o Supreme Court Hears Arguments In Copyright Term Extension Case

Washington -- The U.S. Supreme Court heard arguments Wednesday in Eldred
v. Ashcroft, an appeal aiming to reverse a 20-year extension on
copyrights. If successful, the result would be that copyrights on many
works such as Robert Frost's poetry and films like "Casablanca" would
expire and the works would go into the "public domain," where anyone may
use parts of them without paying or seeking permission from the work's
original owner. Arguing on behalf of plaintiff Eric Eldred was Stanford
professor Lawrence Lessig, and appearing on behalf of the government was
Justice Dept. solicitor general Ted Olson. Justices questioned Lessig on
whether the Court can trump Congress in reversing the 1998 law, and
whether all of the earlier 11 extensions to a copyright's length may be
called into question if the Court declares the current extension
unconstitutional. Some justices argued that the Constitution's stipulation
that copyright terms be "limited" is not affected by the extension, while
others, including Justices Breyer and Scalia, questioned whether continued
extensions are any different than an unlimited copyright. More detailed

o FCC Approves IBiquity Digital Radio Broadcasting Technology

Columbia, Md. -- IBiquity Digital, a developer of digital radio
broadcasting technology, announced on Thursday that the Federal
Communications Commission (FCC) has approved its technology for use by
radio stations to offer a digital signal alongside their existing analog
broadcast signals. Stations may now use Maryland-based IBiquity's In-Band,
On-Channel (IBOC) technology to simultaneously broadcast a digital signal
-- which may also include data like artist/song titles, weather and
traffic information -- alongside their analog signal on both the AM and FM
bands. IBiquity's transmitters will cost radio stations about $75,000; the
company said consumer electronics manufacturers will debut a number of
digital radio receivers compatible with its technology at the Consumer
Electronics Show in January. Major radio station owner Radio One plans to
begin broadcasting digitally within three months on stations in Atlanta,
Boston, Dallas, Detroit and Los Angeles.

o FCC Rejects EchoStar - DirecTV Merger

Washington -- The Federal Communications Commission (FCC) on Thursday
announced that it has declined to approve the proposed merger of satellite
TV giants EchoStar and DirecTV. In its ruling, the FCC said that a merger
of the two companies would harm consumers by "eliminating an existing
viable competitor in every market; creating the potential for higher
prices and lower service quality; and negatively impacting future
innovation." The FCC gave the companies 30 days to re-file an application
that addresses its specific antitrust concerns, and ordered the
application to be designated for hearing before an Administrative Law
Judge. "The record before us irrefutably demonstrates that the proposed
merger would eliminate an existing viable competitor in every market in
the country," said FCC chairman Michael K. Powell. "At best, this merger
would create a duopoly in areas served by cable [television]; at worst it
would create a merger to monopoly in unserved areas."

o Cinea Wins $2 Million Grant to Develop Movie Anti-Piracy Technology

 Herndon, Va. -- Cinea, a maker of security hardware products, said on
Thursday that it has won a $2 million grant from the National Institute of
Standards and Technologies to accelerate the development of its technology
designed to prevent piracy of motion pictures through illegal camcorder
recordings. The award is part of the Institute's Advanced Technology
Program, which makes early-stage investments in technologies that promise
"significant commercial payoffs and widespread benefits for the nation."
Virginia-based Cinea plans to embark on a two-year project to develop and
test technology that "will modify the timing and modulation of the light
used to create the displayed image [on a movie theater screen] such that
frame-based capture by recording devices is distorted." The Motion Picture
Association of America estimates that the film industry loses $3.5 billion
annually due to piracy.

