o Florida Judge Orders Take-Two's "Bully" Game Into Court for Review

Miami - A Florida judge has ordered video game publisher Take-Two Interactive to demonstrate its forthcoming "Bully" game in court to determine if it violates Florida's "public nuisance" laws. The game allows players to step into the shoes of a 15-year-old attending a school called Bullworth Academy. Florida law defines a public nuisance as something that "tends to annoy the community; injures the health of the citizens in general; or corrupts the public morals," and is usually applied in areas like prostitution, gambling and environmental pollution. "I'm pretty sure that the game is harmful to minors," attorney Jack Thompson, who filed the suit against Take-Two, and retailers Wal-Mart and GameStop, told The Washington Post. The call to New York-based Take-Two, whose Rockstar Games unit is also responsible for the "Grand Theft Auto" franchise, was issued by Miami-Dade Circuit Court Judge Ronald Friedman as part of Thompson's lawsuit. Judge Friedman's clerk told GamePolitics.com that Friedman and Thompson "are prepared to spend several days watching [the game's content]." "Bully" is slated to be released in stores on Tuesday.

o Sony Developing Walkman That Plays Video

Tokyo - In a bid to level the field with rival Apple's Video iPod, Sony announced on Thursday that it is developing a version of its Walkman portable audio player that also plays video, Reuters reported. Sony senior vice president Hiroshi Yoshioka confirmed the plan for reporters at a news conference, but declined to provide any further details. Yoshioka added that Sony's goal is to double the Walkman's current 10% share of the digital music player market. Apple's iPod with video playback capabilities has now been on the market a year.

o Time Warner to Sell AOL Business in U.K. for $688 Million

Dulles, Va. - Media giant Time Warner has struck a deal to sell its AOL Internet access business in the United Kingdom for $688 million to Carphone Warehouse Group, a mobile phone retailer and provider of residential telecom services in Europe. AOL has about 2.1 million ISP customers in the U.K. Dick Parsons, the chairman and CEO of Time Warner, said that the deal "completes the restructuring of our AOL Europe businesses." AOL has been moving away from its Internet access roots and migrating toward an advertising-supported business model.

o Oklahoma Judge Blocks Implementation of Video Game Law

Washington - A federal judge in Oklahoma on Thursday blocked implementation of a new state law that prohibits the sale of video games to minors that depict "inappropriate" violence. U.S. District Court Judge Robin J. Cauthron issued a preliminary injunction against the Oklahoma law, siding with the video game industry's arguments that the law is unconstitutionally vague, and violates First Amendment free speech rights. "This marks the ninth Court decision in the past five years to enjoin restrictions on video games," said Doug Lowenstein, president of the Entertainment Software Association (ESA), the trade group representing U.S. computer and video game publishers. "We're grateful for the preliminary injunction and look forward to prevailing in the effort to permanently strike down the law."

o Video Game Industry Veteran Launches Consumer Advocacy Group

Wilton, Conn. - The Entertainment Consumers Association (ECA), a new Web-based consumer advocacy group that will lobby local and federal lawmakers on behalf of video gamers, announced its launch on Thursday. The non-profit group was created by Hal Halpin, founder of the Interactive Entertainment Merchants Association (IEMA) -- a trade group representing the video and computer game industries that recently merged with the Video Software Dealers Association (VSDA). "These individuals are the life-blood to this multibillion dollar industry yet they have been unrepresented, until now, which is exciting for myself and the rest of the ECA team as we are the organization that now allows their voices to be heard," said Halpin. The ECA will represent gamers in areas like consumer rights, anti-games legislation and a host of other public policy concerns. For a $19.99 annual membership, the ECA will also offer discounts on games and access to industry events, and in the future potentially career assistance, scholarships and low-cost health insurance.

o Report: 8 Million Americans Now Capturing Video on Mobile Phones

San Francisco - Nearly 8 million U.S. mobile subscribers -- or 3% of the market -- are now using their phones to capture video, a figure that jumps to 6% among subscribers who recently purchased a new handset, according to a report from market research firm Telephia. "Google upped the ante this week by paying $1.65 billion for YouTube, validating the success and future potential of user-generated video content. The mobile phone is a unique and rich source of on-the-move, spontaneous, personal videos -- the kind that made YouTube a worldwide phenomenon to begin with," said Telephia's Kanishka Agarwal. Among recently purchased handsets, Americans favored the Motorola RAZR by nearly four to one over the next top device (the Nokia 6101) for capturing video. However, the U.S. with its 3% cell phone video adoption rate still lags behind European countries including Spain (15%), Italy (14%), the U.K. (12%) and Sweden (10%).

