o Report: U.S. Online Content Spending Up 15.7% to $987 Million

New York - U.S. consumers spent $987 million on online content in the first half of 2005, a 15.7% increase over the same period last year, according to a report conducted by comScore Networks on behalf of the Online Publishers Association (OPA). Growth in online music sales spurred the Entertainment/Lifestyles category up 44.8% to $264.8 million, overtaking Personals/Dating ($245.2 million) as the most popular online content sector in the first half of 2005; the Video Games category also saw a 22.5% increase. Overall, 19.4% of the U.S. online population of 171 million said they paid for online content in the first half of 2005, an increase of 15.6% over the 16.8 million who said they had in the first six months of 2004. "Consumers are turning to the Web for entertainment more and more, and as they do sales of content continue to rise," said Online Publishers Association president Michael Zimbalist. "We suspect this trend will continue as new products such as the Video iPod and other mobile devices play greater roles in digital content distribution."

o Sirius Q3 Loss Widens, Revenue Triples; 2005 Subscriber Projection Raised

New York - Sirius Satellite Radio, a provider of subscription radio programming, on Tuesday raised its full-year subscriber estimate, now expecting to count "over" 3 million subscribers by the end of 2005. The company added 359,000 subscribers in the third quarter, and now claims a total 2.2 million subscribers. Sirius reported a loss of $180.5 million for the quarter, larger than the $169.4 million loss recorded in the same period a year ago, and said revenue more than tripled for the quarter, to $66.8 million, from $19.1 million a year ago. Sirius CEO Mel Karmazin told analysts he expects the company will see a "blowout" fourth quarter in the lead-up to the debut of shock jock Howard Stern's new show on Sirius in January. Sirius rival XM Satellite Radio last week said it ended the quarter with 5 million subscribers, and still expects to end the year with more than 6 million subscribers.

o SonyBMG Using Virus Writer Technique to Improve CD Copy-Protection

San Francisco - Major record label SonyBMG has adopted a technique used by virus writers to hide their tracks, in an effort to ramp up its CD copy-protection technology, CNET News.com reported. The "rootkit," used by malware writers to cloak their code deep within an operating system -- making it more difficult for a user to delete -- is part of U.K.-based anti-piracy firm First4Internet's CD copy-protection technology, which
has been employed on SonyBMG CDs released over the past eight months. Although the technique has elicited some concern from computer security firms, First4Internet told News.com it has worked with several security firms to ensure the rootkit is not a risk for end users trying to play a CD on their computers. The use of a rootkit in CD copy-protection was first reported by programmer Mark Russinovich on his blog. "We're still trying to find a line between fair use and digital rights management, and it is going to take issues like this, with discussions between lawmakers and industry, to come up with what's fair and honest," Russinovich told News.com. "But I think this has gone too far." Russinovich discovered the rootkit was installed along with copy-protected tracks when he played a CD in his computer from Van Zant, a band featuring members of Lynyrd Skynyrd and 38 Special.

Movies released on UMD will include "The Dukes of Hazzard," "Batman Begins," "The Matrix" and "House of Wax." Citing DVD Release Report data, the Hollywood Reporter said Sony Pictures so far has offered 51 titles on UMD, compared with Disney's Buena Vista (30 titles), Fox (23), Universal (22) and Paramount (21); the only major studio still eschewing the format is DreamWorks.

o Lance Armstrong Foundation Wins Domains in Cybersquatting Dispute

Geneva - Champion cyclist Lance Armstrong's charitable foundation, which sells the ubiquitous yellow arm bracelets that raise money for cancer research, has won a cybersquatting case against several websites found to be using its name for commercial profit. The World Intellectual Property Organization's (WIPO) domain name arbitration center ordered the domain names livestrongbracelets.net, talk-livestrong.com and mylivestrong.com turned over to the Lance Armstrong Foundation (www.livestrong.org). The WIPO ruled that CSA Marketing and Chris Angeles registered the names in bad faith in late 2004.
