o Time Warner Sets Aside $500 Million for Possible AOL Settlement

Dulles, Va. -- The Washington Post reported on Wednesday that Time Warner has established a $500 million legal reserve, for the first time giving an indication of what the company expects to pay as part of the government's long-running probe of its Dulles-based America Online unit. AOL has been under investigation by both the Securities and Exchange Commission (SEC) and the Department of Justice regarding its accounting practices. "This amount represents the Company's current best estimate of the amounts that would be involved ultimately to resolve these investigations," AOL said in a statement.

o NBA Launches Wireless Sports Service With Nokia, THQ, Jamdat Mobile

New York -- The National Basketball Association (NBA) on Wednesday announced the launch of "NBA Unwired," a wireless sports service that will offer video highlights, games and other features through partnerships with Nokia and game developers THQ Wireless and Jamdat Mobile. Through its relationship with Nokia, the NBA will offer video highlights of every NBA game, in addition to scores and statistics on select Nokia handsets for $4.99 per month. THQ Wireless will release the first official NBA wireless fantasy basketball game, "NBA Fantasy Five," as well as a 5-on-5 NBA wireless simulation game, "NBA Basketball 2005," and a wireless game tracker application called "NBA Courtside Live Mobile." The company will also publish ringtones featuring NBA players including Chris Webber, Richard Jefferson and Jermaine O'Neal. NBA Unwired will also feature Jamdat Mobile's two-on-two wireless game, "Jamdat Sports NBA 2005."

o First Music Albums Released in Two-Sided CD, DVD "DualDisc" Format

Los Angeles -- The recording industry on Wednesday released the first albums in its new DualDisc format -- which consists of a two-sided disc containing CD content on one side and DVD content on the other. The CD side contains the full album, while the DVD side will provide the album in enhanced sound, such as DVD-Audio or Surround Sound, as well as special features like music videos, interviews, lyrics and Web links. Labels including EMI, Sony BMG, Warner, Universal and Silverline Records plan to distribute more than 50 DualDisc releases this fall and into next year, from artists including AC/DC, Blondie, Curtis Mayfield, David Bowie and Dokken.

o Gizmondo Maker Tiger Telematics Acquires U.K. Game Developer Warthog

London -- Tiger Telematics, maker of the Gizmondo multifunctional handheld gaming console, announced on Wednesday that it has acquired U.K.-based video game developer Warthog in a bid to expand its game development resources. Florida-based Tiger provided $1.1 million in cash and about 498,000 shares to acquire Warthog, which has developed games including "Harry Potter" for Electronic Arts. In addition to Warthog's portfolio of 12 game titles, which will be developed for the Gizmondo, Tiger also acquired the company's proprietary game engine porting tool, Tusk -- which it says will speed conversion of third-party games for the Gizmondo. The Gizmondo was released this week in the U.K. and is scheduled to ship in the U.S. in the first quarter of 2005.

o Multimedia Developer InterVideo Settles Patent Suit With PC Maker Acer

Fremont, Calif. -- InterVideo, a provider of software to consumer electronics and PC manufacturers, said on Tuesday that it has agreed to settle its patent infringement claims against computer maker Acer. As part of the deal, InterVideo will license its InstantON patents to Compal Electronics, the company that manufactures Acer's PCs. The two companies also will partner to develop multimedia applications and portable consumer electronic devices. In all, InterVideo has agreed to license 26 of its patents to Compal for use in manufacturing the Acer Aspire 2000 and Acer Aspire 2020 notebook computers. Other details of the settlement were not disclosed. InterVideo subsidiary InterVideo Digital Technology had filed patent infringement lawsuits in Texas and Taiwan against Acer for infringement of various patents relating to the technology.

o Apple iTunes Update Affects Previous Versions, Song-Swap Plug-In

Cupertino, Calif. -- The new version 4.7 of Apple's iTunes digital music management software, released last week, shuts out users of older versions of the software from the company's online music store, and also disables a plug-in called iPodDownload that let iPod owners copy songs from the device to their Mac iTunes music library, CNET News.com reported. Apple has several times before shut out various independently-developed file-sharing capabilities with new versions of iTunes. Apple told News.com that only 5% of iTunes users were running versions older than 4.5, 4.6 or 4.7, now the only supported versions for the iTunes Store, so asking them to upgrade "is no big deal."

