o Sensenbrenner Bill Would Delay Webcast Royalty Payments for Six Months

Washington -- U.S. House Judiciary Committee Chairman James Sensenbrenner
introduced a bill late Thursday that would delay the payment of royalties
by webcasters streaming music online for six months. The delay would give
time for legal appeals of the actual rates by both the record labels and
webcasters to be heard in court, in addition to giving small webcasters
more time to work out their own deals with record labels. Many smaller
webcasters have said that the rate set is so high that it will force them
out of business. The Librarian of Congress set a rate of .07 cents per
song per listener that is scheduled to go into effect on Oct. 20; the
Sensenbrenner bill will be expedited and likely see a vote next week in
advance of the Oct. 20 deadline.

o Congressional Hearing Discusses Piracy on Peer-to-Peer Networks

Washington -- CNET News.com provided coverage of Thursday's congressional
hearing that discussed piracy on peer-to-peer networks, and specifically a
bill introduced by Rep. Howard Berman (D-Ca.) that would allow
entertainment companies use technology to disrupt the unauthorized flow of
copyrighted media on file-sharing services. Opponents of the bill stress
that it does not outline which technologies are legal, nor does it give
sufficient legal recourse for those individual users who may be targeted
in error. "I never expected that anyone would challenge the underlying
premise of the bill, namely that copyrighted owners should be able to use
reasonable, limited measures to thwart peer-to-peer piracy," said Berman,
at the hearing. "Some have characterized it [the bill] as allowing
copyright vigilantism or letting record companies and movie studios hack
into people's computers and crash networks," said Hilary Rosen, CEO of the
Recording Industry Association of America. "These irresponsible
descriptions at best reveal a misunderstanding of the text and purpose of
the bill, and at worst purposely cloud the real issues."

o Report: French Video Games Maker Infogrames Plans Job Cuts  

Paris -- Europe's largest video games maker, Infogrames, plans to make
drastic job cuts in France in an effort to cut costs, a French newspaper
reported on Friday. Les Echos said Infogrames plans to cut 280 jobs, or
about 60 percent of its workforce in France. The article said other job
cuts could also be in store in Germany and Britain. Infogrames earlier
this month posted a bigger-than-expected first half loss and announced
plans to tighten costs. Infogrames employs about 880 people in Europe,
roughly the same as in the United States. It has sites in France, Britain,
Belgium and Germany and has already cut around 150 jobs in Europe over the
past year.

o Creditors Might Challenge Bertelsmann's Right to Napster Sale Proceeds

Los Angeles -- Bertelsmann may find opposition from other creditors of
bankrupt file-sharing service Napster as it tries to claim the first spot
in line to be repaid after a sale of the company's assets, "sources close
to the matter" told Reuters. Bertelsmann invested in the neighborhood of
$100 million in Napster, some of its as "secured" loans which would place
the company ahead of "unsecured" creditors like record labels and music
publishers in line to be repaid. Many of these parties, sources told
Reuters, are likely to sue challenging Bertelsmann's secured creditor
status.

Friday that it partnered with Music Choice, a provider of digital music
programming, and interactive TV firm Wink Communications to launch an
interactive channel that will enable customers to shop for music and
purchase multiple CD titles using their television remote control.
Customers may browse while listening on Music Choice through their
televisions, and make purchases on a pre-determined credit card using a
four-digit PIN.

(San Jose, Calif.) Game developer Bam Entertainment announced that its
Nintendo Game Boy Advance title based on the action film "Ballistic: Ecks
vs. Sever," currently in theaters, began shipping to retailers this week.

(San Francisco) Wired News on Friday reported on angry users of the PC
version of Logic, a music editing program sold by recent Apple acquisition
EMagic. Apple plans to discontinue the PC version of Logic at the end of
September in an attempt to woo users to the Mac version of Logic, and to
Apple hardware in general. Over 2,000 PC users have petitioned Apple to
stay its termination order. "Historically, Apple has been willing to take
hits in the short term in order to guarantee a position in the long term,"
Tim Bajarin, president of consulting firm Create Strategies, told Wired
News.

"hot-rod PC" developed by manufacturer Systemax specifically for the
advanced processing and graphics acceleration needs of PC gamers. The
$2,400 "Double X" desktop PC offers dual hard drives, top AMD or Intel
processors and the top Nvidia graphics card, in addition to a
water-cooling system and a plastic casing for the tower so owners can show
off their souped-up PCs.

(New York) The New York Times on Friday reported on software being
distributed along with a number of file-sharing programs, including
Morpheus, LimeWire, Kazaa, BearShare and others, which "steals"
commissions for directing online shoppers to sites like Amazon.com from
smaller online partners that derive large parts of their revenues from the
commissions. Last week, Amazon stopped affiliate commission payments to
Morpheus, which was being paid a commission each time those who downloaded
New York-based Wurld Media's commission-grabbing software along with
Morpheus bought at Amazon. "We don't allow sites that use a download or a
tool to redirect a shopping session to their account if they do not
initiate the shopping session," Amazon spokeswoman Patty Smith told The
Times. "We've kicked out a number of sites for doing that."
