o EU Judge Questions Reasoning Behind Ruling Against Microsoft

Brussels -- Some industry experts are speculating that Microsoft could get a victory in its protracted antitrust battle with the EU after Judge Bo Vesterdorf, president of the European Court of First Instance, questioned both the effects and the costs of a ruling against the U.S.-based software giant. In March, the European Commission (EC) decided that Microsoft had violated EU antitrust rules and ordered the company to offer a version of Windows without Media Player. Microsoft has appealed that decision and is now asking the court to suspend penalties levied against it until the appeal process finishes. In the final day of a two-day hearing, Judge Vesterdorf asked the Commission whether the measures would rein in Microsoft or simply increase costs for others. "Isn't it dramatic to impose a remedy to which you don't really know the result, with all the complications it seems to bring for ISVs, OEMs (original equipment manufacturers), for Microsoft and for (RealNetworks') RealPlayer and not really know what will be the result?" he asked Commission lawyers. Microsoft General Counsel Brad Smith was optimistic about his company's chances. "We go forward with all the confidence that we had when we arrived, and we go forward with all the conviction that we brought with us in terms of thinking that there must be a better way to address these issues," he said.

o Firms Partner to Standardize Digital Rights Management

Sunnyvale, Calif. -- A group of seven entertainment, technology and consumer electronics firms have announced the formation of a consortium that will promote interoperability between digital rights management technologies used in the consumer media market. The Coral Consortium -- whose members include HP, Intertrust, Philips, Matsushita, Samsung, Sony and Fox -- will work to create a common technology framework for content, device and service providers, regardless of which digital rights management technologies they use. "The classic approach to solving the interoperability problem is to either use a single proprietary platform for media distribution, or to standardize a common content protection and management technology," said Coral Consortium president Jack Lacy. "Consumers typically just want to buy, play, and use content in an intuitive manner and do not want to dwell on differences between esoteric technology features. Coral aims to provide them with such functionality and ease of use."

o Sony Japan Ditches Music CD Copy-Protection Technology

Tokyo -- Sony's Japanese record label unit has announced that it will abandon its CD copy-protection technology as of Nov. 17, citing more widespread consumer knowledge of copyright laws and penalties for piracy. Sony introduced its "Label Gate" technology in January 2003, initially preventing any playback of the CDs on a PC, but later loosened the anti-piracy technology to prevent ripping of music CDs while allowing playback of secure files on a PC. However, it is unclear what effect the decision will have in the U.S., where Sony's recent record label merger partner BMG continues to release discs that are copy-protected with technology from SunnComm. Sony also recently announced that it had relaxed its format support for its line of portable audio players, which will now play MP3 files in addition to tracks encoded in Sony's proprietary ATRAC 3 format.

o Report: China to Become Top Online Gaming Market by 2007

New York -- With a current online population of 80 million, 15.9% of whom play online games, China is projected to become the world's largest online gaming market by 2007, according to a report from online gaming tournaments provider Game Trust and analyst firm The Diffusion Group. Factors that will spur online games in China include the reluctance of Nintendo and Sony to release consoles in the country due to piracy fears, and the continued import of popular Korean online game titles. The report found that 68% of Chinese online gamers play traditional chess and card games, while 44% play roleplaying games on a regular basis; in Internet cafes, 28% play strategy and first person shooter titles. "We believe that 80% of the Internet's content will be in Chinese in ten years," said Game Trust CEO Adeo Ressi. "Presently, China is the largest online gaming market on a per capita basis but not by dollar volume. As the China gaming marketplace rapidly matures, we expect that economic growth will rise in accordance with Western models. Network gaming comprises one of the largest opportunities in the Chinese Internet services market."

