o Recording Industry Files 8,000 New File-Sharing Lawsuits Worldwide

London - The recording industry announced on Tuesday that it has launched over 8,000 new legal actions against suspected music file-swappers in 17 countries, including the first such lawsuits in Brazil, Mexico and Poland. The International Federation of the Phonographic Industry (IFPI), a global record label trade group, said it has now filed a total of more than 13,000 actions against file-swappers outside the U.S. So far, over 2,300 defendants have agreed to settlements averaging about $3,000 each. The IFPI said that over 1 billion tracks were downloaded illegally last year in Brazil, where record company revenues have nearly halved since 2000. "In each of the 17 countries involved in today's actions there are legal music services available to consumers," said IFPI chairman and CEO John Kennedy. "We reluctantly continue with our legal actions and today sees the latest escalation of that campaign to show that file-sharing copyrighted music does carry real legal risks -- apart from the risks to privacy and the risks from spyware and viruses."

o RIAA Drops Copyright Lawsuit Against Suspected File-Swapper

Los Angeles - The Recording Industry Association of America (RIAA) has dropped copyright infringement charges against a man who argued the record label trade group's method of identifying suspected illegal file-swappers is insufficient. Ars Technica reported that the RIAA's lawsuit against Chicago resident Paul Wilke (Elektra v. Wilke) appears to be another case of mistaken identity among the industry's thousands of lawsuits against file-swappers. Wilke argued that RIAA's evidence, consisting of a name, IP address and list of shared files, was not sufficient to tie him to the illegal downloads. Wilke's attorneys said he was not the "Paule Wilke" named in the complaint, had never downloaded any file-sharing applications, and did not possess the songs the RIAA alleged he had downloaded. So far, none of the RIAA's nearly 18,000 lawsuits against individual file-swappers in the U.S. has gone to trial. Most have been settled by defendants, who have agreed to pay various amounts of damages to the record labels.

o Florida Judge OKs "Bully" Video Game for Release

Miami - After viewing a two-hour demonstration of Take-Two Interactive's "Bully" video game in court on Friday, a Florida judge denied a request to block the game's release in Florida on grounds that it constituted a "public nuisance." "There's a lot of violence. A whole lot. [But] less than we see on television every night," Judge Ronald Friedman said in open court, according to the Miami Herald. The game, developed by the makers of the violent "Grand Theft Auto" franchise, puts players in the footsteps of a student at Bullworth Academy, but does not feature weapons aside from a slingshot and baseball bat. "What you conducted in your chambers, Judge, was the equivalent of Iran leading UN weapons inspectors around the country taking them to places where the illegal activity was not occurring," Jack Thompson, the attorney who filed the Florida lawsuit seeking to block the game's release, wrote in a letter to Judge Friedman following the ruling. The game was released in Florida and the rest of the country on Tuesday. Meanwhile, major U.K. retailers PC World, Currys and Dixons announced they will not stock the game in Europe. "We're fully aware people will be able to buy this game elsewhere, but we feel this game is not appropriate for Currys' family-friendly image," a spokesman told GamesIndustry.biz.

o Consumer Electronics Assn. Passes on Video Game Trade Show

San Francisco - The Consumer Electronics Association (CEA), a trade group made up of consumer electronics makers and other technology firms, and producer of the annual Consumer Electronics Show, announced on Tuesday that it will not launch a 2007 video game trade show. The CEA previously announced its intention to explore the possibility of launching a video game event, in the wake of the cancellation of the Entertainment Software Association's (ESA) mammoth annual E3 event. "Although CEA was prepared to launch a new event, the recent announcement by ESA that it would open its event to both ESA and non-ESA members and would include PC and wireless gaming, led us to conclude that a new spring West Coast event would likely not serve the best needs of the industry. At this point, we will continue dialog with the industry to determine if the need for a broader gaming event exists for 2008," said Karen Chupka, senior vice president of events and conferences for CEA.

o Viacom's MTV Networks Acquires Teen User-Generated Site Quizilla.com

New York - Viacom's MTN Networks announced on Tuesday that it has acquired Quizilla.com, an online community featuring user-generated content from teen authors, from Gorilla Nation Media. Financial terms of the transaction were not disclosed. Founded in 2002, Quizilla is in the top five sites for teenage girls, and attracted 3.1 million unique visitors during September, according to comScore Media Metrix. The site's mix of quizzes, fiction, non-fiction, poetry, polls and other creative content will be added to The-N.com, part of Nickelodeon/MTVN Kids and Family Group.

