o Google Profits Soar, Exceed Market Estimates

Mountain View, Calif. - Internet search giant Google on Thursday posted a 70% jump in quarterly profit to $733.4 million, and revenue almost doubled, to $2.69 billion. The results were at the top end of expectations on Wall Street and Google shares were up 7 percent in after-market trading. "Google right now seems to be running on all cylinders. They're executing phenomenally well," Jay Wong, a portfolio manager at Payden & Rygel Investment Management, told Reuters. The strong results are a testament to the fact that Internet users increasingly clicked on Internet advertisements provided through the Google AdWorks network. Chief executive Eric Schmidt has been able to squeeze more money out of each search query, helping to drive profit and establish dominance over Yahoo and Microsoft's MSN. Schmidt is now seeking to translate that success into online video, purchasing YouTube this week for $1.65 billion. Google's third quarter results were in sharp contrast to rival Yahoo, which earlier this week reported a 38 percent decline in profits.

o NBC Universal Announces Digital Strategy, 700 Layoffs

New York - NBC Universal on Thursday unveiled plans for "NBCU 2.0," a new organizational structure for the company that includes more focus on digital distribution, and 700 layoffs, or about 5% of its total workforce. "Success in this business means quickly adjusting to and anticipating change. This initiative is designed to help us exploit technology and focus our resources, as we continue our transformation into a digital media company for the 21st century," said Bob Wright, vice chairman of GE and chairman and CEO of NBC Universal. NBC Universal said the changes are in line with its recent investments in Vivendi Universal Entertainment, Telemundo and iVillage. The company plans to further modernize its newsgathering operations and utilize new digital distribution opportunities, and expects the new structure to reduce expenses by $750 million by the end of 2008. NBC Universal also projects that its digital revenues will exceed $1 billion by 2009.

o Strong iPod, Mac Sales Boost Apple Profits

Cupertino, Calif. - Buoyed by strong sales of its iPod digital music players and Macintosh computer, Apple on Wednesday posted better-than-expected quarterly results, including a 27% jump in net income. The company said that it sold 8.7 million iPods during the quarter, up 35% from a year ago, and had its best quarter ever in terms of Mac sales, with 1.6 million. As a result, its net income rose to $546 million from $430 million during the same quarter a year ago, and revenue climbed 32% to $4.84 billion. Both figures eclipsed estimates that the company issued in July.

o Former Gizmondo Exec Who Crashed Rare Ferrari Appears in Court

Los Angeles - The Swedish former executive of defunct handheld video game maker Gizmondo, who destroyed a $1 million Ferrari in a high speed crash on Malibu's Pacific Coast Highway, appeared in court on Thursday to face charges of car theft, embezzlement and driving under the influence, Reuters reported. Bo Stefan Eriksson, 44, wrecked the rare Enzo Ferrari a month after Gizmondo Europe declared bankruptcy, its handheld game system having failed to catch on with consumers. Eriksson was revealed to have prior convictions in Sweden, and allegedly headed an organized crime group called the Uppsala Mafia before joining Gizmondo. The wrecked Ferrari, along with two other rare vehicles worth a combined $4 million, were reported stolen by British banks after lease payments stopped in 2005. Eriksson, who faces up to 11 years in prison if convicted on all charges, turned down a plea agreement on Thursday that would have included two years and four months in jail.

o WWE Sues THQ, Jakks Over Wrestling Video Games

Agoura Hills, Calif. - Video game publishers THQ and Jakks Pacific have announced that World Wrestling Entertainment (WWE) filed suit against the companies on Oct. 12 in Connecticut state court, alleging improper sales of WWE video games in Japan and other countries in Asia. The lawsuit seeks unspecified monetary damages and a termination of the license WWE granted to THQ and Jakks in 1998 to make branded wrestling video games. "We believe the lawsuit is without merit and we intend to defend ourselves vigorously," THQ and Jakks said in a statement. The three companies have been involved in an ongoing dispute regarding the video game license, which WWE also alleged in a separate lawsuit filed in 2004 in New York was obtained through a "commercial bribery scheme."

o CEA, Consumer Advocacy Groups to Launch "Digital Freedom Campaign"

Washington - The Consumer Electronics Association (CEA), a trade group of consumer electronics makers and other technology firms, along with consumer advocacy groups Public Knowledge and the Media Access Project, have announced plans to launch a campaign that aims to unite innovators, artists and consumers to "reassert technology rights." The Digital Freedom Campaign will "empower innovators, students, artists and consumers to create and make lawful use of new technologies free of unreasonable government restrictions and without fear of costly and abusive lawsuits." The group added that "basic freedoms are under attack by the big record labels and movie studios whose aging monopolies are threatened by innovation." CEA president and CEO Gary Shapiro, Public Knowledge president Gigi Sohn and Media Access Project senior vice president Harold Feld are slated to be on hand at a press conference in Washington next Wednesday to announce further details about the Digital Freedom Campaign.

o Digital Data Exchange Establishes New Standards for Digital Music Sales

New York - The Digital Data Exchange (DDEX), a consortium of record labels, music rights societies and digital service providers working to develop data exchange standards for the sale of digital music, has announced the establishment of its first four standards on information sharing and transaction processing for digital music. They include an Electronic Release Notification Message Suite Standard (ERN), which provides information about musical works to digital music services; a Digital Sales Report Message Suite (DSR), which provides digital sales reports to record labels; and two other supporting standards that will aid the implementation of the ERN and DSR. DDEX said its members -- who include the four major record labels; ASCAP and the Harry Fox Agency; and Apple, Napster, RealNetworks and Microsoft -- are already working to begin exchanging live information using the standards before the end of the year, with further roll-out by additional companies planned for the first half of 2007.

