o "Broadcast Flag" Bills Floated
by House Judiciary Committee
Washington - A number of bills to revive the "broadcast
flag," or technology that would prevent consumers from making
unauthorized copies of digital TV and radio broadcasts or posting
them online, have been floated by the House Judiciary Committee in
advance of a hearing on the issue scheduled for Thursday, Reuters
reported. A federal appeals court in May struck down a broadcast
flag proposal that originated from the FCC, in part ruling that the
FCC was not invested with such authority. The proposed legislation
would give the FCC the authority to mandate the broadcast flag for
digital TV and radio broadcasts, and also prohibit the manufacture,
import or sale of devices that can convert protected digital
programs into the unprotected analog format. "The draft appears to
be in sync with industry consensus on both analog hole and broadcast
flag and we look forward to working through the legislative process
to get them enacted quickly," MPAA spokesperson Gayle Osterberg told
Reuters. Art Brodsky, a spokesman for Public Knowledge -- which
successfully argued against the broadcast flag in the federal
appellate case -- argued that, "[The proposed legislation] would
give the FCC and the Patent and Trademark Office wide-ranging power
and control over the development of technology while depriving
consumers of rights they have enjoyed for years. These are
unwarranted technological mandates."

Cable TV Firms Invest $200 Million in "Convergence" Joint Venture
New York - Wireless network operator Sprint Nextel
announced on Wednesday that it has partnered with cable TV providers
Comcast, Time Warner Cable, Cox and Advance/Newhouse Communications
on a joint venture that aims to offer bundled mobile, TV, broadband
and voice services to 75 million homes. Sprint will invest $100
million in the venture, while the cable firms will collectively
contribute another $100 million, to develop and market the converged
services. New features expected from the combined services include
remote programming of home digital video recorders via cell phones,
mobile viewing of streamed TV, music and DVR recordings, and mobile
access to cable broadband e-mail accounts. The companies will also
collaborate on the development of new devices for the services.
Beginning in 2006, the venture plans to sell and market their
co-branded products and services in Sprint's 1,600 retail stores,
Radio Shack stores, and cable retail outlets.

Offers HD DVD Technology to Chinese Manufacturers
Tokyo - Japanese consumer electronics firm Toshiba,
currently in a battle with Sony over next-generation DVD formats,
has taken the step of licensing its HD DVD format to Chinese DVD
player makers in an effort to beat Sony's Blu-ray DVD players to
market, The New York Times reported. The low-cost Chinese players
could have the effect of curbing the market for Toshiba's own HD DVD
player models, but would likely challenge Sony's Blu-ray in the race
to become the dominant next-generation DVD standard. Sony has
recently gained some momentum in the format war, as several
Hollywood movie studios that previously only backed HD DVD said they
would also release movies in its Blu-ray format. "Toshiba can't back
out of this format war for face-saving reasons," Richard Doherty,
research director at market research firm the Envisioneering Group,
told The Times. "But pushing ahead means dealing with the Chinese
sooner rather than later. They'll risk dealing with the Chinese if
it means getting the format out quicker."

Free Webcasts of "NBC Nightly News"
New York - NBC Universal has announced that NBC will
become the first network to offer a daily webcast of its flagship
news program, "NBC Nightly News." Beginning next Monday, the
half-hour program hosted by anchor Brian Williams will be offered
for free at MSNBC.com at 7 p.m. Pacific time, after it has been
broadcast on-air throughout the country. "This is the next logical
step for 'Nightly' and NBC News," said NBC News acting president
Steve Capus. "As the leader on the broadcast side, and with our
partnership in the leading online news and information site,
MSNBC.com, it couldn't be a better fit." "NBC Nightly News" anchor
Brian Williams added, "Many of our viewers tell me they often miss
the broadcast because they're not home in time or tending to their

Arts to Produce Games Based on Fox TV's "The Simpsons"
Redwood City, Calif. - Video game publisher Electronic
Arts announced on Wednesday that it has signed a long-term deal with
Twentieth Century Fox Television and Gracie Films, for the rights to
develop multiple video games based on the Fox TV series "The
Simpsons." Financial terms of the deal were not disclosed. Redwood
City, Calif.-based EA will work closely with writers on "The
Simpsons" to create games for next-generation video game consoles.
No launch dates for upcoming titles were provided. EA said that its
Redwood Shores studio will be responsible for its Simpsons games;
the studio also created EA's "From Russia With Love," "Tiger Woods
PGA Tour," "The Lord of the Rings," "The Godfather" and "The Sims"
titles.

