o 3D Graphics Patent Suit Expanded
from Game Developers to 19 PC Makers Dallas, Texas -- A Texas law
firm that earlier this week sued 12 video game publishers for
allegedly infringing a 3D graphics patent has extended its
litigation to include 19 PC manufacturers, including HP, IBM, Dell,
Sony, Sharp and Toshiba. The Dallas-based law firm of McKool Smith
said that in addition to the 3D graphics display patent, it believes
the PC makers may be infringing on six other patents, all of which
were originally purchased by the firm itself from Oregon-based
Tektronix. The firm will likely seek to settle the lawsuits out of
court, forcing the defendants to consider paying a license fee
rather than pay for patent experts to investigate the firm's claims
and lawyers to defend them.

o Cendant Sues
Amazon.com Over Patented Recommendation Software
Wilmington, Del. -- Online retail giant Amazon.com has been sued
for patent infringement by a company that claims its service that
recommends goods and services to customers based on their previous
purchase history is infringing on patented technology. New
York-based Cendant, a large provider of travel and real estate
services, sued Seattle-based Amazon.com on Oct. 29, claiming
features such as the company's "Customers who bought this book also
bought…" feature and other recommendation technologies infringe on
its "370" patent. In its suit, Cendant is seeking a jury trial and
an injunction against Amazon's use of its patented technology.

o Report:
Wireless Homes' Appetite for Bandwidth to Surge
New York, N.Y. -- With the use of wireless broadband networks at
home rapidly increasing, JupiterResearch, a technology market
research and analysis firm, predicts that the average appetite for
bandwidth in homes with wireless networks will increase from less
than 3 Mbps this year to 57 Mbps in 2009. More "tech-savvy"
households with at least three residents will demand up to 84 Mbps,
according to the new forecast. Leading vendors in the field are
reporting a quick uptake in alternative uses of wireless networks,
such as streaming music from one's PC to the home stereo, Jupiter
reports. "The number of consumer electronics devices using a
wireless network in the home could explode over the next five years,
driving bandwidth requirements beyond today's offerings," said Julie
Ask, a research director at JupiterResearch.

o Wal-Mart
Lowers Price of Monthly Online DVD Rental Service to $17.36
Bentonville, Ark. -- Retail giant Wal-Mart this week announced
that it will cut the monthly subscription price for its online DVD
rental service to $17.36, making it once again the cheapest service
amongst rivals including Netflix and Blockbuster. Both rivals
recently reduced the monthly costs for their services, with Netflix
this week slashing its fee by $4 to $17.99, and Blockbuster lowering
its price to $17.49 per month. All three companies are also
preparing for potential competition from an online DVD rental
service from Amazon.com, which is rumored to be developing such an
offering.

o U.K. to
Help Russian Nuclear Scientists Become Game Developers
London -- The U.K. Department of Trade and Industry (DTI)
announced on Friday that it has signed a Memorandum of Understanding
with Russia to launch a multi-million-dollar program to help former
nuclear weapon scientists become video game designers. The
U.K.-Russia Closed Nuclear Cities Partnership program (CNCP) is part
of the U.K.'s contribution to a $20 million pledge by G8 countries
to counter the proliferation of nuclear material and promote nuclear
safety in the former Soviet Union. One of the projects that received
grant investment arranges for former Soviet software designers from
three Russian cities to participate in this year's European Games
Network Event. "With outsourcing of software programming gaining
popularity among U.K. companies in order to maintain their
competitive edge, the CNCP is working to promote Russian technical
capabilities and to develop some long-term commercial partnerships,"
the DTI said.

The Federal Trade Commission plans to hold a public workshop
entitled, "Peer-to-Peer File-Sharing Technology: Consumer Protection
and Competition Issues" on Dec. 15 and 16. The free workshop will be
open to the public, and will discuss the uses of file-sharing; its
role in the economy; identifying associated risks; and its impact on
copyright holders. The FTC is seeking public comments for the
workshop, including studies, surveys, research, and other empirical
data related to P2P file-sharing, which may be submitted
electronically on its website.

