Blocks Injunction Against EchoStar in TiVo Patent Case
Englewood, Colo. - EchoStar Communications, operator of
the DISH Network satellite TV service, announced that an appeals
court has blocked an injunction against the company's digital video
recorders that was part of a ruling won in a patent infringement
lawsuit brought by TiVo. The U.S. Court of Appeals for the Federal
Circuit on Tuesday stayed the injunction ordered by a federal court
in Texas, which would have prevented EchoStar from making or selling
its digital video recorders, and compelled the company to disable
set-tops already in customers' homes. "We are pleased the Federal
Court found that EchoStar has a 'substantial case on the merits' and
blocked the Texas decision for the duration of the appeal," EchoStar
said in a statement. The ruling against EchoStar also ordered the
company to pay TiVo $89.6 million in damages. "We are confident that
the jury's decision in TiVo's favor will be upheld once the Federal
Circuit has the opportunity to review the entire record in this
case," TiVo said in a statement.

Hits 7.1 Million Subscribers; Rival Sirius Counts 5.1 Million
Washington - XM Satellite Radio and Sirius Satellite
Radio, the nation's rival subscription digital radio services, on
Wednesday both announced updates on subscriber growth, with XM now
counting a total of 7.1 million subscribers, compared with 5.1
million for Sirius. XM said it added more than 285,000 new
subscribers in the third quarter of 2006, while Sirius added 441,000
during the period, making for four consecutive quarters in which
Sirius led growth and closed the gap between itself and XM. New
York-based Sirius reiterated that it expects to count a total of 6.3
million subscribers by the end of 2006; XM said it still projects it
will have between 7.7 million and 8.2 million subscribers by year's
end.

Jobs Apologizes for Apple's Past Stock Option Practices
Cupertino, Calif. - Apple CEO Steve Jobs on Wednesday
apologized for the company's past practice of backdating stock
option grants. The company said that a special committee of outside
directors has found that stock option grants made on 15 dates
between 1997 and 2002 appear to have had grant dates that preceded
the approval of those grants. The committee said that Jobs was aware
of the favorable grant dates in a few instances, but did not benefit
and was unaware of the accounting implications. The investigation
also raised serious concerns regarding the actions of two former
officers, but found no misconduct among any member of Apple's
current management team. "I apologize to Apple's shareholders and
employees for these problems, which happened on my watch," said
Jobs. "We will now work to resolve the remaining issues as quickly
as possible and to put the proper remedial measures in place to
ensure that this never happens again." The company also announced
that Fred Anderson, Apple's former CFO, has resigned from its board
of directors. Anderson, who served as CFO from 1996-2004, informed
the company that he believes it is in Apple's best interests that he
resign from the board at this time.

Gets U.S. Regulatory Clearance to Acquire Msystems
Milpitas, Calif. - SanDisk, a maker of flash memory data
storage cards used in MP3 players, mobile phones and other devices,
said on Wednesday that it has received U.S. regulatory clearance to
complete its $1.3 billion acquisition of Israel's msystems. The
company said that the waiting period under the Hart-Scott-Rodino
Antitrust Improvements Act of 1976 has expired, and the Securities
and Exchange Commission (SEC) has issued a no action letter. The
deal still must be approved by msystems' shareholders and Israeli
courts before closing. The deal, first announced in last July, would
unite a pair of flash memory pioneers with complementary products,
customers and channels. Msystems specializes in flash memory systems
for the mobile, portable and embedded markets.

Los Angeles - Canadian music television network MuchMusic

event in Los Angeles that it has launched a digital music store. The
company tapped Toronto-based Puretracks to power the service, which
offers a selection of over one million songs in Microsoft's Windows
Media Audio format that can be purchased a la carte and downloaded
to PCs and portable MP3 players. The store also features ringtones,
and celebrity playlists from MuchMusic VJs Sarah Taylor and Tim
Deegan.

Music Player Developer Songbird Raises $1 Million
San Francisco - Songbird, a developer of digital music
player software that can access songs both off a PC and the
Internet, announced that it has raised $1 million in new financing
from Atlas Ventures and Sequoia Capital, Venture Beat reported. San
Francisco-based Songbird's media player searches websites visited
for available music files, and allows them to be played within the
player at any time. It also features a range of music search
engines, and allows users to subscribe to MP3 blogs -- with song
updates added to the player automatically. The company will use the
funds as bridge financing until it can complete its first venture
round, a source told Venture Beat.

Sharing Start-up Zannel Raises $6 Million in First Round
Menlo Park, Calif. - Zannel, a technology start-up that
has been in stealth mode, said on Wednesday that it has raised $6
million in its first round of financing, co-led by U.S. Venture
Partners and Palomar Ventures. Menlo Park, Calif.-based Zannel is
developing technology for consuming and sharing content across
wireless devices, which it plans to launch in the "near future."

round of venture capital, led by Valhalla Partners. Other investors

Redpoint Ventures. Founded in 2004, Cambridge, Mass.-based JumpTap
provides wireless carriers with a mobile search platform that drives
"third-party revenues." Its business model involves a search engine

free companion application for Apple's iTunes that makes
