o Students Prevail Against Diebold in
DMCA "Takedown Notice" Abuse Case
San Jose, Calif. -- In the first ruling regarding the application
of Digital Millennium Copyright Act (DMCA) "takedown notices," a
California district court has ruled that Diebold Election Systems
violated several students' free speech rights when it attempted to
prevent them from publishing company memos detailing flaws in its
electronic voting machines. Two Swarthmore college students and the
independent news site IndyMedia sued Diebold, with the help of the
Electronic Frontier Foundation (EFF), claiming that Diebold
knowingly misused the "takedown notice" as a means of quashing
speech critical of its technology. "No reasonable copyright holder
could have believed that portions of the e-mail archive discussing
possible technical problems with Diebold's voting machines were
protected by copyright," Judge Jeremy Fogel wrote, in his ruling.
"Judge Fogel recognized the fair use of copyrighted materials in
critical discussion and gave speakers a remedy when their speech is
chilled by improper claims of copyright infringement," said EFF
staff attorney Wendy Seltzer.

o TiVo, Netflix
Confirm Planned Internet Movies-on-Demand Service
Los Gatos, Calif. -- Online DVD rental service Netflix and
digital video recorder firm TiVo on Thursday confirmed widespread
speculation that the two companies are collaborating on a service
that would deliver films over the Internet to TiVo devices, where
they could be watched on television. To avoid potential conflicts of
interest, TiVo CEO Mike Ramsay has resigned his seat on the Netflix
board of directors. TiVo and Netflix said they are negotiating with
Hollywood studios to license content for such a service, which would
not launch until next year at the earliest. Recently, the FCC
certified TiVo's content protection technology for use with the
"broadcast flag," which content producers are beginning to embed
into their digital programming with the goal of preventing
unauthorized copying while allowing sharing with friends and family.
Currently, Netflix only offers movies via DVD discs delivered
through the U.S. mail to its 2.1 million subscribers; TiVo has sold
2 million digital video recorders, but only 800,000 of these were
sold through the company and are part of the Netflix deal. The
remaining 1.2 million were sold through partner DirecTV and aren't
part of the agreement, The Los Angeles Times reported.

o RIAA Sues
Another 762 Suspected File-Swappers for Copyright Infringement
Washington -- The Recording Industry Association of America (RIAA)
announced that it has sued another 762 individuals suspected of
copyright infringement on peer-to-peer file-sharing networks,
bringing the total number of people the record label trade group has
filed suit against to nearly 5,400. Those sued as "John Doe"
defendants, whose identities must be provided my their Internet
service providers, included students at 26 colleges; the RIAA also
said it sued 68 defendants whose identities had been revealed as a
result of past "John Doe" suits, and had declined out of court
settlements. The RIAA has offered to settle its copyright
infringement suits against file-swappers for an average of $5,000
each. Since a landmark ruling that found companies distributing
file-sharing software are not liable for copyright infringement, the
recording and motion picture industries have sought to lobby
lawmakers for new laws enabling them to sue companies like Kazaa's
Sharman Networks. Other proposed legislation would empower the FBI
to take action against file-swappers who share over 1,000 songs,
providing a penalty of up to three years in prison.

Bans Sale of Rockstar Games' Violent "Manhunt" Video Game
Sydney -- Australia's Office of Film and Literature
Classification (OFLC) this week announced that it has effectively
banned developer Rockstar Games' violent video game "Manhunt," after
revoking the title's "MA15+" certification that allowed it only to
be sold to those over 15 years of age, Australian IT reported. The
game, which made headlines in the U.K. when it was associated with
the murder of a 14-yeard old by a 17-year old, is now prohibited for
sale to anyone in Australia. "Manhunt," in which players must murder
characters in increasingly more gruesome manners in order to
advance, had been on store shelves in Australia for nearly a year.
"In the Classification Review Board's opinion, the game warrants a
refusal of classification because it contains elements beyond those
set out in the classification guidelines and legislation for a
computer game at the MA15+ classification," the OFLC said in a
statement. The OFLC said it would publish its reasoning behind the
new prohibition within 28 days.

