o WSJ: Cingular to Team With Yahoo, Napster, eMusic on Mobile Service

New York - Mobile network operator Cingular Wireless is set to announce partnerships with Napster, Yahoo, eMusic and XM Satellite Radio that will greatly expand its mobile music service offering, The Wall Street Journal reported on Wednesday. The new service would allow over-the-air song downloads to phones, as well as the transfer of existing CD collections in MP3 format to phones over a USB connection. The service will also support Microsoft's WMA format, which is used with both Napster's and Yahoo's subscription services. Citing sources familiar with the matter, The Journal said an announcement could come as early as tomorrow on the collaboration. Rival Sprint said on Wednesday that its own mobile music store has sold 8 million downloads in its first year.

o Music Publishers, Kazaa to Settle Copyright Infringement Case

Los Angeles - Music publishers suing the peer-to-peer file-sharing service Kazaa for copyright infringement announced that they have reached an anticipated settlement that includes a "substantial sum" that will be paid to compensate the publishers. The National Music Publishers Association (NMPA) said the settlement with Kazaa was reached after months of negotiations. Earlier this year, Kazaa settled similar litigation with the major record labels and movie studios, agreeing to add filtering technology to its service and pay $115 million in compensation. "The anticipated settlement represents an important victory for songwriters, music publishers and music fans alike," said NMPA president and CEO David Israelite. "It will be another key milestone in the ongoing transformation of the digital music marketplace to one that will allow legal services to thrive."

o Time Warner Head "Encouraged" by Early Results of AOL Strategy Shift

Dulles, Va. - The head of media giant Time Warner said on Wednesday that the company is "particularly encouraged" by the early progress made by AOL in switching to an advertising-supported model. Although 2.5 million subscribers left the service as paying customers during the third quarter, Chairman and CEO Dick Parsons called the early results -- including only a negligible drop in visitors to the company's sites -- promising. "These members are maintaining their level of usage after they switch," Parsons said in a conference call. "In addition, we are also signing up more new users than we initially expected." Despite losing $210 million in subscription revenue during the quarter, AOL made up much of the difference with a 46% increase in ad revenue. AOL announced in August that it would deemphasize its dial-up Internet business by providing email and most of its content to broadband users free of charge. The company now has 15.2 million subscribers, down from its peak of 26.7 million in 2002.

o eMusic to Lower Number of Monthly Downloads Allowed

Los Angeles - Digital music service eMusic, the nation's second most-popular behind iTunes, is changing its terms to lower the number of unprotected MP3 format songs that subscribers may download each month. While monthly prices will remain the same, starting Nov. 21 the company's $19.99 premium subscription option will allow just 75 song downloads per month, down from 90. An intermediate option will fall from 65 to 50 songs per month, while the $9.99 per month basic service will now permit 30 songs, down from 40 per month. The company defended its move, saying that it has added hundreds of new features and grown its catalog from 250,000 to 1.7 million tracks since the previous pricing was set in 2003. "We still offer the best value out of any download service, 25 cents a track," an eMusic spokesperson told The Register. "We're offering people more so we feel can we can charge more for it." To encourage loyal subscribers, eMusic has offset the lowering of monthly download caps by also lowering the cost of its annual subscription plans. Originally launched in 1995, New York-based eMusic was acquired by Dimensional Associates in 2003. When it relaunched in 2004, its new owners eliminated the service's popular "unlimited" downloads per month option.

o Production on Microsoft "Halo" Movie Halted

Los Angeles - Production on the film version of Microsoft's "Halo" Xbox video game has been officially postponed, according to a statement from Microsoft and Peter Jackson and Fran Walsh's Wingnut Films. Two financial backers of the movie -- Fox and Universal Pictures -- recently bowed out, with Microsoft saying at the time it would move forward on production while it sought new partners. "As was previously confirmed, we deeply regret that both Universal and Fox did not choose to move forward with financing the Halo film under the original terms of the agreement. At this time Peter Jackson and Fran Walsh, along with their partner, Microsoft, have mutually agreed to postpone making a feature film based on the Halo video game universe until we can fulfill the promise we made to millions of Halo fans throughout the world that we would settle for no less than bringing a first class film to the big screen," the parties said in a statement. Microsoft also dispelled a rumor that uncertainty with first-time director Neill Blomkamp was a factor in the financing and production process. "We are fully supportive of director Neill Blomkamp's vision of the film. Neill is a tremendously gifted filmmaker and his preliminary work on Halo is truly awe-inspiring," the company said.

o Atom's Mika Salmi Named President of MTV Global Digital Media

New York - Viacom's MTV Networks announced on Wednesday that Mika Salmi has been named president of Global Digital Media. In this newly created position, Salmi will work across MTV's portfolio of music, games, entertainment, networking and interactive brands, growing the network's appeal to young adult consumers through global acquisitions activity and community and gaming assets. Salmi was formerly CEO of Atom Entertainment, the company he founded and which was acquired by MTV in August of this year. Salmi will report directly to MTV chairman and CEO Judy McGrath, and will become a member of her senior strategy team. As a side note, Salmi will be keynoting at Digital Media Wire's LA Games Conference on November 8, 2006.

o Nintendo to Offer 32 New Titles, 30 Retro Games for Wii Launch

Redmond, Wash. - Nintendo of America announced that it will offer a total of 32 new games for the North American launch of its next-generation Wii video game console. In addition to the 32 new titles, which include "The Legend of Zelda: Twilight Princess," "Metal Slug Anthology" and "Call of Duty 3," the company will offer 30 retro titles -- like "Super Mario 64" and "Sonic the Hedgehog" -- from NES, Super NES and other platforms through its Virtual Console download service. Nintendo plans to ship 4 million Wii systems globally by the end of 2006, with the greatest share allotted to the Americas. The Wii goes on sale in North America for $249 on Nov. 19.