o Founders of Hip-Hop Label Roc-A-Fella Records Launch MP3 Player Line

Los Angeles -- ROC Digital, a unit of the urban lifestyle company that also owns hip-hop label Roc-A-Fella Records (Jay-Z, R. Kelly), on Monday announced its foray into consumer electronics with the launch of its ROCBOX line of MP3 players. The line includes a $299, 20GB hard drive-based player, as well as a $159, 256MB flash memory-based player, both of which will be sold at CompUSA and Macy's Stores beginning in mid-November. "Our first business venture -- and the heart of what we do -- was the formation of Roc-A-Fella Records," said Damon Dash, CEO of ROC and ROC Digital partner. "This is a natural extension of that core that also responds to the state of the continually evolving music marketplace." In addition to the record label and consumer electronics unit, ROC also comprises the Rocawear clothing line, Pro-Keds sneakers, America Magazine, Armadale vodka and Tiret watches.

o Report: Electronic Payments Growing at Rapid Pace

New York -- A fast-growing number of consumers are leaving their cash in their wallets while shopping, according to new research from market research publisher Packaged Facts. The firm said that electronic payments are expected to grow from 33% of consumer payments to 43% by 2007. The growth is being fueled primarily by increased e-commerce, international expansion and an increased number of debit transactions. Also according to the report, the number of households banking by computer grew three-fold between 1999-2003, while those using debit and smart cards more than doubled.

o EU Report: 81% of European Homes Have Mobile Phones

Brussels -- According to the "Telecoms Services Indicators 2004" report conducted on behalf of the European Commission (EC), approximately 81% of European households said they own at least one mobile phone. The Commission said the news puts the number of mobile phones per household on a par with the number of European homes having at least one fixed-line phone. The report also found that fixed telephony penetration in the EU, which currently stands at about 82%, has actually dropped by 3% since last year. The Commission said the overall proportion of households with access to a telephone at home in 2004 was 97%, while 66% of households own both fixed and mobile phones. Only 3% of EU households have no telephone at all.

(Century City, Calif.) Twentieth Century Fox announced on Monday that it has joined the Blu-ray Association, a group supporting Sony's next-generation blue laser DVD format that also includes Dell, Hitachi, HP, LG, Matsushita, Mitsubishi, Philips, Pioneer, Samsung, Sharp, TDK and Thomson. While the studio has not yet committed to publishing its films on the format, it will work with the other firms on the development of the high-capacity DVD format. Fox has also endorsed the rival HD-DVD format that is being developed by Toshiba and others.

(Dublin) Microsoft announced on Monday that it plans to launch a version of its Internet portal MSN in Irish. "We could have entered the market a year ago, but we wanted to wait until the time was right," said MSN Europe's Geoff Sutton. The version will come complete with Irish content and new advertisers, and Esat BT, RTE, IFG, VHI, Golden Pages and Eirbourne Text Promotions will provide content and other services for the new site, Microsoft said. Microsoft currently has 20 localized MSN portals in Europe and about 40 in total worldwide.

(Chicago) Midway Games announced on Monday that it has shipped its "Mortal Kombat: Deception" title for PlayStation 2 and Xbox to retailers. The title features online play for both platforms. Chicago-based Midway said its 2002 release "Mortal Kombat: Deadly Alliance" will likely reach 3 million units sold by the end of the year.

(Santa Monica, Calif.) Video game publisher Activision on Monday shipped its "Tony Hawk's Underground 2" title for PlayStation 2, Xbox, GameCube, Game Boy Advance and the PC. The sequel features MTV's Bam Margera in addition to skating legend Tony Hawk. The console versions were developed by Neversoft Entertainment, while the Game Boy Advance version was created by Vicarious Visions and the PC version by Beenox Studio.

Game developer THQ on Monday announced the release of its "LEGO Knights' Kingdom" title for Nintendo Game Boy Advance, a collaboration with the Danish children's building blocks company. (New York) Playboy Enterprises announced on Monday that it has partnered with French lifestyles magazine publisher 1633SA to distribute wallpaper, MMS content and wireless games to mobile subscribers in Spain and Portugal. The company also distributed its wireless content in Germany, the U.K., France, Italy, Hong Kong, Australia and Brazil, and plans to begin U.S. distribution by the end of the year.
