o DVD Copy Software Firm Sues Studios for Right to Distribute Product

Los Angeles -- The software firm that makes DVD Copy Plus, a program that
can copy DVD discs, has sued major Hollywood films, asking a judge to
declare its product legal or else rule the anticircumvention provisions of
the Digital Millennium Copyright Act to be unconstitutional, The Los
Angeles Times reported. 321 Studios, which distributes DVD Copy Plus, and
its founder Robert H. Moore filed suit in U.S. District Court in San
Francisco against studios including Sony Pictures, Time Warner, Universal,
MGM and Disney. Moore and 321 Studios argue that the DVD Copy Plus program
allows those who have purchased a DVD to make a backup copy for their
personal use; however, the program may also be used to copy rented or
borrowed DVDs, not in line with the company's "fair use" defense. Moore
said that to date, various versions of DVD Copy Plus have sold over
100,000 units.

o European Union to Fine Nintendo for Sales Practices

Brussels -- The European Union will fine Japanese video game maker
Nintendo and a number of its distributors this week for sales practices it
employed in the mid-1990s, according to Reuters. The EU charges that
Nintendo conspired with distributors to limit the cross-border flow of its
products in an effort to boost wholesale prices. A decision is expected on
Wednesday. Nintendo confirmed to Reuters that it has already set aside an
undisclosed sum to account for the fines.

o Broadband Content Delivery Provider Kontiki Raises $16 Million

Sunnyvale, Calif. -- Kontiki, a provider of secure digital video and data
delivery technology to businesses, announced on Monday that it has raised
$16 million in its second round of venture capital financing. Adobe
Ventures and VeriSign led the investment round; previous investors
Benchmark Capital and The Barksdale Group also participated. The company
has raised a total of $34 million. Sunnyvale, Calif.-based Kontiki's
technology is used by customers including Adobe and VeriSign to securely
distribute digital media such as training videos, product launch
presentations, and customer support videos to employees.

o DataPlay Investor Trans World to Record $5.3 Million Charge 

Albany, N.Y. -- Trans World Entertainment, an online and off-line seller
of music and videos, announced on Monday it will take a $5.3 million
charge in the third quarter for its lost investment in DataPlay, the
optical discmaker which filed for Ch. 11 bankruptcy protection last week.
New York-based Trans World, which owns retail chains Coconuts Music and
Movies, Strawberries Music, Spec's and Planet Music, in addition to the
FYE (For Your Entertainment) stores and FYE.com e-commerce site, made the
investment in June 2001. Although consumer electronics firms had already
begun to sell devices capable of playing the quarter-sized DataPlay discs,
the company was not able to raise enough funds to continue operations.
Trans World said that it and other retailers had "anticipated that this
new format would be a driver for new music sales."

o Swedish IT Firm Files Hacking Charges Against Reuters

Stockholm -- Intentia International, a Swedish technology group, on Monday
filed criminal charges against Reuters Group after the U.K.-based news
agency allegedly hacked into the company's IT system and then published
the company's third-quarter results before they were officially announced
last week. "The incident has severely damaged confidence in us as
individuals and in Intentia as a company," Intentia CEO Bjorn Algkvist
said in a statement. Reuters has rejected the allegations.

o Asian Broadband, VOD Provider GigaMedia Gets Notice from Nasdaq

Taipei -- GigaMedia, a broadband ISP and distributor of music and
video-on-demand programming, said on Monday it received notice from the
Nasdaq that its shares are in danger of being delisted from the exchange.
Taipei-based GigaMedia's shares have traded below the Nasdaq's $1 minimum
since the middle of September. GigaMedia operates a broadband ISP and also
owns two large record store chains in Taiwan. The company laid off 17
percent of its employees in September.

(Santa Monica, Calif.) Vivendi Universal's Universal Music Group announced
on Monday the release of its first albums in the Super Audio CD format, a
new proprietary format developed jointly by Sony and Philips. In addition
to elevated sound quality, the format offers four times the storage
capacity of a normal CD, for adding text and images, disc variations and

(St. Louis) Cable TV operator Charter Communications announced on Monday
that it will launch video-on-demand services in nine additional markets by

(New York) Game developer Infogrames on Monday announced the release of
"Backyard Football" for Nintendo's GameCube console and Game Boy Advance
handheld. Developed by Left Field and Humongous Entertainment, the game
features Donovan McNabb of the NFL's Philadelphia Eagles as spokesman, and
aims to help teach kids the basics of the game of football. The game is
accompanied by a TV special featuring McNabb called "NFL Backyard Basics:
Football Tips from the Pros," which will air on CBS.

Oxford Union, a debating club at the university, that featured Recording
Industry of America chairman Hilary Rosen and International Federation of

Freenet, an encrypted peer-to-peer network technology created by a group
of independent developers led by Scotsman Ian Clarke. Freenet does more to
protect the identity of those using the program, as well as what content
is being traded among its users, than do other more popular programs such
as Kazaa or Morpheus, although Freenet has suffered from lack of usability
and long delays in the release of the current version. "This is the first
(release) where we can confidently encourage people to go download the
software and comfortably expect it to work for them," Clarke told
News.com. "Before it's always been a bit of a case of having our fingers
crossed."
