o Madonna, Eminem, Other Big Musicians In Anti-Piracy Media Campaign

Washington -- A large group of top-name musicians is appearing in
anti-piracy ads developed by the Recording Industry Association of America
(RIAA) in an effort to educate consumers as to how Internet downloading of
music negatively affects artists. The coalition of 90 artists appearing in
the full-page newspaper, radio and TV ads includes Madonna, Britney
Spears, Luciano Pavarotti, Eminem, the Dixie Chicks and Stevie Wonder. The
RIAA quotes figures indicating that CD shipments fell 7 percent in the
first half of this year, and points to Internet piracy as a key factor for
the decline. "Illegally downloading is stealing, and it's against the law
plain and simple," said RIAA CEO Hilary Rosen. The ad campaign coincides
with a hearing in the U.S. House Thursday, on piracy and peer-to-peer
systems.

o OpenTV Acquires Interactive TV Firms ACTV, Wink Communications

Mountain View, Calif. -- OpenTV, a provider of interactive TV software and
services, announced on Thursday that it has acquired two other interactive
TV firms, ACTV and Wink Communications. OpenTV will pay around $92 million
in stock for ACTV, which develops interactive TV advertising. The company
also said that Liberty's Media's interactive TV division, Liberty
Broadband Interactive Television, has agreed to sell recently acquired
Wink Communications -- which provides interactive TV ads and content
through a specially-enabled set-top box -- for $101 million. Mountain
View, Calif.-based OpenTV said that when combined with ACTV and Wink, the
company will have approximately $160 million in cash, no debt and a total
of over 35 million homes with one or more of its interactive TV products
or services. "Integrating these technologies with OpenTV's middleware
business and international distribution should enable us to offer a much
broader array of products and services to the global pay television
industry," said Peter C. Boylan III, chairman of OpenTV and CEO of Liberty
Broadband Interactive Television.

o Universal Music Sued Over PIN Technology Used On New Bon Jovi CDs

New York -- A software firm has sued Universal Music Group over PIN
number-based technology it is including along with rock band Bon Jovi's
upcoming album, "Bounce." New York-based DownloadCard offers promotional
"credit cards" with a serial number that unlocks "exclusive Card holder
content, including music, video, off and online coupons, entrance to
'member only' websites and sweepstakes," according to a description on the
company's site. Its products have been used by record label Island/Def Jam
to promote artists including Musiq and Rusted Root. DownloadCard claims
that a program called "American XS," which includes a unique serial number
on each new Bon Jovi CD enabling access to exclusive online content, is
essentially the same as its proprietary technology, and was in fact
offered to Universal at an earlier date as a promotional tool. The company
is seeking an injunction on the release of the Bon Jovi album, due Oct. 8,
as well as undisclosed compensatory damages from Universal Music. The
trial will be heard Oct. 3 in the U.S. District Court in the Southern
District of New York.

o Report: Media Firms Focusing on Encryption, Instead of Business Models

Los Angeles -- Media companies, in an effort to stop piracy, are spending
far too much time on encryption and other defense technologies and are
failing to develop proactive strategies to recognize and leverage their
online intellectual property assets, according to a recently released
report from consulting firm KPMG. The study surveyed about 40
international media executives, and found that most firms are focused on
developing encryption and other digital rights management technologies to
prevent piracy, rather than on developing business models that appeal to
consumers familiar with free file-sharing services. The report indicates
that only 43 percent of those polled said their companies offer some of
their content in digital form, while 57 percent said their companies do
not even have a process for classifying online intellectual property.

Briefly Noted:

(San Francisco) Microsoft experienced technical difficulties with the
release of the digital version of a new album from musician Peter Gabriel,
the Associated Press reported on Thursday. Links from both Gabriel's and
Microsoft's sites did not connect to a payment page, a problem Microsoft
attributed to "bad timing between various retailers and distributors
around the globe." The album is the first to be offered in its entirety in
Microsoft's Windows Media Audio Pro Format; the digital version sells for
$9.99.

(Helsinki, Finland) Cell phone maker Nokia and partner wireless network
operator Sonera on Thursday announced they have completed live
demonstrations of a new phone model working on a dual wideband-CDMA/GSM
platform. The advanced system allows for two simultaneous data feeds, so
for instance a user may be on the phone while recording video. A new
handset, the Nokia 6650, may use the network to record video
simultaneously with sound -- for up to twenty seconds, in 4096 colors.
Pictures or clips can be sent to other compatible phones or emailed as MMS
messages. The phone also comes with software enabling users to edit their
phone video clips on a PC.

(New York) Cornerband, an online music promotional service that operates
on Sharman Networks' Kazaa file-sharing service, said on Thursday that
bands using its service have had their songs downloaded over 3 million
times since the service launched four weeks ago. Cornerband is a part of
Altnet, a secure file-sharing component on Kazaa operated by Los
Angeles-based Brilliant Digital. New York-based Cornerband said artists
including Jay Quinn Band, PT Phunk and Two Guy Trio -- who each paid
between $35 and $200 to use the service -- each received more than 200,000
downloads of their music on Altnet.

(Los Angeles) New Line Cinema announced it will premiere the trailer for
its upcoming release "Lord of the Rings: The Two Towers" on America
Online. Both New Line and America Online are units of AOL Time Warner. The
trailer will be available for a 24-hour period from midnight on Monday,

trilogy was downloaded 1.7 million times in the first 24 hours.

(Austin) NCSoft, a Korean publisher of online games, announced on Thursday
that it will publish Colorado-based game developer NetDevil's massively
multiplayer online game, "Wreckage." The game is scheduled for release in
2004-2005. NCSoft operates "Lineage," currently the most widely-played
online game in the world, and also recently launched service for Sony
Online Entertainment's "EverQuest" online game in Korea.

(New York) The Associated Press on Thursday published an article exploring
the demographics of video game players. According to data from the
Interactive Digital Software Association (IDSA), an industry trade group,
40 percent of the most frequent PC game players are 35 or older. "As
people who grew up in their teens playing games have moved into adulthood,
they have continued to play games, and have integrated these games into
their entertainment diet," IDSA president Douglas Lowenstein told the AP.

(San Francisco) Wired News recently reported on a Tuesday House of
Representatives telecommunications subcommittee hearing on the digital
television transition, featuring testimony from the broadcasting and cable
TV industries. The House Energy and Commerce Committee has introduced a
new bill that would require TV signals to be broadcast digitally by 2006,
ahead of an earlier 2007 FCC mandate.