o Loudeye Shareholders Approve Nokia Acquisition; Class Actions Filed

Seattle - Shareholders have approved digital music service provider Loudeye's $60 million buyout by cell phone maker Nokia, the company said in a regulatory filing. The deal expected to close next week. Meanwhile, several law firms have announced the filing of shareholder class actions against Seattle-based Loudeye, alleging the company artificially inflated its stock price between May 2003 and November 2005. One lawsuit, from New Orleans-based law firm KGS, said the company during this time was "operating well below guidance… not successfully integrating its acquisitions," and that its "restructuring was failing." The company's share price fell from a high of $30 per share in late 2004 to less than $2 per share by the time Loudeye announced Nokia's intention to acquire the company.

o Teens Migrate from Buddy Icon Sites to Those Helping Them Build Profiles

New York - Over a three-year period, the top sites among teens 12-17 have shifted from those offering a selection of instant messaging buddy icons to those providing assistance with social networking profiles and page layouts, according to a new report from Nielsen/NetRatings. In September, sites offering tools to improve social networking profiles with song lyrics, pictures, quotes and layout designs -- led by PLyrics.com -- ranked among the most popular with the age group. In fact, nine out of the top 10 teen sites either offered content or tools for social networking site profiles, or were social networking sites themselves. That compares with three years ago, when the top teen sites included Originalicons.com, Buddy4u.com and Badass Buddy. Ken Cassar, chief analyst at Nielsen/NetRatings, said that while it's no surprise that teens are actively engaged in social networking sites like MySpace and YouTube, "What is surprising, however, is the extent to which a wide array of supporting web sites has developed in conjunction with these bigger, more well-known web destinations."

o Internap to Acquire Streaming Services Firm VitalStream for $217 Million

Atlanta - Internap Network Services, an Atlanta-based provider of performance network services over the Internet, has agreed to pay $217 million in stock to acquire VitalStream, a California-based provider of audio and video streaming services. Under the agreement, Internap will issue about 11.9 million shares of common stock. Internap said that by combining the two companies' product lines it will be able to meet the needs of customers seeking to both deliver rich media content and monetize that content.

o Ultra Wideband Wireless Video Developer Tzero Gets Venture Capital

Sunnyvale, Calif. - Tzero Technologies, a developer ultra wideband wireless video technology used in displays, set-top boxes, digital video recorders and other products, announced on Thursday that it has received an undisclosed strategic investment from Miven Venture Partners. Tzero said the investment is an extension of its $25.5 million second round of funding announced in June. The Sunnyvale, Calif.-based company develops technology that can wirelessly connect high-definition video and audio devices, such as HDTVs, next-generation DVD players, set-top boxes and video game systems -- in place of a standard HDMI cable. Tzero said it will use the funds to expand business opportunities and bring new products to market.

o Intent MediaWorks Raises $1.2 Million in First Round

Atlanta - Intent MediaWorks Inc., an Atlanta-based digital media distribution company, has raised $1.2 million in its first round of venture capital, Private Equity Week reported on Wednesday, citing a regulatory filing. Investors in the deal include Menemsha Capital Partners and IMW Partners, the report said. Founded in October 2003, Intent MediaWorks offers technology that supports legal, secure file trading, "turning each file into a marketing tool for the copyright owner." The company's technology is designed to work with major Peer-to-Peer (P2P) file-trading networks, web-based communities as well as email and RSS.

o Report: Fiber-to-the-Home Reaches 1 Million Households and Businesses

Washington - Two national telecommunications industry organizations -- the Fiber-to-the-Home Council and the Telecommunications Industry Association -- announced that the number of homes and businesses in the United States directly connected by fiber optic connections now exceeds one million. Fiber optic connections are much faster than standard Internet broadband connections. The organizations said the growth rate in new subscribers has increased by 50% in the last six months. "Surveys of early fiber-to-the-home users show that they are highly satisfied with the service attributes such as increased Internet speed, on-demand video and HDTV, as well as online gaming," said Michael Render of RVA Market Research. "However, there is also increased interest in applications that affect health and education as information becomes available about services and distance learning available through the Internet."

San Jose, Calif. - PayPal, the online payments arm of eBay, said on Thursday that it is now accepting payments in 10 new currencies, allowing customers to send, receive and hold funds in a total of 17 currencies worldwide. New currencies include the Czech Koruna, Danish Krone, Hong Kong Dollar, Hungarian Forint, New Zealand Dollar, Norwegian Krone, Polish Zloty, Singapore Dollar, Swedish Krona and Swiss Franc. San Jose-based PayPal also announced that residents in 48 new markets can now use PayPal in their local markets to send money online.

Overland Park, Kan. - Sprint said on Thursday that it has secured exclusive early distribution of the animated comic series "Pale Force," starring comedians Jim Gaffigan and Conan O'Brien and illustrated by New Yorker cartoonist Paul Noth. The animated series will be available to Sprint subscribers a week before it is made available from NBC, which plans to stream webisodes online.
