o California Passes Law Mandating E-Mail Addresses From File-Swappers

Sacramento, Calif. -- It is now illegal in the state of California to trade songs or movies on the Internet without the sender including his or her valid e-mail address. Earlier this week, Gov. Arnold Schwarzenegger signed the Motion Picture Association of America-sponsored SB 1506, introduced by state Sen. Kevin Murray, into law. File-swappers who fail to include a valid e-mail will be guilty of a misdemeanor. Proponents said the law will enable law enforcement to attack piracy more effectively; those opposed to the legislation, including the Electronic Frontier Foundation and American Civil Liberties Union, said it infringes privacy rights and will make criminals out of casual file-swappers. The governor also made it a crime this week to use state-owned computers for file-sharing.

o Report: Sony to Add Support for MP3 Format to Portable Music Players

San Francisco -- Sony is developing support for the popular MP3 format into its line of portable digital music players, in a shift that may move the company more into the line of both smaller manufacturers and rival Apple, whose devices support multiple formats, ZDNet France reported. "We're discussing plans to bring flash players to the United States that support MP3 files, but we have nothing to announce at this time," Gretchen Griswold, a representative of Sony Electronics, told ZDNet France. Previously, Sony devices only played tracks encoded in its proprietary ATRAC 3 format; likewise, the company only sells ATRAC 3 songs on its Connect music service. Apple has come under fire from rivals like RealNetworks for only supporting an in-house format for downloads from its iTunes Store to its iPod players; however, the iPod has always supported playback of MP3 files. A source told ZDNet France Sony is also considering MP3 support in its hard disk players. "We want to push Atrac on our music download services and remain convinced that it is the best format on the market," the ZDNet France source said. "But it is clear that the industry benchmark is Apple's iPod, which is compatible with MP3."

o Survey: Most View Internet, TV As Media Equals

New York -- Consumers increasingly view the Internet as just as viable a source of information and entertainment as television or newspapers, according to a survey of 18 to 54 year-olds conducted by Frank N. Magid Associates on behalf of the Online Publishers Association (OPA). Nearly forty-six percent of respondents cited the Internet as their "top media choice," followed by television (34.6%) and newspapers (3.2%). Among 18 to 24 year-olds, 50.5% picked the Internet over television (28.5%). Overall, 73% said the Internet is an important part of their day and helps them keep up with topics of interest, and 47% report using it more than they did a year ago. Nineteen percent said they use the Internet more than five hours per day during the week, while 15% watch more than five hours of TV per day. "Consumers continue to move beyond purely functional uses of the Internet into more media-oriented activities, such as reading stories, looking at photos, and watching video," said OPA president Michael Zimbalist. The survey found that 83% said reading a news story online is the same or better than a newspaper, and 67% said watching a short clip online is the same or better than TV. However, 63% still believe television is better for longer programs.

o RealNetworks to Combine RealPlayer Software, Music Services Units

Seattle -- RealNetworks, a provider of media delivery technology, announced on Thursday a plan to integrate its RealPlayer and Music Services businesses into a single unit, bringing together the teams that develop its audio and video playback software, RealPlayer, and its RealPlayer Music Store, RadioPass and Rhapsody services. The combined unit will be headed by Robert Acker, who currently serves as vice president of the RealPlayer unit. "Over the next year we believe it's critical to adopt a holistic approach that tightly integrates our player and music businesses, especially as we begin developing a new version of Rhapsody that includes Harmony technology," said RealNetworks CEO Rob Glaser. Seattle-based RealNetworks also announced the departure of vice president of music services Sean Ryan -- former CEO of Listen.com -- who left to pursue other business opportunities. The company also said that it has named former Listen.com executive Nirangan Nagar as general manager of its music services division, overseeing operations of the RealPlayer Music Store and Rhapsody service.

o Report: 2004 U.S. Ringtone Sales Double to $300 Million

New York -- Global sales of ringtones for cell phones in 2004 will reach $4 billion, with the U.S. contributing $300 million to the total, according to a report from New York-based mobile market analysis firm Consect. U.S. sales will have doubled from 2003's $150 million, and indicate the U.S. is one of the fastest-growing markets for ringtones. "Surpassing $300 million this year, ringtone sales are becoming a significant component of the music industry's business, exceeding that of digital music downloads even at this early stage of the market," said Consect CEO Mark Frieser. The U.S. market is still dwarfed by Western Europe, which will see $1.5 billion in ringtone revenues in 2004, as well as Korea ($500 million); the rest of the world is projected to generate a combined $700 million.

o Watered-Down Video Game Sales Bill Passes in California

Sacramento, Calif. -- Gov. Arnold Schwarzenegger has signed a Calif. state bill into law that will require retailers to prominently display ESRB video game ratings in their stores, as well as provide pamphlets on the ratings system to parents. An earlier version of AB 1793, introduced by Assemblyman Leland Yee, would have compelled retailers to cordon off "Mature"-rated titles in a separate part of the store and penalized clerks violating the ban on the sale of such games to minors with a $2000 fine and up to one year in prison. That version of Yee's bill was rejected.

