o Fortune: Yahoo in Talks to Buy AOL

Sunnyvale, Calif. - Hoping to jumpstart talks that initially died about a year ago, Yahoo may be again considering a bid for AOL, according to a report from Fortune. The magazine's website said that multiple sources have confirmed the company's talks with AOL parent Time Warner, though a source close to Yahoo denied them. Fortune said that the move would help Yahoo Chairman and CEO Terry Semel regain some of the spotlight from Mountain View-based rival Google, which in May finalized a $1 billion investment in AOL as part of an even large advertising and search deal. Yahoo, which reportedly has about $3 billion in cash and equivalents available, has been rumored to be on the verge of a $1 billion acquisition of social networking site Facebook.

o MySpace Licenses Gracenote Technology to Block Copyrighted Music

Los Angeles - Fox's MySpace announced on Monday that it has implemented a system that will block unauthorized copyrighted music from being posted to the online social network. The company licensed Gracenote's MusicID audio fingerprinting technology, which can identify copyrighted works present in its database and allow MySpace to block uploading of these works. MySpace added that users who repeatedly attempt to upload unauthorized music will have their accounts permanently deleted. "MySpace is staunchly committed to protecting artists' rights -- whether those artists are on major labels or are independent acts," said MySpace co-founder and CEO Chris DeWolfe. "This is another important step we're taking to ensure artists control the content they create." Emeryville, Calif.-based Gracenote's database is also used by many music applications to identify CDs and track listings when users insert a CD into their computers.

o Virginia Man Gets 5 Months in BitTorrent Copyright Conviction

Roanoke, Va. - A Virginia man convicted of criminal copyright infringement for using the BitTorrent peer-to-peer network has been sentenced to five months in prison, another five months of house arrest, three years of probation and a $3,000 fine. Grant T. Stanley, 23, of Wise, Virginia, pleaded guilty to the charges related to Elitetorrents, a site for which he was a network administrator that made the latest "Star Wars" movie available online hours before its official release. "This is the first criminal enforcement action against copyright infringement on a P2P network using BitTorrent technology," said United States Attorney John Brownlee. "We hope this case sends the message that cyberspace will not provide a shield of anonymity for those who choose to break our copyright laws." Stanley was one of three defendants convicted so far as part of Operation D-Elite, a federal crackdown on the Elite Torrents network, which the government said counted 133,000 members and facilitated the illegal distribution of more than 2 million copies of movies, software, music and games.

o YouTube Removes Copyrighted Clips from Viacom's Comedy Central

New York - YouTube, the video-sharing site that Google is paying $1.65 billion to acquire, late last week began removing copyrighted clips from Viacom's Comedy Central, The New York Times reported. The move comes as YouTube removed some 30,000 clips at the behest of a Japanese copyrights society, and new deals signed with major record labels Sony BMG, Universal and Warner that compensate them for the right to post their copyrighted materials. Clips from Comedy Central's "The Daily Show," "South Park" and "The Colbert Report" were among those removed from YouTube; it is unclear whether they included submissions from a contest launched by "The Colbert Report," where users were actually asked to submit videos via YouTube that contained elements of the show.

o "Bully" Game Features Two Boys Kissing; Florida Lawyer Attacks

Los Angeles - Video game publisher Take-Two Interactive, which has generated controversy and lawsuits with its violent "Grand Theft Auto" franchise, is "courting new controversy" with a feature in its new "Bully" schoolyard game that allows boy characters to kiss one another, Reuters reported. The hero of the Teen-rated game, which ranked third in U.S. sales for the week of Oct. 27, is a 15-year-old named Jimmy who must navigate a modern-day boarding school. In addition to brawling, Jimmy can also court the affections of both girls and boys in the game. "I'm hot. You're hot. Let's make out," a tall blond boy in the game replies when approached by Jimmy. Attorney Jack Thompson, who last week failed to convince a Florida judge that "Bully" was too violent for store shelves, wrote in a letter to retailers and Take-Two that the "homosexual activity" in the game in his legal opinion "violates Florida's 'Sexual Material Harmful to Minors Statute'," which would make each sale of the game to a minor a felony. Comment posters on GayGamer.net pointed out that other games -- including "The Sims," "Fable," and "Jade Empire" -- have also allowed gamers to court other characters of the same sex.

o Universal Music to Cut European Download Prices on Catalog Albums

London - Major record label Universal Music Group has announced plans to discount the European digital album prices for some of its back catalog releases, Reuters reported. Beginning Nov. 1, more than 1,500 albums will be reduced in price at U.K. retailers like iTunes to between about $8.89 and $10.43, down from between $12.70 and $15.20. The albums include The Who's "Quadrophenia" and R.E.M.'s "Reckoning," along with LPs from The Cure and Buddy Holly. "As the leading online record company, we are totally committed to expanding and developing the digital music market," said Max Hole, head of marketing for Universal Music's international division.

o IDPF Releases New Digital Book Standard

New York - A new e-book standard has been released that allows publishers to include XML-based e-book contents, metadata, signatures, encryption, rights and other information in one standard file. The Open eBook Publication Structure (OEBPS) and Open eBook Publication Structure Container Format (OCF) were released by the International Digital Publishing Forum (IDPF), whose members include Adobe, Mobipocket, OverDrive, Hachette Book Group, Random House and Simon & Schuster. The new standard will allow publishers to release a single file to sales and distribution channels, and enable consumers to exchange unencrypted e-books between reading systems that support the new standard. "Today's announcement heralds the beginning of increased title availability and lower costs for publishers entering the eBook and digital reading market," said Neil de Young, of Hachette Book Group USA.

