o Reps. Boucher, Doolitte Introduce Digital "Fair Use" Legislation

Washington -- A second bill that would preserve consumers' "fair use"
rights to make copies of digital media that exist in the analog realm has
been introduced this week by Rep. Rick Boucher (D-Va.) and John Doolittle
(D-Ca.), on the heels of a similar bill submitted by Rep. Zoe Lofgren
(D-Ca.). Neither Boucher's "Digital Media Consumers' Rights Act" nor
Lofgren's "Digital Choice and Freedom Act" stand much of a chance of
passing with so little time left in the current Congressional session, but
both show opposition to Hollywood-backed legislation that would
effectively strip consumers of their traditionally enjoyed ability to make
personal copies of music and movies they own. In addition to fair use
provisions, Boucher's bill would mandate that copy-protected CDs be
plainly labeled for consumers; the International Federation of the
Phonographic Industry (IFPI) recently introduced such a warning sticker,
but made it optional for record labels. Showing support for Boucher's bill
were technology firms including Verizon, Gateway, Philips and Intel, in
addition to nonprofits like the Consumers Union and American Library
Association.

o RIAA, Verizon In Court Over Alleged Copyright Infringer's Identity

Washington -- The Recording Industry Association of America (RIAA) on
Friday argued in its case against Internet service provider Verizon that
it should not have to have a court's order before it is given identifying
data on alleged copyright infringers who are Verizon subscribers, the
Associated Press reported. Verizon has ignored the RIAA's subpoena for
data revealing the identity of an alleged song-swapper, citing privacy
issues for its subscribers. The judge in the matter, U.S. District Judge
John D. Bates, said in court on Friday that the Digital Millennium
Copyright Act, which provides guidelines on Internet copyright
infringement, "is not organized as being consistent with the argument for
either side," and also said that Congress "could have made the statute
clearer," AP reported. Lawyers for both sides said they did not know when
they expect a ruling from Bates.

o Report: DVD Rental Revenue $2 Billion So Far In 2002, Up 18% From 2001

Encino, Calif. -- DVD rental revenues for the year have surpassed $2
billion, and now account for 33 percent of the total home video rental
market -- up from 17 percent in 2001, according to a report released on
Friday by industry trade group the Video Software Dealers Association. The
DVD share of the video rental market was 17 percent for the year 2001,
when total DVD rental revenues were $1.4 billion, and was 7 percent for
the year 2000, when total DVD rental revenues were $569 million. "The DVD
rental market is beginning to reflect DVD hardware penetration rates,"
said Brad Hackley, Director of Research for VSDA/VidTrac, who added that
an estimated 30 percent of U.S. television households now own a DVD
player.

o EchoStar, NagraStar Join Smart Card-Hacking Case Against NDS

London -- NDS, a unit of Rupert Murdoch's News Corp., announced that it
has received a number of subpoenas requesting documents in connection with
an investigation being conducted by the U.S. Attorney's office in San
Diego, on charges the company hacked its competitors' digital TV "smart
cards" enabling widespread digital TV piracy. London-based NDS was sued in
March by rival smart card developer Canal Plus Technologies, now a unit of
Thomson, and last week satellite TV provider EchoStar Communications Corp.
and smart card developer NagraStar petitioned to join the suit. The lurid
allegations in the case include reports that NDS secretly worked to hack
the security cards -- which allow descrambling of satellite TV signals --
of its competitors at a plant in Israel, and then covertly distributed the
hacks on websites frequented by those interested in digital TV piracy. In
a statement, NDS called the allegations "baseless, and motivated by a
desire on the part of certain persons and entities to cause harm to NDS
and to thwart legitimate competition from NDS."

(San Mateo, Calif.) Virage, a provider of digital video software,
announced that the U.S. Senate will use its technology, along with that of
Washington-based TGS, to record and provide streaming video-on-demand
coverage of its daily hearings. The video, encoded in RealNetworks'
RealVideo format, will be available only to Senate members and their staff
for review in either high-definition or standard video formats. San Mateo,
Calif.-based Virage said the initial system will support 60 hours of
high-definition video and 200 hours of standard-definition video online at
any one time.

(New York) Both America Online and Yahoo have announced a number of online
promotions in advance of the release of Warner Bros. Records artist Faith
Hill's upcoming album, "Cry." AOL is already featuring music videos, and
will offer an audio stream of the complete album the day before it arrives
in stores on Oct. 15. Yahoo created Faith.Yahoo.com to showcase the
artist, with advance streaming of some tracks from the album, as well as

(New York) Playboy.com will launch a version of its site in Taiwan,
through an agreement with Taiwanese multimedia services company Kings
International. The site will mirror the multiple revenue stream model of

(San Francisco) CNET News.com on Friday reported on the considerable cash
winnings some players are accruing while challenging other players in
"skill-based" online games, such as Solitaire. The skill factor
differentiates the games from Vegas-style odds-based gambling, and
therefore makes them legal for online play in the U.S. Mary Dion, a former
accountant who quit her job to play solitaire and other games at sites
like WorldWinner.com, told News.com she estimates having cleared over
$100,000 in winnings last year.

(San Jose, Calif.) The Associated Press recently reported on plans being
hatched by Blockbuster Entertainment, Wal-Mart and Columbia House to
launch online DVD rental services to compete with Netflix, the largest
online company currently offering such a service. The AP said it obtained
internal Wal-Mart documents that show the company plans to launch a
subscription service costing $18.86 per month -- less than Netflix's
$19.95 -- and deliver DVDs from its distribution center in Carrollton, Ga.
Blockbuster has already launched a limited "Freedom Pass" similar to
Netflix's offering, and Columbia House told AP it was looking into a
similar service to offer its 3 million existing members.

several new video games that are "teaching today's teenagers how to wage,
and win, the war against terror." The U.S. Army developed its own title,
"America's Army," where players become U.S. soldiers battling terrorists
in a massively multiplayer online game that has become very popular among
enlisted ranks. Another game, NovaLogic's "Delta Force: Black Hawk Down,"
