o U.S. House Approves Three-Year Prison Terms for File-Swappers

Washington -- The U.S. House of Representatives on Tuesday approved legislation that would provide three-year prison terms for file-swappers, and direct federal agents to actively target those who offer songs on peer-to-peer networks like Kazaa. Under the Piracy Deterrence and Education Act, the FBI would be called on to educate the public on copyright laws, and be empowered to send warnings to people suspected of committing copyright infringement on file-sharing networks; those who were found to be sharing more than 1,000 songs would face prosecution. A similar bill has already passed in the Senate, but differences in the two will need to be worked out before the president could sign it into law. The House bill would also provide a three-year prison term for anyone who brings a camcorder into a movie theater to pirate a film. Another provision protects companies that that have invented technological means of editing out sex and violence from films, for the benefit of parents and more conservative viewers.

o SoundExchange Seeks 38,000 Artists Owed $1 Million in Unclaimed Royalties

New York -- SoundExchange, the recording industry non-profit set up to collect and distribute royalties to record labels and artists from satellite, Internet and cable TV radio music broadcasts, has announced that it is seeking over 38,000 artists who are owed around $1 million in unclaimed royalties. If the artists in question -- who include The Shangri-Las ("Leader of the Pack") and Black Sheep ("The Choice is Yours") -- do not step forward by Dec. 31, their royalties will be forfeited into a general pool that covers SoundExchange administrative costs and is also re-distributed to member record labels and artists. SoundExchange, which has distributed nearly $16 million in royalties since 2000, said payouts range from $10 to about $6,000 per artist. "I am very pleased that SoundExchange has signed up thousands of artists. Our search, however, has made us realize how many thousands more we still must find," said SoundExchange executive director John Simson. "Today we are launching our most aggressive effort to locate and pay the deserving artists who are either unaware of their new right or who have not come forward to claim their earnings." Artists are encouraged to visit SoundExchange.com to determine if they are owed royalties for digital performances of their music for the period between 1996 and 2000.

o Apple to Launch iTunes Stores in More European Countries Next Month

Berlin -- Apple Computer plans to expand its iTunes digital music store into additional European countries in October, but declined to name which countries will be included in the expansion, Reuters reported on Wednesday. The company currently operates iTunes stores in the U.K., France and Germany. "We are well on pace to launch more EU stores. We will do it next month," Apple vice president of applications Eddie Cue said at the Popkomm conference in Berlin. "It will cover a good portion of Western Europe." Apple's iTunes stores in the U.S. and Europe have to date sold more than 125 million downloads.

o Judge Throws Out Federal Ban on Sale of Live Concert Bootlegs

New York -- A federal judge in New York has struck down a 1994 law that made it illegal to sell bootleg recordings of live concert performances, Billboard.com reported. U.S. District Judge Harold Baer Jr. threw out the indictment of Jean Martignon, a Manhattan woman who runs a mail-order bootleg business called Midnight Records. In his ruling, Baer Jr. said the anti-bootleg law went beyond standard laws regarding studio recordings because it placed no time limit on the ban; copyrights on studio recordings expire 70 years after the author's death. The Recording Industry Association of America (RIAA) said the decision "stands in marked contrast to existing law and prior decisions that have determined that Congress was well within its constitutional authority to adopt legislation that prevented trafficking in copies of unauthorized recordings of live performances." The U.S. attorney's office in Manhattan has not yet said if it will appeal the ruling.

o Sony to Release Wireless Broadband Portable TV Sets

Toronto -- Japanese electronics giant Sony has introduced a portable, wireless TV set that can receive TV signals and music over the Internet from anywhere. Sony will begin selling two models of its LocationFree TV in Canada next month -- a $1,965 model with a 12-inch LCD touch screen, and $1,258 model with a 7-inch screen. The devices feature a carrying handle, 2 to 3-hour rechargeable battery, Memory Stick media slot and Ethernet port. They can surf the Web and check e-mail, but do not feature a hard disk drive, as Sony says the device can program home PCs to record TV content that may then be downloaded to the LocationFree TV over the Internet for viewing.

o Loudeye Expands P2P Anti-Piracy Service to European Market

Berlin -- Loudeye, a provider of streaming song samples and other digital media services, announced on Wednesday that it has launched its Overpeer anti-piracy service in the European marketplace. The service, which will be distributed through Loudeye's European OD2 subsidiary, promises "99% effectiveness in preventing the illegal sharing of digital media across peer-to-peer networks." Seattle-based Loudeye said that Overpeer currently protects more than 60,000 digital entertainment titles, and that each month it averages 25 billion digital download hits against its servers, blocking distribution of copyrighted material across 200 million unique user sessions.