o Silverstar Holdings to Acquire U.K. Game Developer Empire Interactive

Boca Raton, Fla. - Silverstar Holdings, a publicly-traded firm with stakes in companies including game publisher Strategy First and chipmaker Magnolia Broadband, announced on Monday an offer to acquire London-based game publisher Empire Interactive. Under the terms, shareholders would receive about $7.2 million in cash at closing, or $6.15 million upfront and another $6.4 million through a stock-based earn-out. Empire publishes a range of game titles, including the racing franchises "Big Mutha Truckers" and "FlatOut." Bermuda-based Silverstar said 63% of Empire shareholders have already committed to the earn-out option, and expects the deal to close in late November.

o GarageBand.com Contest to Air Unsigned Artists on FM Radio

San Francisco - GarageBand.com, an online community for aspiring artists and fans of independent music, on Monday announced the launch of a talent contest that will give unsigned artists radio airplay on U.S. FM stations. Sponsored by Cingular Wireless, the GarageBand Faceoff will air clips of the most popular entries on a four-minute weekday afternoon radio show heard on stations including WFNY, KITS, WYSP and WKRK. Listeners will be able to vote for the better of two bands via SMS and Web voting, with the winner to return the next day to face another challenger. o Brightcove Lets Users Distribute Commercial Internet TV Channels

Cambridge, Mass. - Internet TV distributor Brightcove on Monday introduced a new free service that lets anyone launch their own commercial Internet video channels that generate revenue through advertising and video download sales. The Brightcove Network will share 50% of revenue from ads sold by Brightcove with users, who can also set their own prices for video downloads and earn 70% of the sale price for each transaction. Cambridge, Mass.-based Brightcove announced that it partnered with AOL, to allow users to distribute ad-supported or paid videos through the AOL Video portal, and also hatched plans to make Brightcove.com a consumer destination for viewing Internet TV channels. Other companies using Brightcove to distribute video programming include Warner Music Group.

o Survey: Tech-Savvy Consumers Hesitant to Buy New DVD Players

San Francisco - The overwhelming majority (81%) of tech enthusiasts remain skeptical about which next-generation DVD technology will be the market standard, according to a new survey by CNET and the Consumer Electronics Association. The study comes as manufacturers prepare to release several players that run on varying formats. Other factors that respondents said will initially keep them from buying the new players include the price of the machines (74%) and concerns about their compatibility with current DVD players (54%). "The studios, manufacturers, retailers and media companies have their own theories on how this will play out in the market," said Claudia Haase, senior research manager at CNET. “But, at the end of the day, the only thing that matters is the consumer."

o Web-based Ad Agency Spot Runner Lands $40 Million

Los Angeles - Spot Runner, an Internet-based advertising agency that lets local businesses advertise on cable TV, announced on Monday that it has received $40 million in new equity investments from WPP, CBS, Interpublic Group and other institutions. In addition to identifying and offering unsold ad space on cable TV networks, Los Angeles-based Spot Runner's service also helps local businesses create their own TV ads. New investor WPP, which manages $50 billion of clients' ad budgets, plans to use Spot Runner's Web-based platform to help clients target ads across all media channels more effectively at the local level, while CBS will use Spot Runner to sell ad inventory and bring new local advertisers to its media properties. New York - Mobile entertainment retailer Thumbplay announced on Monday that it has raised $15 million in new funding, through a $10 million third round of venture capital led by Bain Capital Ventures, and a $5 million load from Silicon Valley Bank. Other investors in the Series C round included SoftBank Capital and i-Hatch Ventures. New York-based Thumbplay sells mobile games, ringtones, wallpapers and other content directly to consumers through a website that supports all major wireless carriers. The company has partnerships with providers including Sony Pictures and Walt Disney Internet Group, and offers more than 50,000 pieces of mobile entertainment content. Thumbplay will use the funds to expand its marketing efforts and its mobile entertainment library.

Los Angeles - OGPlanet, a publisher of free online multiplayer games that generate revenue through the sale of virtual items, announced on Monday that it has received an undisclosed sum of venture funding from a group of gaming and digital media executives. New investors in the company include former Disney Online president Richard Wolpert; GameSpy founder Mark Surfas; former RealArcade vice president Andrew Wright; and BellRock Media CEO Peter Levin. Los Angeles-based OGPlanet's first title is the U.S. version of the online game "Albatross18," which is already generating more than $25 per month per player in sales of virtual game pieces, clothing and accessories. Palo Alto, Calif. - Video-sharing site Metacafe on Monday introduced a new program that pays video creators for bringing traffic to their programming. The Producer Rewards program will provide $5 for every 1,000 video clip views, in exchange for granting Metacafe the non-exclusive right to distribute the video on any platform. The company said that during a month-long trial, Producer Rewards videos were viewed more than 10 million times, earning thirty video creators a combined more than $60,000 for their work. Palo Alto, Calif.-based Metacafe claims nearly 17 million unique monthly visitors.

o Delphi Gets FCC Approval for XM SKYFi3 Satellite Radio

Troy, Mich. - Consumer electronics firm Delphi announced on Monday that its SKYFi3 portable satellite radio receiver has received approval for sale to the public from the Federal Communications Commission (FCC). The $229 XM Satellite Radio receiver can record up to 10 hours of XM programming, and store MP3 files on removable memory cards. The FCC raised concerns that certain radios from both XM and rival Sirius did not meet its emissions standards, causing both companies to briefly halt production by their manufacturers while they made design changes to bring them in line with FCC regulations.

The $99 Moviebeam player utilizes unused spectrum to transmit a rotating library of 100 movies to the TV set-top box, which viewers can then rent for $3.99 for new releases and $1.99 for library titles.