o Wii Console Pre-Orders Sell Out at GameStop, Nintendo Store

New York - Both video game retail chain GameStop and Nintendo's own Nintendo World Store in New York have confirmed sell-outs of their pre-order allotments of Nintendo's next-generation Wii console on Friday, the same day they were first offered. Texas-based GameStop, which operates over 3,000 stores in the U.S., did not say how many Wii consoles Nintendo it was given for pre-orders. Kotaku.com reported that the Nintendo World Store at Rockefeller Center in New York also sold out of its Wii pre-order allotment on Friday, but did not say how many consoles had been reserved for Nintendo's only official retail store in North America. The Wii is scheduled to go on sale in the U.S. on Nov. 19 for $250.

o Universal Music: 250,000 Out-of-Print Tracks Downloaded This Year

London - Major record label Universal Music Group has sold over 250,000 downloads of songs from out-of-print albums since February, Reuters reported. The most popular of the 3,000 tracks offered in 20 mostly European countries is Gun's 1994 single "Word Up"; the most popular album is Big Country's 1984 release "Steeltown." Universal Music plans to digitally distribute more than 100,000 deleted and mostly vinyl-only European recordings over the next four years, with a second batch including albums from Maurice Chevalier and The Orb set for release in late November.

o NBA Offers Live Webcasts to Cable/Satellite "League Pass" Subscribers

New York - The National Basketball Association (NBA) announced that its new NBA.com site will for the first time offer subscribers to its NBA League Pass Broadband service access to a full season of live video webcasts of NBA games. The service is a free and exclusive extension of the League Pass service offered to digital cable and satellite TV subscribers, which is available for about $180 per season. The NBA said it has also added more free broadband video, a new Fantasy Resource center, and a new language-specific international site for Hong Kong to NBA.com.

o Report: Asia Pacific Mobile Music Revenues to Hit $9.3 Billion by 2010

Scottsdale, Ariz. - The mobile music market in the Asia Pacific region is poised to grow from $3.3 billion in 2005 to $9.3 billion by 2010, according to a report from market research firm In-Stat. Some 60% of those surveyed in the region said they have a phone capable of some form of music playback. Already, South Korea's mobile music industry has surpassed the country's conventional music industry, while China's mobile music revenues are set to reach $2.8 billion by 2010, trailing only Japan's projected $3.4 billion in revenues that year. "Ringtones have been the primary driver for mobile music growth in the past, but this will change as new mobile phones equipped with digital music file playback capability create a new market," said In-Stat director Bryan Wang. "As consumer preferences change, the future growth of the mobile music industry rests on ringback tones and full music tracks."

Troy, Mich. - Car stereo maker Delphi on Tuesday introduced the SKYFi3, an XM Satellite Radio receiver that is 65% smaller than its predecessor and can store up to 10 hours of XM programming. The SKYFi3 can also be equipped with a memory card for storing MP3 files, and a $49 Live Wearable Kit that allows the device to become portable via a built-in headphones antenna. Dreieich, Germany - European telco Tiscali announced on Tuesday that its streaming services unit has partnered with RawFlow, a provider of live peer-to-peer streaming technology, to increase the scalability and quality of Tiscali's network that streams radio station signals online. Tiscali will first implement RawFlow's technology on its Freestream initiative in Germany, which now streams over 100 terabytes per month of free radio signals from stations in exchange for ad space on their media players.

Atlanta - Turner Broadcasting's year-old GameTap subscription games and entertainment service on Tuesday announced its expansion into Canada, as well as the launch of an original games label. New subscribers in both the U.S. and Canada who sign up this month for an entire year of service will receive a discounted annual rate of $59.40; GameTap is otherwise $9.95 per month. The Atlanta-based company also announced the launch of GameTap Original, a label that will publish games from independent publishers and developers, such as "Sam & Max" and "Myst Online: Uru Live."

Melbourne, Fla. - Movie exhibitor Premiere Theaters on Tuesday announced plans to open a complete digital cinema multiplex using Dolby Digital Cinema systems. The Florida-based theater chain also expects to deploy nine additional Dolby Digital Cinema systems in its theaters. Dolby said that more than 175 of its digital projector systems have been installed in theaters worldwide.

Palo Alto, Calif. - Bix.com, a free service that lets users generate online competitions of all sorts, said on Tuesday that Interscope Records hip-hop artist The Game has created two new contests on its service.