(Cupertino, Calif.) Apple Computer on Wednesday released Logic Pro 7 and Logic Express 7, updates to its professional music creation and audio production software. The company also released two new Jam Packs for its GarageBand music creation software, containing licensed pre-recorded loops and software-based instruments. The Remix Tools pack offers production tools for dance, hip-hop and electronica tracks, while the Rhythm Section pack offers percussion instrument production tools for rock, alternative and country music.

(New York) Sirius Satellite Radio, a provider of satellite-delivered digital radio programming, announced that new radios capable of receiving its satellite service will go on sale at retail giant Wal-Mart this week. The Sanyo CRSR-10 Plug & Play receiver will sell for $149; New York-based Sirius' radio service costs an additional $12.95 per month.

(Nuremburg, Germany) Coding Technologies, a developer of audio compression technology, said on Wednesday that its aacPlus codec has been standardized by 3GPP, a wireless communications standards group, as the codec for high-quality content delivery. Germany-based Coding Technologies said that aacPlus is already used for mobile music download services offered by European wireless carriers O2 and Vodafone.

(London) Shazam Entertainment has announced that it has identified over 1 million songs for U.K. cell phone users who have called its service and placed their phone near an audio speaker in the last nine months. The company has created a database of over 2.2 million tracks that can be identified by its technology after hearing only a small snippet of a song over a cell phone connection. London-based Shazam also recently signed a deal with U.K. music promote Mean Fiddler that will allow users to download full songs tagged by the Shazam service.

(Los Angeles) Independent online music store AudioLunchbox.com said on Wednesday that, with the recent addition of tracks from 3,700 labels to its system, the store will offer over 500,000 songs from 50,000 artists on 4,200 labels by early December. Recent label additions include Beggars/Matador, Kill Rock Stars and Doghouse Records. The service, which offers tracks in 192 kbps MP3 format for $0.99, aims to eventually offer 1 million independent songs for download.

(Stuttgart, Germany) Automaker Mercedes-Benz said on Wednesday that it has to date racked up over 1.4 million downloads of songs from its "Mixed Tape" free download website, which promotes independent artists. The company has so far produced two such albums, and says the site now draws submissions from over 300 artists per month.

(London) M-connected, a U.K.-based mobile gaming firm, announced that it has launched a horseracing game that allows users to bet using their cell phones. The company said its new "V-Bet Mobile" service -- developed jointly with Kiron Interactive, a virtual racing company based in South Africa -- would be able to show an entire horse race on a mobile handset. "Giving punters the ability to self-generate their own event and to wager upon it wherever they are is a true representation of the here and now mobile generation," said m-connected commercial director Julien Parven.

(Cologne, Germany) Storage media manufacturer SanDisk on Wednesday introduced its SanDisk Photo Album, a portable device that allows digital pictures to be displayed on a TV, and also plays video clips and MP3 music files. Sunnyvale, Calif.-based SanDisk said the $49 device comes with a 256MB flash memory card capable of holding up to 4,000 photos.

(Santa Monica, Calif.) C.A.C. Media, a provider of home networking software, said on Wednesday that it has partnered with broadband media device maker Video Without Boundaries (VWB) to launch a content delivery network that will supply DVD-quality video to televisions over the Internet. The service will deliver video-on-demand and other content to TVs equipped with VWB's MediaReady set-top box. Independently-produced content channels include "Celebrity Gossip," "Become a Magician" and "Frat Party USA." A pilot with 5,000 households is planned by the end of 2004, with the goal of increasing to 250,000 by the end of 2005.

(Santa Monica, Calif.) Game publisher Activision on Wednesday announced the release of its "Shark Tale" title for PlayStation 2, Xbox, GameCube, Game Boy Advance and the PC, based on the DreamWorks digitally-animated feature film. The console versions were developed by Edge of Reality, while the Game Boy Advance version was created by Vicarious Visions and the PC version by Amaze Entertainment. The "Shark Tale" film opens in theaters on Oct. 1.

(London) The BBC Online recently reported that researchers at Imperial College London are developing a new data storage method that could result in discs capable of holding 1,000 gigabytes. The method would create four disc layers with a total capacity of 472 hours of video, or enough to hold every episode of "The Simpsons." Next-generation DVD technology currently in the works -- HD-DVD and Blu-ray -- have the potential to increase current DVD capacity from 4.5GB to 30GB and 50GB, respectively. The Imperial College researchers envision a commercial version of the 1,000GB discs by 2010.
