o Best Buy Launches Digital Music Service Powered by RealNetworks

Minneapolis - Electronics and media retailer Best Buy announced on Thursday plans to launch a digital music store powered by RealNetworks' Rhapsody service. The Best Buy Digital Music Store, which launches Oct. 15, will feature tight integration with memory card maker SanDisk's line of Sansa Rhapsody MP3 players. Consumers who purchase the $139 (2GB) or $249 (8GB) Sansa e200 Rhapsody player will be given a free two-month subscription to the service, enabling unlimited downloads to the players; after the trial period the portable downloads service will cost $14.99 per month. Users can also purchase tracks from Rhapsody a la carte for 99 cents each. "Whether they want to purchase downloads or a subscription and have access to all the music, we're giving consumers the ability to enjoy entertainment on their terms," said Jennifer Schaidler, vice president of music for Best Buy. The launch coincided with the release of RealNetworks' Rhapsody 4.0, an enhanced version of the digital music service that allows users to drag-and-drop songs from the service directly onto their portable players.

o U.S. Trade Rep: Russian MP3 Store Barrier to WTO Accession

Washington - The U.S. Trade Representative has called on Russia to shutter music download store AllofMP3.com, pointing to it as an impediment to the country's accession to the World Trade Organization (WTO), Reuters reported. Susan Schwab previously identified the site -- which sells songs for pennies -- as the "poster child" for online music piracy. "I have a hard time imagining Russia becoming a member of the WTO and having a Web site like that up and running that is so clearly a violation of everyone's intellectual property rights," U.S. Trade Representative Schwab told Reuters. The recording industry has been trying for some time to pressure Russian authorities to shut down AllofMP3.com, but despite an investigation that found the site is breaking Russian laws, prosecutors in Moscow have not taken action thus far against the company. The topic will likely be resurrected next week at another meeting between U.S. and Russian officials on WTO accession.

o $2.37 Billion Bid by Cable TV Firms, Sprint Nextel Wins Wireless Spectrum

Philadelphia - A joint venture called SpectrumCo that includes cable TV firms Comcast, Time Warner and Cox, and wireless carrier Sprint Nextel, announced on Thursday that its bid of $2.37 billion has won 137 wireless spectrum licenses in an FCC auction. The deal will eventually enable the cable TV firms to expand their bundled services -- which currently offer voice, Internet and TV offerings -- to include wireless phone service. The auction included spectrum that covers a national footprint and major U.S. cities including New York, Los Angeles and Chicago. SpectrumCo, which bested bids from satellite firms DirecTV and EchoStar, said it has no finalized plans to build out the networks at this time. Of the $2.37 billion bid, Comcast contributed $1.29 billion, while Time Warner Cable paid $632.2 million and Cox provided $248.3 million.

o "Star Wars" Director's Lucasfilm to Curtail Film Production, Focus on TV

Los Angeles - "Star Wars" director George Lucas said on Thursday that his Lucasfilm production company will shift its focus away from movies and into developing programming for TV and other platforms, Daily Variety reported. "We don't want to make movies. We're about to get into television. As far as Lucasfilm is concerned, we've moved away from the feature film thing because it's too expensive and it's too risky," Lucas told Variety, at the groundbreaking for USC's School of Cinematic Arts, to which Lucas contributed $175 million. He added that he believes Americans are gradually abandoning the habit of going to the movies. "I don't think anything's going to be a habit anymore. I think people are going to be drawn to a certain medium in their leisure time and they're going to do it because there is a desire to do it at that particular moment in time. Everything is going to be a matter of choice. I think that's going to be a huge revolution in the industry," Lucas told Variety. Despite the announcement, Lucasfilm is still at work on films including "Indiana Jones 4" and "Red Tails."

o Sony, Bertelsmann Appeal European Ruling Annulling Sony BMG Merger

Brussels - Japan's Sony and Germany's Bertelsmann have appealed an European court ruling that annulled the merger deal that combined its record label operations to form Sony BMG, Reuters reported. As a result, the European Commission must reexamine any antitrust concerns they found were raised by the deal, which created the world's second-largest record label. The Luxembourg-based European Court of Justice will hear the appeal, which Reuters said will likely take over a year to complete.

