U.S. Govt. in Court Again Over Child Online Protection Act
Philadelphia - The American Civil Liberties Union (ACLU)
was in court again on Monday to continue its challenge to the 1998
Child Online Protection Act (COPA), which has not yet been enforced
but would criminalize the act of publishing materials "harmful to
children" online. The Supreme Court has already weighed in on the
law, twice granting preliminary injunctions against its enforcement,
and asked a lower court in Philadelphia to determine whether there
have been any changes in technology that would affect the
constitutionality of the statute. The ACLU will argue that the law,
which would provide prison terms and fines of up to $50,000 per day,
is a violation of First Amendment free speech rights, and may
unfairly target sites for rap artists, online magazines like
Salon.com and providers of safer sex information. "This case is
about speech," said ACLU lead counsel Chris Hansen. "It is not the
role of the government to decide what people can see and use on the
Internet. Those are personal decision that should be made by
individuals and their families." The ACLU also said the law is
ineffective because it cannot be applied to websites hosted
overseas; the group argues that currently available filtering
technology that blocks sex-related sites from kids eyes' is a viable
alternative. "The evidence will show that a shocking amount of
pornography slips through [filters] to children," argued government
attorney Eric Beane, the Associated Press reported.

Universal, Fox Withdraw Financing for Microsoft's "Halo" Movie
Los Angeles - Hollywood movie studios Universal and Fox
have dropped their financial support of a movie version of
Microsoft's "Halo" Xbox video game directed by Peter Jackson,
Variety reported. The filmmakers told Variety the deal collapsed
after Universal and Fox, which had agreed to co-finance the picture,
negotiated unsuccessfully to reduce the share of profits that
Microsoft and the filmmakers would receive from the movie. Under the
original deal, Microsoft was due to receive a $5 million upfront
payment and 10% of gross profits. There were also rumors the film
was expected to exceed its original $135 million budget and end up
costing closer to $200 million to make. "We are disappointed that
Universal and Fox wanted to significantly renegotiate the financial
points of the deal," Microsoft said in a statement. Ken Kamins, who
represents Peter Jackson, told Variety that Microsoft is already in
talks with other potential distribution partners, adding that there
will be no stoppage on the film's production.

Blockbuster Drops Lowest-Priced Online DVD Rental Plan
Dallas - Video rental giant Blockbuster has discontinued a
test of a $5.99 per month online DVD rental service, which matched
the cheapest offering from rival Netflix, Reuters reported. The
company did not say why it was ending the service. The cheapest
option from Blockbuster Online will now be a $7.99 per month service
that includes three rentals per month with one movie out at a time.
Blockbuster is also testing a feature that lets some subscribers to
Blockbuster Online return mailed rentals in person at Blockbuster
stores and exchange them for new titles on their queues. "We like
what we're seeing but have made no announcement about a national
rollout," spokesman Randy Hargrove told Reuters. The in-store
exchange would set Blockbuster's service, which aims to count 2
million subscribers by year's end, apart from market leader Netflix,
whose mail order-only service claims 5 million subscribers.

Scouts Team on Curriculum, "Respect Copyrights" Patch
Los Angeles - In an effort to discourage file-sharing and
promote respect for intellectual property at an early age, the
Motion Picture Association of America (MPAA) announced that it has
partnered with the Boy Scouts in Los Angeles to create an
anti-piracy curriculum and "Respect Copyrights" patch. Unlike a
badge, the MPAA patch will not be required to advance to the next
level of scouting. The curriculum will teach kids the basics of
copyrights and how to identify pirated works, and includes
activities such as visiting a movie studio, and creating a public
service announcement that "demonstrates the importance of copyright
protection." "Working with the Boy Scouts of Los Angeles, we have a
real opportunity to educate a new generation about how movies are
made, why they are valuable, and hopefully change attitudes about
intellectual property theft," said MPAA chairman and CEO Dan
Glickman. The curriculum will be offered to more than 52,000
youngsters involved in Boy Scout programs in the greater Los Angeles
area.

Santa Cruz, Calif. - Major League Baseball Productions
announced on Monday that it will offer custom DVDs of each game of
the 2006 World Series for purchase through Amazon.com's CustomFlix
DVD on Demand service. MLB partnered with A&E Home Video on the
service, through which CustomFlix will create each $19.95 individual
game DVD as it is ordered by a customer, and ship it within days of
the completion of each game.

Seeks User-Generated Videos for Online Talent Show
Santa Monica, Calif. - Hoping to generate traffic to its
own video-sharing destination in the wake of rival Google's
acquisition of YouTube, Yahoo on Monday announced the launch of an
eight-week, $50,000 online video contest that will seek "the hottest
original talent on the Internet." The Yahoo Talent Show, produced in
collaboration with Embassy Row, is seeking users' original video
clips, which may be submitted through the Nov. 27 contest deadline.
Voting by users will take place from Nov. 13 through Dec. 4. The
site will also feature a daily show hosted by TV personality Mayleen
Ramey that will highlight a selection of the most interesting new
submissions.

Remains Dominant VC Market During Third Quarter
San Francisco - The San Francisco Bay area remained the
dominant market for venture capital investing during the third
quarter, according to new figures released by Dow Jones VentureOne
and Ernst & Young. The area saw 207 VC deals worth a total of $2.45
billion during the period, a decline in the number of deals from a
year ago but an 8% increase in capital. The local scene mimicked a
national trend, which saw venture capital investing outpace the
previous year's activity for the third straight quarter. All told,
there were 611 deals worth $6.36 billion, increases of 2% and 5%
over the same period a year ago. "This is the first time since 2001
that we have seen three consecutive quarters in which investments
exceeded $6 billion, " said Joseph Muscat, the Americas director of
the Ernst & Young Venture Capital Advisory Group. "Factors
contributing to this trend include an improved liquidity environment
based on the robust merger and acquisition market and the positive
reaction of the capital markets to recent technology IPOs." Some of
the largest local VC rounds went to Cortina Systems ($132 million)
and MobiTV ($70 million).

