o Apple Profit Surges on Strong Sales of iPods, Macs

Cupertino, Calif. -- Buoyed by strong sales of its Macintosh computers and iPod digital music players, Apple on Wednesday reported earnings that far exceeded Wall Street expectations. For the quarter, the company posted a net profit of $106 million, up from a profit of $44 million in the same period a year ago. Revenue was $2.35 billion, an increase of 37%. The company's per share profit of $0.27 topped consensus analyst estimates of $0.18, according to Thomson First Call. Apple shipped 836,000 Macintosh units and just over 2 million iPods during the quarter -- increases of 6% and 500%, respectively, from the same period in 2003. "We are thrilled to report our highest fourth quarter revenue in nine years," said Steve Jobs, Apple's CEO.

o EU Takes Greece to Court over Ban on Computer Games

Brussels -- The European Commission (EC) announced on Thursday that it plans to take Greece to the European Court of Justice to reverse the country's ban on PC games. The EC said that it had decided to refer Greece to the court over its ban on the "installation and operation of electrical, electromechanical and electronic games, including computer games, in all public and private places," including premises providing Internet services, such as cyber cafes. The Commission also said that Greece's decision to outlaw video games to stop online gambling essentially violates the EU treaty on the free movement of goods and services. Furthermore, the EC said that it plans to take Greece to task for not having notified the EU of the law when it was in its draft stage, which is an infringement of Directive 98/34/EC.

o Microsoft's Anticipated Xbox Game "Halo 2" Leaked Onto Internet

London -- Microsoft is investigating how a copy of its highly-anticipated Xbox game "Halo 2" was leaked onto newsgroups and "warez" piracy sites, the BBC Online reported on Thursday. The pirated copy is in the French language and compatible with the PAL European television standard, but is not enabled for online play. "We consider downloading this code or making it available for others to download as theft," and are "aggressively pursuing the source of this illegal act," Microsoft said in a statement. The company doesn't expect the leak to affect sales of the title, which will ship to retailers on Nov. 9. The original "Halo" title, developed by Bungie Studios, has to date sold over 4 million units.

o Google Releases Desktop Search Tool

Mountain View, Calif. -- Search engine giant Google on Thursday introduced a new program that allows anyone to search the contents of their PC for email, documents chat logs and Web pages visited through a Web browser. Google's first-to-market release of desktop search software beats out rivals including Yahoo, AOL and Microsoft, which has said such PC search capabilities will be included in its next Windows operating system, codenamed Longhorn. When downloaded by a user, the free Google Desktop Search application will scan and index the entire hard drive of a PC, enabling users to search their own computers. The software will also provide relevant desktop search results alongside Web results when searching the Internet on Google.

o Dell Aims at $249 iPod Mini With New $199, 5GB MP3 Player

New York -- PC maker Dell on Thursday introduced its redesigned DJ digital music player line, including a 5GB model that is similar in size to Apple's $249 iPod mini but is priced at $199. The company also released a $249, 20GB model. "Our competitors' prices provide us considerable room to pass on huge savings to our customers," said Dell senior vice president John Hamlin. "Our Dell DJ provides more battery life and more storage space at 20 percent less than the price of the No. 1 seller." Both devices support MP3 and Windows Media Audio formats, in addition to Microsoft's "Janus" digital rights management technology.

o Game Publisher Bam Entertainment Delisted from Nasdaq

San Jose, Calif. -- Struggling video game publisher Bam Entertainment announced on Thursday that its shares will be delisted from the Nasdaq SmallCap Market, effective on Friday. The ruling follows the company's failure to file its annual report on time, and provide evidence of shareholders' equity of at least $2.5 million. San Jose, Calif.-based Bam has created titles based on licenses of Cartoon Network properties including "The Powerpuff Girls" and "Dexter's Laboratory," as well as games such as "Ballistic: Ecks vs. Sever," "Reign of Fire" and "State of Emergency." Bam said that, following its delisting from the SmallCap market, it expects its common stock will continue to be quoted on the Pink Sheets service.

(London) Napster UK announced on Thursday that it is selling pre-paid music download cards through U.K. retail partner Dixons. The cards -- priced at 14.85 pounds ($26.70), 25.95 pounds ($46.60) and 56.95 pounds ($102) -- will allow customers without credit or debit cards to download 15, 60 or an unlimited number of songs, respectively. All three cards went on sale in Dixons, PC World and Currys stores on Wednesday and will be sent out to other unnamed retailers "very soon," according to a Napster UK spokesman.

(Garden City, N.Y.) RealNetworks announced on Thursday that New York's Adelphi University will offer the Rhapsody online music service to its students -- and for free to those living on-campus through May 2005. Students will be able to stream unlimited full-length songs from Rhapsody's 790,000-song library and purchase downloads for $0.79 each. At the end of the free trial, all Adelphi students will be offered Rhapsody for $2.00 per month, or 80% off the usual $9.95 per month price. Separately, Seattle-based RealNetworks announced that new home networking products from D-Link and Pinnacle Systems will support Rhapsody, allowing users to listen to tracks on their home stereos.

(San Francisco) Video game publisher Ubisoft announced that it has acquired the rights from Universal Studios Consumer Products to develop titles based on director Peter Jackson's ("The Lord of the Rings") take on the classic story and 1933 film "King Kong." Ubisoft's Montreal studio will work with Wingnut Films to develop titles for release alongside the film on Dec. 14, 2005.