(Redmond, Wash.) Microsoft announced on Friday that next week it
will begin offering movie listings via MSN Direct, a wireless
network that transmits data to smart wristwatches using the
company's Smart Personal Objects Technology (SPOT). CinemaSource, a
unit of Hollywood Media Corp., will provide movie listings for the
service, which enables subscribers to track up to 10 theaters in
their local area and view movie listings and show times directly on
their watch.

(New York) A day after Emimen's record label pushed up the
release date for the rapper's upcoming album, citing "Internet
piracy and bootlegging," Sony's Columbia Records announced on Friday
that it will release its new Destiny's Child album one day early, on
Monday, Nov. 15. The label cited a "response to overwhelming
consumer demand for the album," adding that "advance word on
'Destiny Fulfilled' has created the potential for Internet leaks and
'burned' CD counterfeits to lead consumers to experience inferior
and incomplete versions of the album."

(Los Angeles) Mediaport Entertainment, a Utah-based developer of
a digital music distribution kiosk, announced on Friday that
independent record labels Sanctuary Records, Tommy Boy and EMPE3.com
have licensed songs for sale via its MusicATM. The devices allow
users to choose songs for a CD compilation that is then burned by
the kiosk, or else download tracks directly to an iPod or other
portable player and charge them on a credit card. Mediaport is
currently testing its kiosks on campuses and in bars, and also
announced that furniture retailer LoveSac will install the devices
in its locations. The company plans to launch a total of 1,200
MusicATM kiosks over the next year.

(Los Angeles) Jun Group, a provider of legal and licensed content
on peer-to-peer file-sharing services, announced on Friday that it
plans to launch what it calls the first TV show designed for
distribution on file-sharing networks. The ad-supported show, "The
Scene," will focus on an NYU student who is an avid file-swapper,
and will include interactive features including links to webcams,
secret chat rooms, instant messages and email. "Our sponsors will
only be paying for the people who download the show, or the people
we drive to their website," said Jun Group president Mitchell
Reichgut.

(Los Angeles) DigitalContainers, developer of a multimedia secure
file format that encompasses music, video, documents, software,
games and other data, announced on Friday that it has signed an
agreement with MP3 audiobook provider Paperback Digital. Under the
terms, Virginia-based DigitalContainers will distribute the
company's original "Frankenstein" radio broadcasts from the 1930s
for sale on peer-to-peer file-sharing networks. The audio files will
come with embedded information on the series and a catalog offering
Frankenstein-related collector's memorabilia for sale.

(Los Angeles) Javien, a provider of digital payment services,
announced on Friday the re-launch of its micropayment aggregation
engine, which allows digital content merchants to choose how they
want to bundle small charges before processing them onto a credit
card. Arlington, Va.-based Javien said that, rather than processing
individual $0.99 sales transactions, its system allows merchants to
set a threshold of $5 or $10, or create a time-based rule before
their customers' credit cards are charged for small online
purchases. The company's customers include MusicNet and TransWorld
Entertainment.

(Atlanta) Silver Screen Studios announced on Friday that it has
launched a mobile distribution channel for its film "Murder by
Deception." Owners of the HP I-Paq 6315 or a similar Pocket PC
device using Microsoft's mobile video technology will be able to
download the film to the handheld device from a link on the
company's website.

(Los Angeles) A number of news outlets on Friday provided
additional coverage on errors made by electronic voting systems used
during Tuesday's general election. The Associated Press reports that
President Bush received an extra 3,893 votes in a suburban Columbus,
Ohio, due to a malfunction that has still not been explained by
officials. Problems with machines in South Florida may yet force a
recount on a constitutional amendment ballot issue on slot machines.
In one North Carolina county, over 4,500 votes were lost when
officials mistakenly believed their machines could store more votes
that they could, after being told as much by manufacturer UniLect.
Finally, in San Francisco, a flaw caused miscalculations that led to
skewed results with a new ranked-choice voting system where voters
were asked to choose their top three candidates for municipal
offices.