o BBC Closes
Sale of Technology Unit to Germany's Siemens
London -- The BBC on Friday closed the sale of its technology unit
to Siemens, an IT firm based in Germany, for 1.9 billion pounds
($3.4 million). Under the terms of the deal, BBC Technology will be
renamed Siemens Business Services Media Holdings and approximately
1,400 BBC employees will transfer to Siemens. While the BBC has said
in the past that it expects to save as much as 30 million pounds
($54 million) a year over the duration of the 10-year outsourcing
contract, the sale has been hotly contested by trade union BECTU.
BECTU Assistant General Secretary Gerry Morrissey has insisted that
the deal will "not be good" for the BBC in the long term. "This
isn't just the BBC selling off one of its 'Crown Jewels', it's a
case of handing its central nervous system over to the private
sector," he said.

in Talks With THQ, Other Publishers for Master Games License
New York -- Nickelodeon Networks announced on Friday that it is
currently negotiating with several video game publishers and is in
the final stages of awarding its master video game license to create
titles based on Nickelodeon animated properties. The company has
been partnered with Calabasas Hills, Calif.-based THQ for several
years, and the company has released successful titles based on
properties including "SpongeBob SquarePants," but THQ's deal with
the network expires at the end of 2005. Nickelodeon Networks
president Herb Scannell said that the process is being supervised by
independent directors of Viacom, and that no decision has yet been
made.

Japan Copyright Case Over "Dead or Alive" Game Hack
Tokyo -- The Japanese Supreme Court has ruled that a software firm
that created a hack of game developer Tecmo's "Dead or Alive" title
that rendered the female character Kasumi naked violated the
company's copyrights, GamesIndustry.biz reported. Japanese developer
West Side was ordered to pay Tecmo around $18,000 in damages. West
Side prevailed in the original case, but Tecmo then won on a lower
court's appeal, which was recently confirmed by the Japanese Supreme
Court. However, West Side is only one of many developers offering
such hacks; players of the Xbox version of "Dead or Alive Xtreme
Beach Volleyball" can also easily locate software that removes the
bikinis worn by the game's virtual female characters.

AMC Theaters Partner on Digital Release for "The Final Cut"
Santa Monica, Calif. -- Canadian movie studio Lions Gate Films
announced on Friday that it has partnered with AMC Theaters on what
they say is the first-ever exclusive deal for the wide release of a
film via digital cinema technology. Under the terms, Lions Gate will
release "The Final Cut," starring Robin Williams and Mira Sorvino,
exclusively through AMC's Digital Theatre Distribution System to 115
theaters in 27 markets on Oct. 15. A digital file of the movie will
be distributed to the theaters via satellite, eschewing the industry
standard practice of developing individual celluloid film prints for
each theater.

Lauderdale, Fla.) Friendster, a provider of online social networking
services, said on Thursday that it has partnered with Florida-based
Voiceglo, a provider of Internet telephone services. As part of the
agreement, Friendster will begin offering a new telephone powered by
Voiceglo's web- and PC-based phone service, allowing users to make
free calls. Mountain View, Calif.-based Friendster also will
integrate Voiceglo's service into its web site.

(Berlin) Digital Transaction Machines (DTM), a New York-based
start-up, on Friday introduced its ATM-like devices that dispense
music, ringtones, photos and other services at the Popkomm industry
trade show in Berlin. The company's E2Go machines feature a touch
screen menu and enable consumers to use cash, credit or debit cards
to purchase ringtones, custom-burned music CDs and prints of their
digital photos. DTM said it plans to add DVDs, tickets, software and
other products to future device models. The company expects to
announce its first partnership with a worldwide in-store partner in
early November.

(Redwood City, Calif.) Electronic Arts said on Friday that
Rooster Teeth Productions will create a series of promotional movies
featuring elements of EA's "The Sims 2" game, which sold over a
million copies in its first 10 days of release. The "Machinima"
films, which utilize computerized animation, will premiere on a
regular basis at StrangerHood.com. EA bundled software that enables
players to create similar movies along with copies of "The Sims 2."

(Reykjavik, Iceland) TheRegister recently reported that,
following a raid on the homes of 12 suspected users of peer-to-peer
file-sharing software in Iceland, total Internet traffic in the
country dropped a whopping 40%, according to SMAIS, Iceland's
equivalent of the Motion Picture Association. Icelandic authorities
targeting users of the DC++ file-sharing application at the behest
of the SMAIS reportedly found one user storing 2.5 terabytes
(2,500GB) of copyrighted material.