o Microsoft Removes Copy-Protection Scheme from Windows XP Media Center  

Redmond, Wash. -- Microsoft has dumped plans to regulate the recording of
TV programs in its upcoming Windows XP Media Center Edition, a version of
the operating system designed to integrate a PC with other home
entertainment devices. The security technology was originally set to
tether TV shows to the PC on which they were recorded, but will now allow
them to be transferred between devices, and even over the Internet.
Manufacturer HP and Microsoft are working to remove the restrictions from
the HP Media Center PC, which will go on sale at 1,400 North American
retailers later this month. "We take feedback from partners, customers,
press and analysts very seriously," Microsoft product marketing director
Murari Narayan told the Associated Press. "We heard loud and clear that we
have to enable consumer choice. Now, consumers will be able to burn
recorded programs onto DVDs to watch on other computers and, by the end of
the year, on standalone players."

o Report: Linux-Based Set-top Boxes On the Rise

Boston -- The percentage of digital TV set-top boxes running the Linux
open source operating system is expected to rise from 5 percent in 2003 to
12 percent in 2006, according to a report released Thursday by
Boston-based research firm Trace Strategies. The firm also predicts that
unit shipments of Linux-based interactive TV client devices -- which also
include home gateway media centers and digital video recorders -- is
expected to experience average year-over-year growth of 70 percent through
2006. The biggest producers of Linux-based set-tops currently include TiVo
and Motorola. Most manufacturers are using versions of Linux developed
in-house, but Trace reports that Red Hat commands the largest share of
commercial Linux-based deployments.

(Redmond, Wash.) Microsoft on Thursday announced that Korea Telecom will
use its Windows Media 9 Series to deliver a library of 2,000 Korean movies
and TV shows over a new broadband video-on-demand service, called
HomeMedia. The service will be offered to Korea Telecom's 4.4 million
broadband subscribers, and will deliver content over a wired or wireless
connection from a PC to the television using Microsoft technology. Movies
will cost between $1 and $3 for pay-per-view, with subscription packages
available for between $5 and $10.

(New York) Epic Records, a division of Sony Music Entertainment, said on
Thursday that its seven genre-based soundtracks for Rockstar Games' "Grand
Theft Auto: Vice City" for Sony PlayStation 2 will be released on Oct. 29,
the same day the game becomes available. The label said that all the CDs
will come embedded with Sony Music's proprietary ConnecteD technology, a
unique key that when placed in the user's CD-ROM drive will grant access
to "cheat codes" for the game as well as screensavers, wallpaper and other
exclusive content.

(New York) World Theatre, a technology and entertainment company with
patents on digital cinema and electronic billboard technologies, announced
on Thursday it is developing an interactive television music video
channel. New York-based World Theatre said is has signed agreements with
the majority of major music companies -- including BMG Entertainment --
for the right to broadcast music videos and offer their albums for sale
over a branded TV network. The system will store music on a set-top box,
and enable transfer to a networked home audio system or portable playback
device.

(San Jose, Calif.) EBay, operator of the popular online auction site, said
that its expansion into the television arena has been put on hold. Reuters
reported that a syndicated series based on the company's concept had been
scheduled to air this fall, but now will be pushed back to an undetermined
date in 2003. San Jose, Calif.-based EBay said that the show is still in
the "development stages." The series, announced last August, will explore
some of the stories behind the site's auctions.

(Washington) Nine of the largest art publishers in the country,
representing some of the most well-known artists, have formed a non-profit
group called the Art Copyright Coalition (ACC) to combat piracy in the
visual arts. The group has established a process for dealing with alleged
infringements, such as unlicensed reproductions and unlicensed goods
bearing artists' images, as well as online virtual art galleries that copy
images from stock photo catalogs. "I don't think anyone's ever quantified
the problem, but everyone is getting ripped off all the time," said ACC
general counsel Joshua J. Kaufman.

(London) Shazam Entertainment, provider a mobile phone service that can
identify songs in real-time played through a speaker into a cell phone,
announced that it has licensed 30-second samples and cover art from Warner
Music Group for inclusion on its service. The company recently signed a
similar deal with the Association for Independent Music, a group of U.K.
indie labels. London-based Shazam's service is currently available in the
U.K. to 02, T-Mobile, Vodafone and Orange subscribers with SMS
text-message compatible phones.