o Nvidia Sees $150 Million Charge, Restatements Related to Stock Options

Santa Clara, Calif. - Graphics chipmaker Nvidia announced on Wednesday that it expects to restate financial results for 2004 through 2006, along with selected statements for earlier years as well as the first quarter of 2007, to correct accounting errors resulting from its stock options granting practices. The stock-based compensation charges incurred will have the effect of decreasing reported net income or increasing reported loss from operations and decreasing the reported retained earnings figures for the periods. Santa Clara, Calif.-based Nvidia said the net impact from the charges will be less than $150 million. The company is among more than 100 that have either initiated internal investigations or are under federal investigation with regard to stock option grants, where the dates on which options were granted are changed to increase their value for employees.

o Blockbuster Adds In-Store Exchanges to Online DVD Rental Service

Dallas - Video rental giant Blockbuster announced on Wednesday that it has altered its online DVD mail order rental service so that subscribers can now either return movies through the mail or to participating Blockbuster stores. For each online rental exchanged in a store, customers will receive a free in-store movie rental. All of Blockbuster's 1.5 million online subscribers will automatically be upgraded to the new Blockbuster Total Access service. "Customers shouldn't have to choose between renting online versus in-store, and they should never have to be without a movie," said Blockbuster chairman and CEO John Antioco.

o Brazilian Broadcasters Launch HD Radio Alliance

Columbia, Md. - iBiquity Digital, the developer of HD Radio technology that lets radio stations transmit a digital signal alongside their traditional analog signals, announced on Wednesday that Brazilian broadcasters have formed an alliance to promote the adoption of HD Radio. There are currently 16 stations in Brazil broadcasting with the technology. The Brazilian Alliance for Digital Radio counts nearly 2,500 stations supporting its efforts, including the Brazilian Association of Radio and Television Broadcasters (ABERT) and the Association of Broadcasters of Sao Paulo (AESP). Earlier this month, Chile's Continental Lensa became the first licensed HD Radio broadcast equipment maker outside of North America. Maryland-based iBiquity said other countries deploying or testing HD Radio include Australia, Canada, France, Mexico, Philippines, Switzerland, Thailand and Ukraine.

o Nielsen Introduces National TV/Internet Fusion Database

New York - Nielsen Media Research and NetRatings on Wednesday announced the launch of a new database that merges ratings data from TV and Internet audiences. The National TV/Internet Fusion database utilizes Nielsen's People Meter, which monitors TV viewing of 30,000 respondents, with NetRatings' NetView, which electronically tracks Internet use of 29,000 panelists. Analysis of April 2006 TV/Internet data found that 40% of Americans are more TV-centric, 24% are more Internet-centric, and 15% are equally heavy users of TV and the Internet. Also, heavy Internet users were found to watch more TV than light Internet users. "At a time when the importance of the Internet as an advertising vehicle continues to grow and expand with new streaming offerings, it's particularly important to understand the interaction between these two media," said Paul Donato, chief research officer at Nielsen Media Research. The company plans this month to begin installing its Internet-monitoring software on computers in homes with its TV-monitoring People Meters, with plans to deploy the combination during the 2007-2008 television season.

o Recording Academy Debuts "What's the Download Music Survival Guide"

New York - The Recording Academy on Wednesday introduced its "What's the Download Music Survival Guide," part of a public education campaign that offers "constructive solutions to tackle illegal downloading." The guide was written from the viewpoint of young consumers, and "outlines relevant court cases and perceptions of the music industry that have led to illegal downloading," while providing suggestions on re-committing to artist development and educating consumers. The What's the Download Interactive Advisory Board that created the guide includes US Weekly entertainment editor Shirley Halperin, BigChampagne CEO Eric Garland, and R&B artist Chris Brown. Waltham, Mass. - Venture capital firm Charles River Ventures (CRV) announced on Wednesday that it has launched a seed funding program "designed to help entrepreneurs prototype and launch new ideas quickly." Called "CRV QuickStart," the program will make loans of up to $250,000 to very early stage businesses, allowing them to avoid equity dilution as they explore the potential for raising venture capital, CRV said. o U.S. Venture Capital Fundraising on Track to Surpass 2005 Levels

San Francisco - Venture capital fundraising in the U.S. looks to be on track to surpass the level of a year ago, according to new figured from Dow JonesVentureOne. During the third quarter, a total of $6.69 billion was raised in 21 funds -- a monetary increase of 17% from the same period in 2005, despite nine fewer funds. Through the first three quarters, $19.66 billion has been raised by venture capital firms, about $3 billion more than last year. VentureOne noted that more than a fifth of the funds raised so far this year are worth at least $500 million, up from just 8% last year. "Increasing globalization is pushing firms to raise ever larger sums to enable them to support new start-ups around the world," said Stephen Harmston, the director of global research for VentureOne. "As a result, smaller funds of less than $100 million in size are becoming increasingly rare." Baltimore-based New Enterprise Associates has raised the largest fund this year, at $2.5 billion.

Palo Alto, Calif. - Norwest Venture Partners, a venture capital firm based in Palo Alto, Calif., said on Wednesday that it has invested $10 million Sulekha.com, India's largest social networking site. It was the company's first institutional round of funding. The company runs various blogs, groups and networking services, as well as local commerce sites, in 25 cities worldwide, including eight in India. NVP currently manages more than $2.5 billion in venture capital.