o Google Prevails in German Paid-Search Ad Trademark Suit

Frankfurt, Germany -- A German court has ruled against a company that filed suit against search engine firm Google, saying Google did not infringe the company's trademarks with its keyword search-based advertising service, the Associated Press reported. Metaspinner Media argued that Google Deutschland infringed on its trademarked "Preispirated" ("Price Pirate") software by allowing advertisers to bid on the term for ad placements. Metaspinner Media attorney Petra Bosbach told AP the decision may take weeks to analyze, while Google had no comment. The search engine firm faces similar trademark infringement claims in both the U.S. and France.

o Study: Most People Completely Dependent on Internet

Sunnyvale, Calif. -- People are so dependent on the Internet that they on average can't go without being online for more than five days, according to a new study funded by Web portal Yahoo. Participants in the Internet Deprivation Study found living without the Internet more difficult than they expected, and in some cases impossible, since they rely so heavily on Web-based tools and services in their daily lives. Nearly half the respondents indicated they could not go without the Internet for more than two weeks, with the average time being just five days. The study also further illustrated the concept of the "digital divide," with three quarters of respondents agreeing that the Internet gives them an advantage over those who don't have access to it, including lower prices, quicker service and more convenience.

(Franklin, Tenn.) PassAlong Networks, a Tennessee-based start-up, on Thursday announced the launch of its digital music download store, which features over 200,000 tracks licensed from both major and independent labels. In addition to a standalone store at PassAlong.com, the company is also launching a companion store on eBay that will be the first to feature major label songs. PassAlong expects to offer the complete digital catalogs of all four major labels and increase its library to 500,000 tracks by the end of the month. The service also allows users to send links to songs via e-mail or instant messaging services. If the recipient then purchases a track from PassAlong, the sender earns points redeemable for digital music. The company is promoting its launch with a contest featuring RCA artist Avril Lavigne.

(Overland Park, Kan.) Wireless carrier Sprint on Thursday launched two new pro football wireless services for its subscribers with PCS Vision handsets. With partner THQ Wireless, the company launched the first pro football player voice ringers, which feature NFL players including Tony Gonzalez, Priest Holmes, Daunte Culpepper, Torry Holt, Clinton Portis and Michael Strahan. For $2.50 each, subscribers can set their phone to ring with a phrase such as, "Hey, this is Daunte Culpepper, #11 QB for Minnesota. Pick up your phone; it's game time, baby." Another service, SportsTracker from 1KTV, will deliver football scores, news and stats to subscribers for $3.95 per month.

(London) Beep Science, a provider of digital rights management technologies, announced that Sony Network Services Europe will use its system to secure its mobile music streaming service, StreamMan. London-based Beep Science's copyright protection technology is based on the OMA v2 DRM standard. Sony's StreamMan, currently available to TeliaSonera Finland cellular customers, offers personal streaming music channels, creation and sharing of playlists, and downloads, in addition to other content like business, local and entertainment news.

(San Francisco) Sega of America has shipped its "Redemption" title for PlayStation 2 and Xbox to retailers. The title is the sequel to Sega's "Headhunter" action/stealth game. Sega also released "Blood Will Tell" for PlayStation 2, which is based on Japanese manga legend Osamu Tezuka's "Dororo."

(Calabasas Hills, Calif.) Video game publisher THQ said on Thursday that it has signed an agreement with MGA Entertainment giving it the rights to develop games based on Bratz, the doll line that has sold over 80 million units worldwide. The property also recently debuted on home video, and a feature film is scheduled for release in 2006. Calabasas Hills, Calif.-based THQ said its first Bratz titles will be released in the fall of 2005.

(Shanghai, China) Chinese online games operator Shanda Interactive Entertainment said on Thursday that developer Nexon's "BNB" casual game recently recorded a record 700,000 concurrent users, which the company claims makes it the world's largest online game. Shanda also said it is currently developing "Maplestory," a 2D side-scrolling online game, for launch later this year. Earlier this week, Shanda acquired a controlling stake in Chinese mobile games developer Beijing Digital-Red Mobile Software.

(Boston) Wireless entertainment publisher Chasma said on Thursday that it has developed a wireless game based on the Poker Superstar Invitational Tourament, which is broadcast in the U.S. on Fox Sports. Boston-based Chasma said the multiplayer game for BREW- and Java-enabled handsets will offer tutorials from accomplished pro poker players.

(San Francisco) The San Francisco Chronicle reports that a website which posted video of the grisly beheading of U.S. contract worker Eugene "Jack" Armstrong in Iraq on Monday was viewed by over 1 million visitors, at a rate of 50,000 per hour. Ogrish.com site operator Dan Klinker told The Chronicle that more than half of viewers were U.S. residents. "Everyone wants to look. It is a universal human reaction to tragedy,'' Dr. Mark Levy, a psychiatrist and expert in post-traumatic stress disorder at UCSF, told The Chronicle. "There is both relief -- 'Thank God it wasn't me' -- and identification with the victim -- 'What must it have been like?'."
