o Hollywood Petitions Fortune 1,000 Companies to Patrol File-Sharing

Washington -- Entertainment companies sent a letter to the CEO of every
Fortune 1,000 company this week, asking them to "take whatever steps
necessary to ensure that their networks are not being misused to infringe
copyrighted works." The letter, jointly signed by the Motion Picture
Association of America (MPAA), the National Music Publishers' Association
(NMPA), Recording Industry Association of America (RIAA) and the
Songwriters Guild of America (SGA), targets the use of file-sharing
networks like Kazaa and Gnutella in the workplace, where employees
typically have access to high-speed Internet connections. Several of the
same groups sent a similar letter to colleges and universities, asking
them to patrol their networks for copyright infringements and educate
students about file-sharing.

o NDS Countersues DirecTV; Additional Digital TV Firm Sues NDS

London -- NDS, a provider of digital TV security technology owned by News
Corp., announced that it has countersued satellite TV provider DirecTV,
alleging the company "misappropriated NDS's trade secrets and proprietary
information, conspired to infringe NDS's patents, colluded to create
unfair competition and breached agreements and licenses restricting the
use of NDS's intellectual property." The suit alleges many of the same
crimes, such as leaking information on how to hack pay-TV "smart cards"
onto the Web, which NDS has been accused of by DirecTV as well as
Vivendi's Canal Plus Technologies, satellite TV firm EchoStar, smart card
maker NagraStar, and Malaysian satellite broadcaster Measat Broadcast
Network Systems -- which filed suit against NDS today. Earlier this month,
the U.S. Attorney's office in San Diego subpoenaed NDS documents for its
investigation into allegations similar to those of NDS' competitors.

o Listen.com Licenses Tracks for Burning to CD from Warner, Universal

San Francisco -- Listen.com, operator of the Rhapsody digital music
subscription service, announced on Thursday extensions to agreements with
two major record labels, Warner Music Group and Universal Music Group.
Both agreements will allow Rhapsody subscribers to burn select tracks from
each label's catalog onto a recordable CD for $0.99 per song. Financial
terms of both deals were not disclosed. Under the agreement with
Universal, about 40,000 tracks from its catalog will be available to burn;
Warner did not specify a number of tracks it would make available. San
Francisco-based Listen.com's service is distributed by AT&T Wireless,
Verizon, Charter Communications, DirecTV Broadband and others.

o Web Portal Terra Lycos Lays Off 174 U.S. Employees

Waltham, Mass. -- Terra Lycos, a global Internet portal, has laid off 174
employees, or 21 percent of its U.S. staff, the Associated Press reported.
The layoffs come as a result of redundancies created by the merger of
Terra and Lycos in October 2002. Barcelona-based Terra Lycos said it will
also cut back in some of its content areas to focus on key assets, like
its search engine. "This reorganization is about focusing on our most
valuable properties," Terra Lycos spokeswoman Jennifer Risi told AP.

o Live365.com Files for Emergency Stay of Webcasting Royalty Rates 

Washington -- Webcaster Live365.com has filed for an emergency stay of the
Librarian of Congress' determination of the royalty rates webcasters must
pay to stream music online, which went into effect on Oct. 20. The U.S.
Copyright Office rejected an earlier motion to stay the decision last
week. In its emergency motion filed with the Washington, D.C. Circuit
Court of Appeals, Foster City, Calif.-based Live365 argues that the
Librarian's determination was arbitrary, because it was based on only one
actual existing webcast royalty agreement, between the Recording Industry
Association of America (RIAA) and Yahoo. The company also claims First
Amendment rights are in violation.

o Microsoft, Disney Launch Co-Branded Internet Service on MSN

New York -- Microsoft and The Walt Disney Company on Thursday announced
the launch of a co-branded dial-up Internet access service, targeted at
Disney's core audience of children. The $21.95 monthly service, which will
be offered under Microsoft's recently released MSN 8, includes a
kid-oriented start-up page, parental controls and a free subscription to
Disney Blast, a premium kids' content service. "Disney on MSN combines the
ultimate resource for family content with technology that families can
trust," said Microsoft chairman Bill Gates. "This service gives parents
the tools they need to help make the Internet safe and fun for their
children -- without sacrificing powerful browsing and communications
capabilities." The service will be marketed by Disney Online, The Disney
Store, Walt Disney Parks and Resorts, Buena Vista Home Entertainment and
other affiliates.

Automotive Group, a nationwide network of automotive dealers, to
distribute satellite radio receivers. Connecticut-based Asbury operates

different vehicle brands including BMW, Toyota, Chevrolet, Ford, Honda,

(Hillsboro, Ore.) CenterSpan Communications, a provider of peer-to-peer
content delivery network services, announced on Thursday that BlackStage
Communications Group will use its C-StarOne network to deliver its
streamed and downloaded urban content and promotions. New Jersey-based
BlackStage holds streaming rights to content from personalities including
Shaquille O'Neal, as well as film shorts, video and animation from Black
and Pan African film festivals. The company plans to distribute a Ray
Charles Gospel and Holiday concert on CenterSpan's network in December.

(San Francisco) CNET News.com on Thursday reported on the increasingly
aggressive steps copyright holders are taking to have their materials
removed from websites which have not sought the proper permissions. Under
the Digital Millennium Copyright Act (DMCA), copyright owners may send a
"takedown notice" to a website owner and his or her ISP -- to have their
materials removed. Often an ISP or search engine will simply comply with
the request in order to avoid a costly legal battle. "We're seeing a trend
toward more aggressive protection of (intellectual property) rights,"
David Schnapf, an attorney with Coudert Brothers, told News.com. "Some
sites that shouldn't come down are coming down. That could have serious
implications for the Internet," said Jennifer Urban, who works on
ChillingEffects.org, a site that publishes takedown notices sent to
website publishers, search engines and ISPs.
