o Congress Declines Action on
File-Sharing
Washington - Although one U.S. Senator and the Register of
Copyrights argued that Congress should step in and legislate
file-sharing, a Senate Judiciary Committee hearing on Wednesday
concluded that Congress will not enter the fray for the time being,
CNET News.com reported. Sen. Diane Feinstein (D-Calif.) said that
despite the recent Supreme Court ruling that holds peer-to-peer
software providers accountable for copyright infringement, users of
the software have since increased. "If we don't stop it, it's going
to destroy these intellectual property industries," said Feinstein.
The U.S. Copyright Office's Register of Copyrights, Mary Beth
Peters, argued that Congress should create a "blanket" license to
improve efficiency in licensing of digital works. But as the hearing
closed, it appeared Congress will not introduce file-sharing
legislation for the time being. "At least in the short term, I think
we'll carry out the wishes of those who want us to do nothing," said
Judiciary Committee chairman Sen. Arlen Specter (R-Penn.).
Meanwhile, distributors of two of the most popular file-sharing
services -- BitTorrent and eDonkey -- have both announced plans to
convert their software into legal media distribution platforms.

File-Sharing Software Firm BitTorrent Raises $8.75 Million
San Francisco - BitTorrent, a developer of peer-to-peer
file-sharing software with 45 million users, announced that it has
raised $8.75 million in its first round of venture capital
financing, which the company intends to use to develop its software
into a commercial digital distribution tool for media firms. Doll
Capital Management (DCM) led the investment round. BitTorrent
creator Bram Cohen did not specifically announce that his software
would immediately cease support for trading of free music, movies,
games and other copyrighted works, but he did speak of cooperating
with media firms. "While BitTorrent already has become the de facto
protocol for cooperative distribution on the Internet, DCM shares
our belief that BitTorrent will become the ideal platform for both
independent publishers and the world's leading media companies
alike," said Cohen. "We are committed to working with content
creators and distributors to shape the future of media
distribution." DCM co-founder David Chao was more explicit. "We
believe BitTorrent's cooperative distribution technology will become
the leading platform for the legal and secure distribution of
large-file content for a wide range of commercial purposes around
the globe," said Chao. BitTorrent's software is already used by
firms including Red Hat, Sun Microsystems, PBS and Blizzard
Entertainment for legal content distribution.

Peer-to-Peer Software Firm eDonkey Announces Plans to Go Legit
Washington - eDonkey, currently one of the most-popular
file-sharing networks in the world, announced its intention at a
Senate Judiciary Committee hearing on file-sharing Wednesday to
convert to a legal for-pay service, in the wake of new litigation
threats from the recording industry, InformationWeek reported.
"Because we cannot afford to fight a lawsuit -- even one we think we
would win -- we have instead prepared to convert eDonkey's user base
to an online content retailer operating in a 'closed' P2P
environment," said Sam Yagan, the president of eDonkey distributor
MetaMachine, during his testimony at the hearing. The Recording
Industry Association of America (RIAA) recently sent
cease-and-desist letters to a number of file-sharing firms,
emboldened by the recent Supreme Court ruling that found P2P
software providers liable for copyright infringement. The letters
have also been credited with shutting down the distribution site of
WinMX, another popular file-sharing service.

Introduces Line of $49 Digital Music Players for Kids
New York - Joining a lucrative market currently dominated
by Apple's iPod, Disney on Thursday introduced a line of portable
digital music players designed specifically for kids and teens. The
$49 Disney Mix Stick is PC and Mac compatible, will come in three
color schemes, and will feature 128MB of memory (upgradeable to 1GB)
when it goes on sale in October. In addition to downloading songs
from a PC or ripping them from a CD, Disney will also sell Disney
Mix Clip WMA memory cards with pre-loaded full-length albums.
Compilations such as "Radio Disney Ultimate Jams" and "That's So
Raven: Songs Inspired by the Hit TV Series" will carry a suggested
retail price equivalent to CDs. Disney will also offer a range of
accessories for the Mix Stick, including a $39 set of external
speakers, several styles of headphones, and a number of carrying
cases.

