BitTorrent Network Operators Convicted on Copyright Charges
Helsinki - A court in Finland has convicted 21 operators
of a BitTorrent network on copyright-related charges, and ordered
them to pay damages and expenses of over $721,000 to rights holders.
The court rejected the argument from the operators of Finreactor,
who claimed they were not liable as media was exchanged directly
between users, ruling instead that defendants willfully encouraged
copyright infringement, requiring its 10,000 users to maintain a
minimum ratio of uploaded to downloaded content to maintain their
accounts. During three months in late 2004, Finreactor users
downloaded nearly 16,000 games, 136,000 movies and 274,000 music
albums on the network.

Microsoft: Six Million Xbox 360 Video Game Consoles Sold
Redmond, Wash. - Microsoft has sold a total of six million
Xbox 360 video game consoles since the product's release nearly a
year ago, according to first quarter results. The company expects to
have shipped 10 million units worldwide by the end of 2006.
Microsoft also narrowed losses at the division which includes its
Xbox business, from $173 million in the first quarter of 2005 to $96
million in the same period this year.

Chairman Levy: "The CD as it is Right Now is Dead"
London - Alain Levy, the chairman and CEO of major record
label EMI Music, made the comment before an audience at the London
Business School this week, MarketWatch.com reported. "You're not
going to offer your mother-in-law iTunes downloads for Christmas,"
Levy added. "But we have to be much more innovative in the way we
sell physical content...By the beginning of next year, none of our
content will come without any additional material." Levy stated that
60% of consumers now rip CDs to their computers for transfer to
portable devices. The head of EMI Music also said the company was
continuing talks with Google on an ad revenue-sharing deal to
license EMI content to YouTube, Google's recently acquired
video-sharing site. EMI rivals Warner Music, Sony BMG and Universal
have already signed licensing deals with YouTube.

Court Orders ISP to Block Access to Russia's AllofMP3.com
London - A Danish court has ordered an ISP to block
subscribers from accessing controversial Russian digital music store
AllofMP3.com. The ruling came as a result of a lawsuit filed by the
International Federation of the Phonographic Industry (IFPI), an
international record label trade group. The Danish court on
Wednesday ordered Sweden-based ISP Tele2 to block its subscribers'
access to the Russian download store, which claims to be properly
licensed but sells albums for as little as $2. "This judgment is one
more step along the road to getting this rogue site closed down.
Allofmp3.com illegally offers for sale copies of music that it has
no right to reproduce or distribute," said IFPI chairman and CEO I
John Kennedy. The ruling follows decisions from MasterCard and Visa
to block payments to AllofMP3.com, and pressure from the U.S. Trade
Representative to have the site shuttered.

Denies Motion to Dismiss in Take-Two Class Action
New York - A federal judge has denied "Grand Theft Auto"
game publisher Take-Two Interactive's motion to dismiss a class
action lawsuit that claims the company violated consumer protection
laws when it included hidden sexually explicit content in the game,
Reuters reported. U.S. District Judge Shirley Wohl Kram rejected
Take-Two's argument that plaintiffs could only file claims in states
in which they resided, instead of all 50 states. "If class
certification is granted, the court will have the benefit of a
well-defined class and a more fully developed treatment of potential
choice of law questions," Kram wrote in an opinion dated Wednesday.

Group Led by Ted Venetoulis Looking to Buy Baltimore Sun
Baltimore - A group led by former Baltimore County
Executive Ted Venetoulis is hoping to buy The Baltimore Sun from
owner Tribune, The Washington Post reported on Friday. Venetoulis,
whose Baltimore Media Group also includes local civic leader Walter
Sondheim Jr. and Robert Embry Jr., the president of Baltimore's
Abell Foundation, said that he's hoping to return the paper to
private ownership to restore some of the quality that has been lost
over the years as a result of increased budget concerns. "Everyone
(in the investment group) needs to understand this may not be the
best business venture around and the return may not be what they
expect," he told The Post. "This is part civic responsibility."
Tribune, which purchased The Sun and other papers from Times Mirror
in 2000, set Friday as its deadline for bids for either the company
as a whole or its individual pieces. The Post reported the DC-based
Carlyle Group is expected to be among the bidders for Tribune. The
Sun's daily circulation has dropped about 10% over the past year to
236,000.

U.S. Online Spending Increases 16% in Third Quarter
Reston, Va. - Total online spending by U.S. consumers
reached $41.3 billion in the third quarter, up 16% from the same
quarter a year ago, according to new figures from comScore Networks.
Leading the charge was spending on consumer electronics (up 42%) and
apparel and accessories (up 32%). The firm is now forecasting that
total consumer online spending this year will reach approximately
$170 billion, with non-travel spending breaking the $100 billion
threshold for the first time. "Online consumer spending at U.S.
sites -- and particularly non-travel spending -- remains strong,"
said Gian Fulgoni, the chairman of comScore Networks.

Systems Raises $35 Million in Fourth Round
San Francisco - Zoom Systems, a maker of automated robotic
stores, said that it has raised $35 million in its fourth round of
funding from Goldman, Sachs & Co., Sierra Ventures and Motorola
Ventures. NeoCarta Ventures, which led the company's second round,
also contributed. The company's robotic stores are located in high
traffic areas, and allow shoppers to select products through a touch
screen graphic interface. They can pay for items with a credit or
debit card and receive them from a robotic arm. All of Zoom's stores
are networked and centrally monitored. Over the next two years, Zoom
said that it plans to implement several thousand of the units at
airports, hotels, malls and retail stores.

Jupitermedia Acquires Spanish Image Distributor
Darien, Conn. - Jupitermedia, the provider of original
information, images and digital content, said on Thursday that its
Jupiterimages division has acquired Cover - Imagen y Publicaciones,
a Spain-based distributor of local and international rights-managed
images. Financial terms of the deal were not disclosed. The
acquisition gives Jupiterimages, which already owns a library of
more than 7 million online images online, about 1.5 million more
images that are distributed in Spain. Alan Meckler, the chairman and
CEO of Jupitermedia, said that the deal will help his company grow
its presence in Spain, just as it has in France and Germany over the
past year.
