o Universal Music Sues Bolt, Grouper Over User-Posted Music Videos

Los Angeles - Major record label Universal Music Group has filed copyright infringement lawsuits against two websites -- Bolt.com and Grouper.com -- that feature music videos and other copyrighted content posted by users, according to The Hollywood Reporter. Universal's lawsuits, filed in U.S. District Court in Los Angeles, seek injunctions against Bolt and Grouper and the same $150,000-per-instance damages claimed in the record labels' lawsuits against the original Napster file-sharing service, and could run into the millions of dollars. Bolt and Grouper both said they remove copyrighted materials when asked, and maintain their services are protected by a "safe harbor" clause of the Digital Millennium Copyright Act that covers ISPs and others from litigation stemming from what customers do with their accounts. "The lawsuit is without merit and we expect to prevail," Grouper CEO Josh Felser said in a statement. "Our Web site is protected by federal law and we're vigilant about taking down copyrighted content when we're properly notified." A Bolt spokesperson told THR the company welcomes a dialogue with Universal, and added, "The YouTube-Google merger and subsequent partnerships with Universal, Warner and others demonstrate that viable models exist to enable our creative users to enjoy and play with copyrighted content. We do not encourage nor reward our members for utilizing or sharing copyrighted content of any kind." Universal recently signed a licensing agreement with Google acquisition YouTube -- which features a similar selection of music videos posted by users -- providing compensation to copyright holders for use of the videos.

o Visa Cuts Off Payments to Russian Music Download Site AllofMP3.com

San Francisco - Adding teeth to recent calls from the U.S. Trade Representative to shut down what the U.S. calls an illegal music download service, credit card company Visa announced on Wednesday that it has stopped processing payments to Russian music site AllofMP3.com, the International Herald Tribune reported. "It's no longer permitted to accept Visa cards," Simon Barker, a Visa International spokesman told CNET News.com. "The action we've taken is in line with legislation passed in Russia and international copyright law." AllofMP3.com sells digital albums for about $2 each -- far less than the $9.99 standard at iTunes and other retailers -- and has maintained that its site is licensed by a Russian copyrights society and conforms to Russian laws. However, U.S. Trade Representative Susan Schwab has targeted the site as a piracy haven, and in recent comments has suggested the site could jeopardize Russia's entry to the World Trade Organization. AllofMP3 on Tuesday for the first time went on the offensive, holding a virtual press conference for U.S. reporters during which it defended its license from the Russian Multimedia and Internet Society, which the company says sets aside 15% of revenue to pay artists. The recording industry disputed this claim. "Allofmp3.com summoned the world's media to specifically address the issue of their legality -- but all they did was duck the questions time and again. Allofmp3.com's claims to legality are false and spurious," said John Kennedy, chairman and CEO of the International Federation of the Phonographic Industry. In a signal it may be responding to mounting pressures, AllofMP3.com said on Tuesday that it plans to adopt an ad-supported model where it would offer downloads for free.

o Time Warner Cable Files for $100 Million IPO

New York - Time Warner Cable, the nation's second-largest cable TV provider behind Comcast, has filed for an initial public offering of $100 million. Bloomberg News reported the IPO may raise as much as $6.9 billion, with all proceeds going to creditors of the now defunct cable provider Adelphia, which Time Warner acquired in July together with Comcast for $16.7 billion in cash and Time Warner Cable stock. All told, Adelphia creditors have filed claims seeking a total of $3.98 trillion, which Adelphia has maintained exceeds its liability. Following the acquisition, Time Warner Cable became the largest cable TV provider in the New York and Los Angeles markets.

o Apple: Some Video iPods Shipped With Windows Virus

Cupertino, Calif. - Apple has confirmed that a malicious Windows-based code has shipped on a number of its Video iPods. The RavMonE.exe worm is not rated a serious threat, but can lower the security settings on Windows computers. Apple said the problem affects less than 1% of video iPods shipped after Sept. 12, 2006, and it has so far seen less than 25 reports concerning the problem. The company added that iPod nano and shuffle models, and Mac OS X are not affected by the malicious code. "As you might imagine, we are upset at Windows for not being more hardy against such viruses, and even more upset with ourselves, for not catching it," Apple said on a support page of its website. Anti-virus firm McAfee on Wednesday released a software tool that removes the RavMonE.exe worm.

o Yahoo to Acquire AdInterax; Invests in Right Media

Sunnyvale, Calif. - In a pair of major deals in the Internet advertising space, Yahoo has announced an agreement to acquire AdInterax, a New York-based provider of rich media advertising technology to online publishers, as well as an investment in New York-based Right Media, operator of an open media exchange. The company will pay an undisclosed amount for AdInterax, and plans to offer its rich media creative assembly and campaign management tools directly to marketers at no charge as part of its graphical advertising offerings. The AdInterax tracking and reporting module tracks traditional metrics including impressions, clicks, and reach and frequency, in addition to other key branding and direct marketing data. Yahoo also has purchased a 20% stake in Right Media, operator of an online exchange that allows ads to be auctioned to the highest bidder. More than 2 billion impressions are traded daily on the exchange, which Yahoo, itself, plans to join. Right Media raised a total of $45 million in its second round.

