o Court Rules Universal's Farmclub.com Liable for Copyright Infringement

New York -- A federal court ruling on Wednesday could make Universal Music
Group liable for damages to songwriters and music publishers relating to
its Farmclub.com, a site that let users stream songs from Universal
artists on-demand. Plaintiffs including the Rodgers and Hammerstein
Organization were granted a partial motion for summary judgment against
UMG, which has since shut down the Farmclub.com service in favor of its
GetMusic site, which does not offer streaming music on-demand.

o EarthLink Cable Modem Service Launches On Time Warner Systems

Atlanta -- EarthLink, a provider of Internet access services, has launched
a high-speed, cable modem-based Internet access services on Time Warner
Cable systems in Columbus, Ohio and Syracuse, New York. Federal regulators
told Time Warner and AOL that a competitor's service must launch before
their own on Time Warner's cable service as part of their approval of the
AOL Time Warner merger. Atlanta-based EarthLink said it will also launch
high-speed services on Time Warner Cable lines in Tampa, Florida and
Raleigh, North Carolina in October, and in a "substantial number" of Time
Warner Cable-services areas by the end of the year.

o Appeals Court Overturns VoyeurDorm.com Ruling; Site Can Stay in Tampa

Tampa, Fla. -- The 11th Circuit Court of Appeals has ruled 3-0 that adult
entertainment site VoyeurDorm.com does not violate zoning laws in the city
of Tampa, and can continue to operate its site that lets viewers observe
coeds living in a house equipped with webcams in a residential
neighborhood. Previously, site operator Entertainment Network, Inc. sued
the city in federal court in an attempt to establish its legality but lost
that case. The higher court's ruling establishes a precedent that such
webcam sites technically operate on the Internet, and not in their
physical locations. "The audience or consumers of the adult entertainment
do not go to [the dorm] or congregate anywhere else in Tampa to enjoy the
entertainment," the 11th Circuit wrote in its ruling. "Indeed, the public
offering occurs over the internet in 'virtual space.'" Entertainment
Network lost an earlier court battle to try to obtain the rights to
webcast the execution of convicted Oklahoma City bomber Timothy McVeigh.