Emmy Award for PlayStation
Foster City, Calif. - Sony Computer Entertainment
announced on Thursday that it has been awarded an Emmy by the
National Academy of Television Arts and Sciences (NATAS). The award
for Outstanding Achievement in Technology and Advanced New Media,
for Sony's pioneering of the 3D polygonal-based gaming experience,
will be accepted by SCEA president and CEO Kaz Hirai today at the
57th Annual Technology & Engineering Emmy Awards in Princeton, N.J.
"Emerging technologies in digital media play an important role in
the way in which people consume in-home entertainment, and gaming in
particular has been a consistent source of innovation in recent
years," said Seth Haberman, chair of the Video Gaming and Technology
Awards panel for NATAS. "We felt that the advent of PlayStation
exemplified a significant shift in the direction of the gaming."

Guidance, Citing $4 Million Class Action Settlement
Los Gatos, Calif. - Online DVD rental service Netflix on
Thursday lowered its profit outlook for the third quarter, citing
the potential $4 million in damages it faces in settling a class
action lawsuit. The company was sued in Sept. 2004, over claims of
false advertising for its DVD rental service. The settlement is
expected to reach between $3 million and $4 million. Los Gatos,
Calif.-based Netflix now expects earnings of between $2.5 million
and $5.3 million for the third quarter, down from $4.5 million to $8
million. The company also slightly increased its subscriber
projections for the quarter, from an estimate of between 3.35
million and 3.5 million, to a new forecast of 3.59 million to 3.61
million subscribers.

With DirecTV, Duke Basketball's Mike Krzyzewski
Washington - XM Satellite Radio, a provider of
subscription radio programming with 5 million subscribers, said on
Thursday that much of its programming will soon be available to 14.6
million subscribers of satellite television service DirecTV.
Beginning November 15, DirecTV subscribers will have access to 72
channels of XM's music, children's and talk programming. Separately,
D.C.-based XM said it signed an agreement with Duke University men's
basketball team coach Mike Krzyzewski to host a show on XM.
"Basketball and Beyond with Coach K" will feature Krzyzewski and
sportscaster co-host Dave Sims conducting interviews with athletes,
entertainers and business leaders, and offer Krzyzewski's "personal
perspective on principles for life on and off the court."

Industry Reports Record Subscriber Additions
San Francisco - The wireless industry on Wednesday
reported the largest one-year addition of new subscribers since
first offering commercial service in 1983, adding 25.2 million
subscribers for the year ending in June. Steve Largent, the
president of wireless industry association CTIA, said that the U.S.
wireless penetration rate of roughly 65% points to more growth in
the future. "When you look at countries in other parts of the world
with penetration rates exceeding 100%, it's only logical to predict
that subscriber growth in the U.S. is far from over," said Largent.
CTIA's semi-annual survey also reported a sharp increase in SMS
traffic and revenue from data services. In the month of June alone,
more than 7.2 billion SMS wireless messages were sent, up from 2.8
billion the previous year. Revenue from text messaging and SMS
traffic was $1.24 billion, up 154%.

Retail Software Developer July Systems Raises $10 Million
Santa Clara, Calif. - July Systems, a developer of
technology that allows mobile operators and content retailers to
market to mass audiences, said that it has received a $10 million in
its third round of funding, led by Motorola Ventures, the investment
arm of mobile handset maker Motorola. July's technology allows for
the creation of mobile storefronts that allow consumers to browse
"virtual malls" on their handheld devices. The company also has
teamed with Motorola to create an architecture designed to handle
all dimensions of mobile services retailing.

Survey: Most Consumers Say Web Poses Threat to Children
San Francisco - The vast majority of consumers believe
that the Internet poses a threat to children, especially from online
predators and pornography, according to a new poll conducted by
Harris Interactive for San Francisco-based Zone Labs. The survey
shows that 94% of consumers believe that the Internet presents a
threat to children -- with 61% citing predators in chat rooms as the
biggest threat and another 16% citing pornographic websites. The
survey also revealed that only 23% of respondents had installed
software to secure their personal computer against such Internet
threats, and 78% said that they don't feel safer computing online
compared with a year ago.

application from Chicago-based start-up Meetroduction that creates
local online social networks using geo-proximity technology and

members within a certain geographic radius. The company said its
current members are mainly 18-30 year-olds in the Chicago and New
York metropolitan areas.
