o Supreme Court Hearing Arguments In Copyright Term Extension Case

Washington -- The Supreme Court on Wednesday is hearing arguments in
Eldred v. Ashcroft, a lawsuit that aims to eliminate a 20-year extension
on the term length of copyrights before they go into the "public domain,"
where they may be used freely and without seeking any permissions.
Plaintiff Eric Eldred runs a website that publishes books and other
materials online that have gone into the public domain, and is suing for
the right to add works such as Robert Frost's poetry -- which would have
recently gone into the public domain -- to his offering. However, with
Hollywood's backing, Congress passed the Sony Bono Copyright Extension
Act, giving the poems and other valuable copyrights such as Disney's
Mickey Mouse twenty more years to make money for their owners.

o Bob Dylan, Billy Joel, James Taylor Sue Vivendi's MP3.com

New York -- Recording artists Bob Dylan, Billy Joel and James Taylor have
sued Vivendi Universal's MP3.com for copyright infringement, claiming the
company was not authorized to make digital copies of their CDs and
distribute them online, Dow Jones Newswires reported. The suit seeks the
maximum $150,000 in damages per infringement. San Diego-based MP3.com
settled a similar suit filed in January 2000 by most of the major record
labels and music publishers, paying a settlement of about $133 million.
Both suits target a service called My.MP3.com -- which the company no
longer offers -- that let CD owners listen to streaming versions of the
songs on their CDs over the Internet. A group of musicians including Tom
Waits, Randy Newman and members of the band Heart filed also filed suit
against MP3.com in May 2001.

o Technology Business Publication Upside Magazine Shuts Down

Arlington, Va. -- Upside magazine, a well-known publication covering
technology and finance news, has been shut down. The magazine's 25
employees have all lost their jobs. Reuters reported that Upside, which is
based in San Francisco, will not publish an October issue. Last September,
MCG Capital acquired UMAC Inc., the publisher of Upside, in what Andrew
Jacobson, a managing director with MCG, called "a friendly foreclosure."
Continued slowness in advertising sales forced the magazine to shut down.

o Verizon to Distribute Listen.com Subscription Service to DSL Subscribers

New York -- Verizon Communications announced on Wednesday that it will
distribute San Francisco-based Listen.com's Rhapsody digital music
subscription service to its 1.5 million DSL high-speed Internet
subscribers. The service gives subscribers access to on-demand streaming
of 230,000 tracks from both major and independent label artists for under
$10 per month, including a free month for Verizon subscribers who sign up
by Oct. 31. Listen.com has also secured distribution for the Rhapsody
service with cable TV operators Charter Communications, DirecTV DSL, Time
Warner Cable's Road Runner, Lycos Music and a number of others.

o Music Education Software Firm MakeMusic Raises $730,000 

Minneapolis -- MakeMusic, a provider of music notation software and other
music education technology, announced on Wednesday that it has raised
$730,000 in bridge financing. Investors included MakeMusic chairman and
CEO Sean Lafleur, Gideon Hixon Ventures, and the managing general partner
of J.M. Hixon Partners. Minneapolis-based MakeMusic offers schools a
subscription service where a number of students can have access to its
music education software at a group rate.

o Game Developer Interplay Delisted From Nasdaq

Irvine, Calif. -- Interplay Entertainment, a developer and publisher of
video games, announced on Wednesday that the Nasdaq has delisted its
shares from trading on the Nasdaq SmallCap Market. The company said it is
considering whether to seek an appeal of the decision, and expects its
shares to begin trading shortly on the Nasdaq-operated Over-the-Counter
Bulletin Board.

(Europe) A group of developers calling themselves the Xbox Linux Project
has announced the completion of a version of the Linux operating system
that will run on Microsoft's Xbox video game console. The release is
available for free on the developers' community site, and enables
tech-savvy Xbox owners to use the PC-based game console for "office
applications, the Internet, email, Linux games, or even as a web, file or
database server."

(New York) Muze, a provider of informational databases on entertainment as
well as streaming music samples, said on Wednesday that it has signed an
agreement with independent record label V2 Records to stream samples of
songs from V2 artists on its service. V2's roster includes White Stripes,
Moby, Grandaddy, The Black Crowes and Mercury Rev. New York-based Muze's
streaming samples and databases are available through several retailers'

offered $2.4 million to purchase Napster's trademark and domain name to
launch a peer-to-peer service for exchanging pornography, announced on
Wednesday that it plans to launch an online DVD rental service for adult
films. The company said it plans to launch the service -- which will offer

(Chicago) Midway Games announced on Wednesday that its upcoming 3-D
version of the popular 1980's arcade game "Defender" will feature
game-exclusive tracks from Metropolis Records' KMFDM, as well as Black
Black Records' artist Trigger. Chicago-based Midway said that "Defender"
is currently in development at Santa Monica-based 7 Studios. The game will
be released for Sony PlayStation 2 on Oct. 21, with releases for
Microsoft's Xbox and Nintendo's GameCube and Game Boy Advance scheduled in
November.