o Game Industry Lauds $9 Million Verdict Against "Mod Chip" Traffickers

Washington - The Entertainment Software Association (ESA), a video game industry trade group, on Thursday applauded a recent federal court decision in California that ordered makers of "mod chips" that allow game consoles to play pirated games to pay $9 million in damages. The Sept. 11 verdict from U.S. District Court Judge Claudia Wilken said that a company called Divineo and several individuals violated the Digital Millennium Copyright Act (DMCA) by trafficking in mod chips and HDLoaders, which allow copies of games to be downloaded directly onto a game console's hard drive. "This Court order is very important because it recognizes the significant damage that mod chips and HDLoaders cause the entertainment software industry and delivers the clear message that trafficking in circumvention devices that enable game piracy will result in heavy penalties," said Ric Hirsch, senior vice president of intellectual property enforcement for the ESA.

o Report: 56% of 117 Million U.S. Active Gamers Play Online; 64% are Women

Los Angeles - A new report estimates that there are 117 million active games (defined as those who play upwards of five hours per week) in the U.S., more than half of whom (56%) play online games. Of all online gamers, the report from Nielsen Entertainment found that 64% are women. While teenagers still comprise the largest share of online gamers (40%), Nielsen found that 8%, or nearly 15 million active gamers, are 45 or older. "The expansion of next generation hardware and technology in the marketplace is simultaneously delivering new ecosystems of social exchange, interactive entertainment, media experiences and advertising models," said Emily Della Maggiora, senior vice president of Nielsen Interactive Entertainment. "We see everyday how important online gaming is in terms of connecting people and bringing communities of gamers together." The report also found that 64% of active gamers play on PC-based systems, while 59% owned a PlayStation 2, 33% have an Xbox, 30% own a GameCube and 15% have purchased an Xbox 360. During the past six months, active games have purchased, on average, four new games, with 90% purchased at retail and 10% downloaded online.

o PC Lightning Damage Forces Sweden to Drop File-Sharing Charges

London - Lightning damage to the PC of a Swedish politician who admitted to being an avid file-swapper and encouraged others to do the same has forced Swedish authorities to drop copyright infringement charges against him, TheRegister reported. Ivan Wenster revealed his support for file-sharing in the wake of a raid on The Pirate Bay, a popular site for downloading free media files, by Swedish authorities. After legislation outlawing illicit downloading was passed in Sweden in July 2005, Wenster turned himself into authorities, and would have faced up to two years in jail. But the freak lightning incident that burned his PC intervened. "They laughed when I told them," Wenster told Swedish site The Local. "It was my children's and wife's PC, too."

o User-Generated Local Reviews Site Yelp Raises $10 Million

San Francisco - Yelp, a site that publishes reviews of local businesses, announced on Thursday that it has raised $10 million in new financing from Benchmark Capital. San Francisco-based Yelp said it receives thousands of new user-generated reviews of restaurants and other local businesses each day, and has large online communities in Boston, Chicago, New York, Los Angeles and Seattle. The site attracted 1.5 million unique visitors in September. The company said it will use the funds to expand its offering in major metropolitan areas across the country.

o Photo-Sharing Social Network Fotolog Raises $4 Million

New York - Fotolog, a social networking site based around sharing photos, said that it has raised $4 million in its third round of venture capital financing, from BV Capital and 3i. Founded in 2002, New York-based Fotolog now claims 4.7 million members and 9.7 million unique monthly visitors. The company has raised $12 million since March 2005. Fotolog will use the funds to accelerate growth, for product development and to expand into new markets.

New York - The Harry Fox Agency (HFA), a U.S. music rights licensing organization, announced that it has signed a lyrics licensing agreement with LyricFind, a website that publishes song lyrics. Financial terms of the deal were not disclosed. Under the terms, music publishers can participate on an opt-in basis and will be able to add, review and edit lyrics on LyricFind's database. HFA said the service will be offered to publishers on a commission-free basis, waiving its usual 6.75% cut of royalties.

New York - Viacom's Nickelodeon children's programming network on Thursday introduced TurboNick 2.0, an enhanced version of its broadband video platform that includes new features like continuous video streaming, customized playlists, support for new languages and search across Nickelodeon's content library. Nickelodeon said the initial TurboNick site served nearly 19 million streams between Sept. 20 and Oct. 1, adding that the site is currently averaging 236,000 daily unique visitors.
