o RIAA, MPAA Appeal P2P File-Sharing Ruling to U.S. Supreme Court

Washington -- Trade groups for the recording and motion picture industries on Friday petitioned the U.S. Supreme Court to overturn a landmark Ninth Circuit Court of Appeals ruling, delivered in August, which said distributors of peer-to-peer file-sharing software like Kazaa and eDonkey aren't liable for copyright infringement. Studios represented by the Motion Picture Association of America (MPAA) and record label members of the Recording Industry Association of America (RIAA) on Friday filed their appeal of the Ninth Circuit's ruling, which was based in part on the Supreme Court's 1984 Betamax decision that legalized the VCR because of its "substantial non-infringing uses." Even before the Ninth Circuit's ruling, the RIAA had begun suing individual file-swappers for copyright infringement -- now the main avenue for quelling piracy since the software publishers aren't legally culpable. The entertainment industry has also intensely lobbied Congress for new legislation that would allow peer-to-peer software providers to be targeted, such as the "Induce Act," which was scheduled for a vote in the Senate Judiciary Committee this week but postponed amid criticism from technology firms and consumer advocates.

o Sirius Radio to Raise $290 Million in Stock and Notes Offering

New York -- Days after announcing the signing of radio giant Howard Stern to its satellite-delivered digital radio service, Sirius Satellite Radio announced on Friday an offering of stock and bonds that aims to raise $290 million in new funds. The company said it intends to offer 25 million shares at a price of $3.87 per share, as well as $200 million of convertible notes. New York-based Sirius said the proceeds will be used for general corporate purposes, including investments in programming, infrastructure, and retail and automotive distribution arrangements. On Wednesday, Sirius signed "shock jock" Howard Stern to a five-year, $500 million contract that will take his show off the traditional airwaves and move it onto Sirius' $12.95 per month service beginning in January 2006.

o Nintendo Details Wireless Features of New DS Handheld

Tokyo -- Nintendo president Satoru Iwata on Thursday provided new details on the wireless capabilities of its upcoming dual-screened DS handheld video game device. Scheduled for release in the U.S. on Nov. 21, the device will enable wireless multiplayer gaming, now a common feature for handhelds. But the DS wireless connection will also allow the device to receive a program over a wireless connection and execute it. "We're thinking of a system where people can download a demo program (from within a retail location, for instance) with a time or a usage limit, to their own DS," said Iwata. "We hope that this system will allow new potential hits to be recognized by everyone, and that it will help to buck the trend where only sequels are hitting the sales charts." Nintendo is also envisioning possible tie-ins with movie spin-offs of its games. "By using the system's wireless functionality, users that bring their DS and GBA Pokemon cartridge to designated theaters will be able to download game data that will be distributed during certain scenes of the next Pokemon movie. In one scene where the main characters meet a new Pokemon, that character's data will be sent to their cartridges," said Iwata.

o IPTV Software Firm Orca Interactive Raises $25 Million

London -- Orca Interactive Ltd., an Israel-based developer of middleware software for Internet TV, announced on Friday that it has raised $25 million from an initial public offering (IPO) on the London Stock Exchange's alternative investment market (AIM). Orca said the funds raised would be used mainly for sales and marketing. "This flotation will give (Orca) the visibility, and incentivize its management and employees to maximize the strong growth for IPTV expected over the next five years," said Emblaze Chief Executive Officer Eli Reifman. Orca Interactive is a unit of Emblaze Ltd., formerly known as Geo Interactive, a group of communication technologies companies.

(Berlin) German record label K7 Records has announced that all of its future releases will not feature any type of CD copy-protection, and in fact will carry a logo that reads, "NO copy protection -- respect the music." The move follows Sony's recent decision to remove copy-protection from its Japanese releases, in part due to consumer backlash because the discs won't play on all devices that play CDs. "This makes it clear that you've bought a CD and you can use it however you want," K7 wrote in a note on its website. "The old song about mutual give and take has been given a new verse: Copy protection kills customer relationships."

(San Francisco) In a follow-up to the popular Woody Guthrie-inspired Web campaign parody, "This Land Is Your Land," San Francisco-based AtomFilms said that it has partnered with Los Angeles-based JibJab to release the sequel, entitled "Good to Be in DC!" Xfire, provider of an online game platform and social networking tool for gamers, said on Friday that it has added support for cross-game chat and peer-to-peer file-sharing to its service. Gamers will be able to message their friends who are playing any of the 200 online PC games supported by Xfire, as well as download patches, mods, demos, trailers and other files over a closed peer-to-peer distribution system. (Pawtucket, RI) Toymaker Hasbro's Playskool division on Friday introduced the Videonow Jr., a personal video player designed for preschoolers that will offer early learning programming. The $85 device, scheduled for release in the fall, measures five by six inches and features a backlit, full-color LCD screen. Video game developer Funcom announced on Friday that it is offering a free full version of its massively multiplayer online game "Anarchy Online," while at the same time extending the free tryout period from 7 to 14 days. (Cambridge, Mass.) MIT Technology Review recently reported on a range of current applications for peer-to-peer networks aside from their obvious ability to distribute copyrighted music, movies and other media. The article calls Internet telephony the most important P2P application to emerge in 2004, with VoIP service Skype already having served 1.7 billion minutes of P2P phone calls since August 2003. Another is LionShare, a service launched by Penn State University to share scholarly information among academics. There are also Vipul's Razor, a P2P application used as part of a system to filter spam, and BitTorrent, a service that can be used by small software publishers to cost-efficiently distribute their products.

(San Francisco) Wired News on Friday reported on a nascent TiVo-like Internet audio distribution method called "podcasting," which allows MP3 player owners to subscribe to audio feeds of news and radio shows and have them automatically recorded and downloaded onto their portable players. "It's aggregating audio content, but it's taking one extra step, in that it's putting it on your device," Adam Curry, who built the first podcasting aggregator, known as iPodder, told Wired News. "Not only do these devices play it, but you don't have to put it there yourself. It just happens automatically." Podcasting feeds and aggregators may be found at Podcasters.org, Podcast.net, iPodderX and Curry's iPodder.org.