New York - Muze, a provider of informational databases on
music, movies, books and video games, announced on Monday that it
has signed an agreement with Fox Interactive Media's IGN video games
site to create a jointly-owned video game database. The MuzeGames
database will feature editorial coverage of nearly 45,000 video game
titles, with accompanying cover images, screenshots and trailers.
IGN will provide editorial content for, and power the database,
while Muze will provide marketing and distribution to outlets
including retailers, video service providers and consumer
electronics makers.

Internet Research Influences Most Consumer Electronics Purchases
Arlington, Va. - About 77% of consumer electronics
purchases are influenced by Internet research, according to a new
study commissioned by the Consumer Electronics Association (CEA) and
Yahoo. The study, conducted by Hall and Partners, explored the ways
that consumers buy cell phones, computers, digital cameras, digital
music players and televisions, and found that online research time
directly correlated to product price. As the price of a product
increased, so did the amount of time a consumer spent researching
that product. The least amount of time spent researching was on cell
phones at nine hours and the most was 15 hours on televisions. For
those who purchased, the average amount of time spent researching
online was 12 hours. About three-quarter of consumers said that
comparing prices of the same product at different stores is easy to
do online and two-thirds said that they preferred shopping online
because of the wider variety of products.

Mobile Internet More Popular With Europeans Than Americans
London - Europeans are more likely than Americans to use
their mobile phones to access the Internet, as 29% of European
Internet users regularly log on via their phones, compared with 19%
of U.S. users, according to a report from comScore. Germany and
Italy boast the highest mobile Web penetration in Europe (34% each),
followed by France (28%), Spain (26%) and the U.K. (24%). Nokia is
the most popular handset amongst European mobile Internet users,
capturing 50% market share in Italy and 22% in France, compared with
17% of the market in the U.S., where Motorola leads with 26%. While
the mobile sites of major portals like Google, Yahoo and MSN capture
74% of the U.S. market, in Europe these sites run neck-and-neck with
sites set up by mobile carriers like Vodafone, O2 and T-Mobile,
where major portals and wireless network operators each claim about
one-quarter of mobile Internet visits. "In Europe, the mobile
Internet appears to mirror the dynamics of the fixed Internet.
Google remains strong but the other U.S.-based portals achieve much
lower penetration, facing stiff competition from local competitors
-- in this case the mobile providers," said Bob Ivins, managing
director of comScore Europe.

Menlo Park, Calif. - Jingle Networks, the operator of the
1-800-FREE411 directory assistance service, said on Monday that it
has raised $30 million in its third round of funding, co-led by
Goldman, Sachs & Co. and Hearst Corp. Previous investors Comcast
Interactive Capital, First Round Capital, IDG Ventures Boston and
Liberty Associated Partner also participated. It marks the company's
second round of funding in just six months, following its $26
million round in April. Jingle's advertiser-supported 411 service
now processes nearly 3% of directory assistance calls in the U.S.,

Tokyo - Sony has once again delayed the release of its first
standalone Blu-ray Disc player in North America. The BDP-S1, which
had been scheduled for release in August before being bumped to
October, will now go on sale for $999 in North America "on or about
Dec. 4, 2006," according to SonyStyle.com. The player will now ship
later than Sony's PlayStation 3, which also features a Blu-ray drive
and goes on sale in North America on Nov. 17.

San Francisco - BitTorrent, the popular peer-to-peer
file-sharing network, announced on Monday that it has partnered with
a number of consumer electronics firms, which plan to embed
BitTorrent into their products. ASUS, Planex and QNAP will implement
the BitTorrent download manager into a range of wireless routers,
media servers and storage devices, which will allow users to
download media files from BitTorrent without the need of a PC.

Yahoo After MSN, Google
London - The Belgian copyrights organization that sued Google
to have references to Belgian newspapers removed from the search
engine and Google News is also in talks with Microsoft's MSN, and
plans to target Yahoo as well, The Register reported. "The law is
the law," said Margaret Boribon, secretary general for Copiepresse.
"We are producing protected works and the law in Europe says clearly
that to re-use that content you have to ask for permission. We want
every search engine, aggregator or re-user of our content to respect
it and to ask for agreement and to pay a fair price." Copiepresse's
ongoing case against Google will return to court next month.

AOL Video Adds Downloadable Movies from Paramount Pictures
Dulles, Va. - AOL announced on Monday that it has added films
and TV shows from Viacom's Paramount Pictures to the offering on its
AOL Video portal. New releases, TV specials, library hits and cult
favorites will be available for download for between $9.99 and
$19.99 per movie. AOL also said it added content from BlueHighways
TV, The Employment & Careers Channel, The Hip Hop Hall of Fame,
MyPath TV and Plum to AOL Video, which features over 50
video-on-demand channels that combine free and download-to-own
programming.

Thomson's Technicolor to Convert Mann Theatres to Digital
Burbank, Calif. - French electronics firm Thomson announced
on Monday that its Burbank, Calif.-based Technicolor Digital Cinema
unit has installed digital projection systems in several Mann
Theatres locations in Los Angeles, as part of its North America beta
test of digital cinema equipment. The test includes projectors at
Grauman's Chinese Theatre and Mann Chinese 6 in Hollywood, as well
as the Village, Bruin, Criterion 6 and Marketplace 4 theaters.
Thomson aims to install digital projection systems in up to 5,000
screens over the next 3-4 years, and at least 15,000 screens in the
U.S. and Canada over the next 10 years.
