Retailer MusicNow from Circuit City
Dulles, Va. - Looking to upgrade its digital music
offerings, America Online said on Thursday that it has acquired
online music subscription service MusicNow from electronics retailer
Circuit City. Financial terms of the deal were not disclosed. AOL
said that it plans to gradually migrate its current MusicNet@AOL
subscribers to the new service, which it is calling "AOL Music Now."
The service, which offers more than 1 million songs from the four
major record labels and several other independent labels, will allow
visitors to browse and purchase music, either a la carte for $0.99 a
song or through subscriptions ranging from $9.95-$14.95 a month.
Founded as "FullAudio" in 1999 and purchased by Circuit City in
2004, MusicNow will continue to be based in Chicago, operating as a
stand-alone unit of AOL Premium Services. AOL plans to retain the
company's 40 employees, including its president, Gary Cohen. The
acquisition is AOL's fourth this year.

Launches Online Library of Public Domain Works
Mountain View, Calif. - Google on Thursday announced the
availability of the first large collection of public domain books on
its Google Print program, which aims to digitize the world's printed
works and make them searchable in an online index. Works now
available from Google Print include those whose copyrights have
expired, such as U.S. Civil War history books, government documents,
and the writings of author Henry James -- which users may now search
and browse every page online. Google partnered with the New York
Public Library and university libraries at Harvard, Michigan, Oxford
and Stanford to provide public domain works for scanning. "Today we
welcome the world to our library," said University of Michigan
president Mary Sue Coleman. "As educators we are inspired by the
possibility of sharing these important works with people around the
globe. Google's digital library project has angered many authors and
publishers, however, who say the company should not be profiting
from their works used without permission. The Authors Guild and the
Association of American Publishers have separately filed suit
against the company for copyright infringement.

No iTunes Rival Service in the Works
Seoul, South Korea - In clarifying a statement made
earlier this week that it said was misunderstood, and reported
incorrectly by Reuters and others, Korean consumer electronics firm
Samsung said on Thursday that it does not plan to launch a digital
music service to compete with Apple's iTunes. The company did say it
will offer technical support to other music services, like Napster,
in return for marketing its own line of digital music players.
"We're not interested in the online music services market but we
plan to offer technical support to our partners to make their
services easier and fancier and that would increase our hardware
sales," said Choi Gee-sung, the president of Samsung's digital media
division. Samsung hopes to triple its MP3 player sales this year, to
5 million units.

Partners Invests $300 Million in Merger of BioWare, Pandemic Studios
Menlo Park, Calif. - Elevation Partners, a venture capital
firm whose principals include U2's Bono and former Electronic Arts
president John Riccitiello, announced on Thursday that it has
invested $300 million into the merger of two independent game
developers, BioWare and Pandemic Studios. The deal will create a new
holding company, BioWare/Pandemic Studios, which will be jointly
owned by the three companies and headed by Elevation Partners
managing director John Riccitiello. Based in Los Angeles and
Brisbane, Australia, Pandemic will continue to develop
action/adventure titles like "Full Spectrum Warrior," "Star Wars
Battlefront" and "Destroy All Humans," while Edmonton, Canada-based
BioWare will maintain focus on roleplaying titles such as "Baldur's
Gate" and "Neverwinter Nights." "Great video games don't roll off
the assembly line -- they are an art form, as lovingly crafted as a
film, musical score, or novel," said BioWare CEO Greg Zeschuk. "Fans
are the real winners in this deal, because we will now have the
resources and creative discretion to make the right decisions for
our products." Immediate plans for the funds are to utilize them in
the development of titles for next-generation game consoles.

Networking Site MySpace.com Launches Record Label
Santa Monica, Calif. - MySpace.com, the social networking
site with 35 million members recently acquired by News Corporation,
announced on Thursday the launch of its own record label, an imprint
of Universal Music Group's Interscope Records. Some 550,000 band
pages are among the user profiles on MySpace. where bands post songs
and tour dates, while users can add bands as "friends" and
communicate through blogs and message boards. Major label acts
including Madonna, Coldplay and Nine Inch Nails have also used
MySpace to promote new releases, often offering pre-release
streaming samples. The first release on MySpace Records will be a
compilation, "MySpace Records: Volume I," featuring tracks from
Weezer, Fall Out Boy, AFI and Dashboard Confessional. Also featured
on the compilation is Hollywood Undead, a Los Angeles-based band
whose album will be the first proper release on the label, scheduled
for the second quarter of 2006. "Radio has become less and less
important...MySpace, by getting so huge, can truly move the needle
in terms of musical tastes," MySpace CEO Chris DeWolfe told Reuters,
adding that he is currently talking to four additional bands about
signing to the label.