o Video Game Industry Details New, Leaner Annual E3 Trade Show

Washington - The Entertainment Software Association (ESA), a video game industry trade group, has announced plans for the pared-down version of its annual video game trade show that will replace its mammoth E3 event. The ESA said game publishers and retailers wanted to change the format of E3, which had grown so large and costly to produce that many publishers sought a smaller event where more actual business could be transacted. The new, invitation-only E3 Media and Business Summit will be held July 11-13, 2007, in various hotels in Santa Monica, California, with a game demo showcase to be held at a nearby sound stage called Barker Hangar. "The new E3 is first and foremost about getting business done," said ESA president Doug Lowenstein. "When we asked key audiences what they wanted in the new event, we heard that they wanted opportunities for high-level meetings in a business-like setting, to play games, network, and socialize, to see major company offerings while also preserving the sense of discovery that is so much a part of E3, and to hear substantive presentations on the most important issues and trends facing the industry."

o Viacom Offers MTV, Nickelodeon Videos on Chinese Search Engine Baidu

Beijing - Viacom's MTV Networks has announced a partnership with China's leading search engine, Baidu.com, which will create an MTV-branded area on Baidu offering 15,000 hours of MTV and Nickelodeon video content and music videos. While most content will be free and supported by advertising, some music videos will require payment for download. MTV and Baidu will share ad revenues; the companies said Motorola and Procter & Gamble are among the first advertisers on Baidu's MTV Zone. "This breakthrough relationship with Baidu delivers Chinese audiences a major digital platform for non-stop, 24-hour access to MTV and Nickelodeon programming content for the first time -- from "SpongeBob SquarePants," to "Pimp My Ride," to MTV China's vast local original programming like "MTV Tian Lai Cun" and "MTV Music Wire," said Bill Roedy, president of MTV Networks International.

o Nielsen to Launch Video Game Rating Service

New York - Nielsen Media Research announced on Wednesday plans to launch a new video game rating service, which will seek to establish new metrics for the buying and selling of in-game and other video game-related advertising. GamePlay Metrics, from the company's new wireless and interactive services division, will harvest data from Nielsen's existing measurement system on the most popular titles among gamers, and combine it with other demographic information and data such as which TV shows they watch. "A reliable and accurate standard of measurement for video gaming will drive advertising investment in this medium and help convert video game advertising from a discretionary advertising experiment to a must-have option," said Jeff Herrmann, vice president of Nielsen wireless and interactive services. Nielsen's GamePlay Metrics Service is slated to begin providing weekly video game ratings data in mid-2007.

o HarperCollins Launches Collaborative Online Writing Project for Teens

o Online Payments Service iKobo Raises $4 Million in Third Round

Atlanta - iKobo, the provider of a "person to person" online money transfer service, has raised $4 million in its third round of venture capital, led by Greenhill SAVP. Other investors in the deal include Total Technology Ventures and Council Ventures. Atlanta-based iKobo allows customers to send money online to about 145 countries. The recipient is sent a re-loadable Visa debit card which they can use to access money at ATMs or sales terminals.

New York - Digital music service eMusic announced on Wednesday that the European version of its service has signed up over 20,000 subscribers and served over two million downloads since launching on Aug. 10. The service officially launched in Europe on Sept. 12, and offers more than 1.7 million tracks from 8,500 mostly independent labels and artists.

Seattle - Amazon.com announced on Wednesday that it has signed an agreement with CBS-owned Showtime Networks, to offer downloads of episodes of Showtime series on the Amazon Unbox video download service. Unbox will now sell episodes of shows such as "The L Word," "Weeds," "Sleeper Cell," and "Fat Actress" for $1.99 each. An exclusive download of the pilot episode of Showtime's new series "Dexter" will also be available on Unbox for $0.01 for a limited time.

San Francisco - The Internet Streaming Media Alliance (ISMA), a trade association developing open standards for IPTV, on Wednesday announced the release of a video encryption specification for mobile TV. The ISMA, whose members include Apple, AOL, Cisco, HP, Intel and Philips, said the ISMACryp 1.1 specification has already been deployed to over 110,000 European customers in the first commercial DVB-H mobile TV service.

Foster City, Calif. - Sony Computer Entertainment America on Wednesday introduced PC software that facilitates the transfer of multimedia content to the Sony PSP handheld game system. The five million PSP owners can now also subscribe to podcasts, back-up game saves, and transfer DVD home videos, documents and PC browser bookmarks.

New York - World Wide Web Electronic Broadcast Network (WWEBNET) on Wednesday announced a partnership with major record label Universal Music UK, to create Universal-branded online channels that will deliver song and music video streams and downloads, artist features, interviews and other programming directly to users' desktops.