o Indie Music Retailer Insound.com Launches Album-Only MP3 Store

New York - Insound.com, an online retailer of independent music on CD and vinyl, announced on Thursday the launch of a digital music store that will sell only full albums in the unprotected MP3 format. "While the sale of individual tracks certainly makes sense technologically for pop music, it is fully not in the best interest of the independent music community. It hurts not only artists, but also labels, retailers, and distributors," said Insound president Matt Wishnow. The New York-based company simultaneously launched a "Save the Album" campaign, to promote the digital store and "help celebrate a format that has endured recent threats at the hands of single track sales and subscription offers." For the campaign, artists including Lou Barlow, Devendra Banhart, The Mountain Goats and The Decembrists have recorded short video pieces celebrating their favorite albums, which may be viewed at SaveTheAlbum.com. Insound was launched in 1999, and the company said it began turning a profit from its online store in 2004. "The fact that I now can buy vinyl and download a full album instantly all in the same place truly makes Insound the perfect record store for the 21st century," said Jesse Woghin, co-owner of Chicago-based independent label Flameshovel.

o Music Nation, Clear Channel Launch Online Music Video Contest

New York - Music Nation on Thursday announced plans to launch an online music video contest that will award three winners a recording contract with Sony BMG's Epic Records. Beginning in mid-November, musicians and bands can submit their music videos in Rock, Pop or Urban genres at MusicNation.com, or through local Clear Channel radio station websites. Entries received after Jan. 1, 2007 will require a $25 entrance fee. Clear Channel will promote the contest on-air, as well as host weekly webisodes and feature the three winning acts on "Stripped," its in-studio performance series. New York-based Music Nation said it has also established partnerships with Mercury Records (Europe and Latin America) and Typhoon/EMI (Asia), and plans to expand its contest into other markets in 2007.

o Kudelski Group Buys Control of OpenTV for $132.3 Million

San Francisco - OpenTV, a developer of interactive TV software and services, announced on Thursday that Switzerland-based Kudelski Group, a developer of digital TV content protection technologies, has acquired voting control of the company from John Malone's Liberty Media in a stock deal valued at $132.3 million. As part of the deal, Liberty will pay San Francisco-based up to $19.7 million. Kudelski Group companies include digital TV security software developer Nagravision, as well as Abilis, Quative, SmarDTV and SkiData. The company has previously worked with OpenTV to develop various digital TV services; OpenTV's software is used to power over 73 million digital TV set-top boxes deployed in 96 countries. Upon closing of the transaction, Kudelski will appoint Alan Guggenheim, currently CEO of NagraStar -- a joint venture between Kudelski and EchoStar Communications -- as chief executive of OpenTV. The company will continue to operate independently and maintain its listing on the Nasdaq.

o Logitech Acquires Internet Radio Maker Slim Devices for $20 Million

Fremont, Calif. - Computer peripherals manufacturer Logitech announced on Thursday that it has acquired Slim Devices, a maker of Internet radios and home networking technology, for $20 million in cash. Founded in 2001, Mountain View, Calif.-based Slim Devices has developed products including the Squeezebox, a standalone radio that streams Internet radio stations over a broadband connection, and the Transporter, a home audio networking device. Switzerland-based Logitech, whose U.S. headquarters are based in Fremont, Calif., manufactures webcams, mice, keyboards, gaming controllers and audio peripherals like PC and MP3 player speakers and audio home networking devices. "Now we have the opportunity to leverage the marketing, sales, distribution, supply chain, manufacturing and engineering resources of a company that shares our passion for innovation in digital music and that can help us reach a wide range of mainstream customers," said Slim Devices CEO Sean Adams.

San Jose, Calif. - Looking to augment its video software offerings, Adobe Systems, the large developer of Web publishing and business software, said on Thursday that it has acquired Serious Magic Inc., a Folsom, Calif.-based maker of video software and communications tools. Financial terms of the deal were not disclosed. San Jose, Calif.-based Adobe plans to continue to sell Serious Magic's products, as well as integrate the acquired company's technology into own products. Mark Randall, CEO of Serious Magic, will become Adobe's chief strategist of dynamic media.

o Mobile Content Distribution Developer mVisible Raises $3 Million

Deerfield Beach, Fla. - mVisible Technologies, a developer of mobile content distribution technology, announced on Thursday that it has raised $3 million in its first round of venture capital financing, led by New World Angels. Florida-based mVisible's technology allows independent musicians to create, share and sell ringtones and wallpapers directly from their own websites or MySpace pages. More than 6,000 artists have created ringtones using the service since it launched earlier this year. The company will use the funds to scale its Myxer platform and MyxerTones website to support a greater number of independent musicians and their fans.

London - NewScientist.com reported on Thursday that a company has filed a patent application for an optical disc that contains an embedded electronic smart card chip, whose applications could include copyright protection of media. The "XCD," developed by Aladdin, is an irregularly-shaped disc that contains a smart card which can be connected to a USB port, so that encrypted media on the disc could potentially only be accessed by confirming a license via USB.

The performance will be streamed from Folds' MySpace page, and the artist will be taking requests via MySpace's instant messenger feature. Folds will also interact and chat live with fans this evening within the online world Second Life, as well as play songs off the new album.