CSTV: College Sports TV for $325 Million
New York - Viacom's CBS announced on Thursday that it has
acquired CSTV Networks, a broadcaster and webcaster of college
athletics, for $325 million. CSTV: College Sports TV televises 30
men's and women's college sports, and hosts nearly 250 official
collegiate athletics sites. CBS said it intends to closely integrate
CSTV's operations with its own CBS Sports and CBS Digital Media
units, adding that the addition of CSTV.com users will give it the
Web's largest online sports audience, with 19 million unique users.
The company will continue to be run by founder and CEO Brian Bedol.
"Putting our existing resources and events together with these great
cable and online assets makes tremendous sense," said CBS chairman
and Viacom co-president Leslie Moonves. "In bringing our operations
under one roof, our presence in the college sports community grows
even stronger, and the programming possibilities on national cable,
regional sports networks and the Internet are very exciting indeed."

Service Adoption Rises; Cost Remains Factor
Chicago - A global survey of 4,000 mobile phone users who
subscribe to mobile data services found that over half now access
the Internet monthly, and one-third download music to their phones,
while mobile data costs are an obstacle to wider adoption, according
to a report from management consulting firm A.T. Kearney.
Thirty-three percent of users with multimedia phones said they
downloaded music monthly, up from 21% in 2004, while 16% said they
downloaded mobile games monthly. Seventeen percent of all users --
and 27% of those under 24 -- said they were interested in mobile TV.
The survey also found that one-third of multimedia phone owners now
use MMS to send pictures, photos and video clips monthly, a service
that is used regularly by nearly half of all 19 to 24 year-olds.
However, half of mobile users surveyed said they are not willing to
pay more than $5 per month for a mobile data service; currently,
U.S. mobile data services cost between $10 and $20 per month. "The
growing penetration of new multimedia phones is the catalyst for
mobile data adoption," said, A.T. Kearney vice president Mark Page.
"There is a clear relationship between the average revenue per user
and the age of the phone the customer uses. People who have recently
replaced their handsets are more likely to be heavier users of data
services."

Acquisition of GameWorks
Glendale, Calif. - Sega Entertainment U.S.A. Inc. (SEUI),
an American unit of the Japanese video game publisher, announced on
Thursday that it has completed its acquisition of the assets of
GameWorks, a location-based entertainment business. GameWorks
currently operates 14 restaurants with expansive video game arcades.
Founded in 1997, with backing from Steven Spielberg's DreamWorks
studio -- which withdrew support for the company in 2001 --
GameWorks would later file for Ch. 11 in 2004. Sega said it named
former Coca-Cola executive Ben Kitay to serve as president and COO
of SEUI, which will oversee GameWorks. The company plans to invest
in updating the games offered in GameWorks locations over the next
year.

San Francisco - CNET News.com reported on Thursday that
the newly re-launched iMesh, the first legal peer-to-peer
file-sharing service in the U.S. with substantial support from major
record labels, is allowing free downloads of some copyrighted works
it shouldn't be in its first days of operation. Tracks from Led
Zeppelin -- who have not licensed tracks to any digital services --
as well as Green Day, Franz Ferdinand, Black Eyed Peas and others
are slipping through the filtering software from Audible Magic meant
to screen out such tracks from iMesh users. "Given that we're in an
early beta phase technology, issues are to be expected. These are
isolated problems which we are diligently working on fixing," iMesh
executive chairman Bob Summer told News.com.

New York - Viacom's CBS network is offering commercial-free
episodes of its new drama, "Threshold," for free on the Internet.
Three episodes will be offered following their broadcast on
successive Friday nights, and remain available online for three
days. "We think that the traditional network run will always be the
primary broadcast, but this is an opportunity to recruit viewers
that may not have experienced the show yet or (provide a chance) for
those that missed an episode to get caught up," Chris Ender, a
senior vice president in the CBS Communications Group, told The

"Weighing Webcasters' Rights to Content"
Washington - The Washington Post reported on Thursday on a
dispute argument pitting broadcasters and webcasters, who are in
favor of international treaties giving them 50-year copyrights on
most any video they transmit, against digital rights advocates who
say such laws will erode rights to works in the public domain. The
treaties would give the broadcaster new rights to works they
transmit, even if the work happens to be uncopyrighted or if the
copyright has lapsed. "This new layer turns every distributor into
yet another owner," James Love, head of the Consumer Project on
Technology, told The Post. Broadcasters maintain that the new
regulations would still allow users to make private copies of these
broadcasts, but would not allow them to redistribute those copies
for commercial profit.