Remove Virus Writer Tool From CD Copy-Protection
San Francisco - SonyBMG and First 4 Internet, a company
providing CD copy-protection technology to the major record label,
are now working with antivirus firms to eliminate the use of a virus
writer technique that hid their anti-piracy software deep within a
computer's operating system, CNET News.com reported on Wednesday.
After a blog posting on Monday revealed that a "rootkit" was being
installed when users put SonyBMG CDs in their PCs, several computer
security firms noted that virus writers could potentially use the
record label's anti-piracy tool to hide a virus on a user's
computer. The rootkit was used in First 4 Internet CD
copy-protection embedded on SonyBMG albums for artists including Van
Zant and My Morning Jacket. A patch that eliminates the rootkit will
be included in automatic security updates provided by antivirus
companies, and also through SonyBMG's website.

Fundraising Grows 16% in Third Quarter
San Francisco - U.S. venture-capital fund raising grew 16%
in the third quarter, compared with the previous year, according to
new statistics from Dow Jones's VentureOne. All told, venture
capital firms completed 27 funds worth $5.91 billion. Though the
number of funds was about the same as a year ago, their average size
grew considerably, continuing a recent trend. For instance, more
than 30% of the funds that have closed so far this year have been in
the $250-$499 million range, up from 20% of funds from last year.
Another 5% are between $500-$999 million -- the most funds of that
size completed since 2001. "Despite the larger funds, fund raising,
of course, has yet to match the levels raised during the 1998 to
2001 timeframe," said John Gabbert, the vice president of worldwide
research at VentureOne. "But we are seeing that the venture-capital
industry has reached a level of sustainability, with venture
investors closing funds at a close pace to the level they are
investing."

Three New Multimedia Mobile Phones
Espoo, Finland - Nokia on Wednesday introduced three new
multimedia-equipped cell phones, including the first handset to
offer a built-in DVB-H mobile TV receiver. The Nokia N92, with the
DVB-H receiver, will allow users to both watch and record live TV.
The latest Nokia XpressMusic phone, the Nokia N71, includes stereo
FM radio, and support for digital music and videos. The company also
introduced the first phone to feature UPnP technology, which allows
it to display photos taken with the phone on a TV, play audio tracks
stored on the phone on a connected audio system or PC, and
wirelessly print to a UPnP-enabled printer. The new phones are
expected to begin selling in the first half of 2006, priced roughly
between $480 and $720.

Waltham, Mass. - Peppercoin, a developer of online
micropayments technology, has raised an additional $2 million in its
second round of venture capital, led by Wall Street Technology

has announced that its subscribers with compatible handsets can now
subscribe to access video clips of "The Tonight Show with Jay Leno."
NBC Mobile will provide a total of four "Tonight Show" clips at all

radio programming, announced on Wednesday that Japanese carmaker
Nissan North America will offer XM as a factory-installed option for

Redwood City, Calif. - Electronic Arts announced on Wednesday
that its Club Pogo subscription-based online casual games service,
launched just over two years ago, now claims one million paying
subscribers. EA said that 75% of subscribers are women, with an
average age of 35-plus. The service is an outgrowth of EA's free
Pogo.com site, which claims 3.6 million daily visitors. The premium
Club Pogo service, which costs $4.99 per month or $29 per year, adds
larger cash prizes, private chat and other features in an ad-free
environment.

New York - 2K Games, a unit of game publisher Take-Two
Interactive, announced on Wednesday that it has signed an agreement
with Sony Pictures to develop games based on the forthcoming film
adaptation of author Dan Brown's "The Da Vinci Code," directed by
Ron Howard. New York-based 2K Games said The Collective will develop
versions of the game for current-generation consoles, to be released
alongside the film's debut in theaters in May 2006.

Helps Independent Bands With Promotions
San Francisco - The latest issue of WIRED magazine features an
article on the social networking service MySpace.com, and the
marketing potential for bands using the site, whose 3 million user
pages include some 400,000 created by bands. MySpace claimed more
page views than Google in August (9.4 billion), and says 3.5 million
new users are signing up each month. Many users add bands to their
list of "friends," so they can hear about new songs and tour dates.
The site has helped enable bands including Hawthorne Heights, Fall
Out Boy and My Chemical Romance to achieve record sales surpassing
500,000 without a record label contract.