o 3 U.K., EMI to Premiere New Robbie Williams Music Video on Cell Phones

London -- 3 UK, the video mobile operator controlled by Hong Kong-based Hutchison Whampoa, announced that it has signed an agreement with record label EMI Records in which Robbie William's "Misunderstood" video will be offered to 3G subscribers before it is aired on TV. According to the firm, the news marks the first time that a music video has ever been released to mobile phones before it has been shown anywhere else. 3 UK said customers would be able to stream or download the video to their mobile phones for about $2.77 until Jan. 31.

(Los Angeles) Napster announced on Wednesday that its Napster To Go service, which enables downloads from its digital music service to be transferred to portable devices, is now available for AT&T Wireless subscribers who own the new Audiovox SMT5600 Smartphone. The deal enables users to transfer and play an unlimited number of full-length songs on their phones for $14.95 per month. The device comes with 28.5MB of internal flash memory -- enough to hold about 6 songs -- with the ability to purchase up to 256MB of additional memory. AT&T Wireless is offering the Audiovox SMT5600 for $149 after rebates and a two-year contract.

(Oslo, Norway) Norwegian mobile entertainment publisher Mobile Media Company announced on Wednesday that it has acquired Cee.tv Format, a developer of interactive TV and mass marketing programs and delivery technologies. Financial terms of the deal were not disclosed. Mobile Media said the acquisition gives it a large portfolio of interactive content to offer its customers in 30 countries, who collectively count 500 million wireless subscribers.

(Calabasas Hills, Calif.) Game publisher THQ and partner Warner Bros. Interactive Entertainment on Wednesday announced the release of their "The Polar Express" title for PlayStation 2, GameCube, Game Boy Advance and the PC. The game is based on the Warner Bros. Pictures adaptation of the acclaimed children's book, which opens in theaters on Nov. 10. THQ said the PlayStation 2 version of the game includes mini-games enabled for the EyeToy USB camera accessory for PlayStation 2.

Video game publisher Atari on Wednesday shipped two new titles based on Hasbro subsidiary Wizards of the Coast's Duel Masters trading card game and animated TV series, which airs on Cartoon Network. Atari released "Duel Masters" for PlayStation 2, developed by High Voltage Software, as well as "Duel Masters: Kaijudo Showdown" for Game Boy Advance, developed by Mistic Software.

(Burbank, Calif.) Disney's Buena Vista Interactive video game publishing unit on Wednesday shipped the version of its "Tron 2.0: Killer App" title for Microsoft Xbox to retailers. The game is already available for PC and Game Boy Advance. The Xbox version, developed at U.K.-based Climax, features multiplayer online play enabled by the Xbox Live service.

(San Francisco) Wired News on Wednesday reported on the scattered instances where electronic voting machines caused delays or other problems for voters in yesterday's general election. The National Protection Coalition, a consortium of nonpartisan groups that includes the Electronic Frontier Foundation, received 600 calls yesterday from voters complaining about e-voting machines in states including Florida, Louisiana and Texas. The problems ranged from machines failing to start-up on time, to calibration problems where a voter would touch the screen next to one candidate and have an "X" appear in a box next to a different candidate's name. Sporadic problems were reported with e-voting machines from all major vendors, including Diebold Election Systems, Election Systems & Software, Hart InterCivic and Sequoia Voting Systems.

(Washington) The Washington Post on Wednesday provided a run-down of the traditional media's coverage of how online political bloggers figured in yesterday's general election, when many released leaked early exit poll data that went unreported by many TV outlets. Traffic to blogs including Drudge Report, National Review's Corner, Daily Kos, Wonkette.com, TalkingPointsMemo and InstaPundit.com skyrocketed on Tuesday, overloading the servers of some smaller blogs. Basing their statements on exit poll data, several blogs and news websites erroneously called the election yesterday early on for John Kerry, before many polling places had closed.
