o U.S. House Passes Online Gambling Ban, Bill Moves On to Senate

Washington -- The U.S. House of Representatives passed a bill yesterday
outlawing the payment of online gambling debts by U.S. banks and credit
card companies, in another effort to prohibit Internet gaming in the U.S.
The bill also requires Internet providers to remove ads and other links to
offshore gambling sites. "It may be impossible to keep illegal gambling
sites off the World Wide Web, but it is entirely possible to prevent
American credit card companies from completing these transactions that
these crooks need to make their money, and that's what this bill does,"
Rep. Joseph Pitt, (R-Pa) told the Associated Press. The bill must now win
approval in the Senate before it adjourns for the upcoming elections to
become law.

o U.K. "Digital Download Day" to Combat Piracy With Free Music Giveaway 

London -- A number of major record labels, U.K. music societies and
digital music distribution firm OD2 have announced that October 3 will be
"Digital Download Day." The initiative will offer legal, free digital
music downloads to U.K. music fans in an attempt to "promote legitimate
digital music and counter digital music piracy." The British Phonographic
Industry and Association of Independent Music Labels (AIM) are supporting
the initiative, and labels including BMG, EMI and Warner and independents
V2 and Mushroom will make 100,000 tracks from 6,000 artists available.
Music retailers HMV and Ministry of Sound and ISPs MSN, Tiscali and
Freeserve will distribute the songs. After registering online, all U.K.
residents will be given credits worth about $8 to spend towards the free
tracks -- which equates to 50 downloads, 500 streams or 5 burned tracks.
"It is time for the record industry to come out fighting. This heralds the
'end of the beginning' for the digital music industry as we move out of
the pirate stage and into something altogether more workable," said artist
Peter Gabriel, founder of OD2.

o European Union Planning Cross-Licensing Scheme for Music Webcasting

Brussels -- In an effort to increase competition, the European Union has
plans to open up online music licensing among its 15 nations and their
neighbors, Reuters reported. Under the plan, hatched by European
Competition Commissioner Mario Monti, radio and TV stations may be given a
choice of the lowest-priced licensing option as the copyright societies in
each country would be empowered to license music for use on the Internet
across all member countries, instead of just their own, EU officials told
Reuters. The plan also calls for a split of the actual fees paid into one
portion for the administrative costs --charged by collection societies to
cull and distribute royalties -- and the other portion for the royalties
themselves. This way, stations could pick the country or agency with the
lowest rate, further encouraging competition.

o Trustee Named In Napster Chapter 11 Bankruptcy Proceedings

Los Angeles -- A trustee has been named in Napster's bankruptcy
proceeding, allowing the company to remain in Chapter 11 bankruptcy and
avoid conversion to Chapter 7 liquidation, where a sale of its assets
would likely bring its creditors less money. Hobey Truesdell, who also
oversaw the liquidation of Drexel Burnham Lambert, will serve as trustee
for Napster. The defunct company's next move is to seek approval from the
court on an undisclosed offer for its assets that it received last week,
which Reuters reports sources close to the proceeding estimate to be $11
million.

(Los Angeles) Black Label Games, a video game developer and subsidiary of
Vivendi Universal Publishing, announced on Wednesday that it has signed an
agreement to license the interactive rights to director Quentin
Tarantino's upcoming Miramax picture, "Kill Bill." Under the agreement,
Black Label will develop at least one title for consoles and the PC, with
Tarantino serving as creative consultant. The film is due for release in
October 2003; the video games will ship along with the home video and DVD
editions of the film in the second quarter of 2004.

(Los Gatos, Calif.) Online DVD rental service Netflix said on Wednesday
that it now counts 742,000 total subscribers, a 122 percent increase over
the past year. The company said its average monthly churn of members
unsubscribing from the service during the third quarter of 2002 was 7.2
percent, up from 6.5 percent a year ago. Additionally, Los Gatos,
Calif.-base Netflix said its penetration in the San Francisco Bay Area is
now 3.5 percent of all households, while penetration in the rest of the
country is at 0.63 percent.

(New York) Digital World Services, a division of Bertelsmann that provides
digital rights management technologies, announced on Wednesday that
Sequoia Peripherals will use its services to provide secure distribution
of media to the online college retailers it serves. New York-based Digital
World Services will enable Sequoia to add digital textbooks, e-books,
audio books, music and educational software to the physical goods it
delivers for schools. Initially, colleges including Princeton, San Jose
State, and University of Puget Sound will offer educational content like

(Philadelphia) Xlibris, a Random House-funded provider of print-on-demand
services for self-publishing authors, on Wednesday announced a new

(New York) The Wall Street Journal featured an interview with 21-year-old
Napster founder Shawn Fanning on Wednesday, focusing on what he has been
up to since the company declared bankruptcy and laid him off last month.
Fanning is now legal guardian of his 15-year-old half-brother, and said he
does have some ideas about future ventures. "I love early-stage companies.
If I do something it's going to be a start-up but right now I'm not in a
position to really say anything. I have some music-related ideas, but I'm
a little burnt out on that space. If I do ultimately pursue those [ideas],
I'm certainly going to make sure that they're well thought out, and I get
the right people involved," Fanning told The Journal.
