o Washington Post: AOL to Split Into Four Divisions

Dulles, Va. -- In a sweeping move, America Online plans to split into four divisions, with each gaining specific responsibility for its financial and operating performance, The Washington Post reported on Tuesday. The moves, directed by CEO Jonathan Miller, are expected to help the Internet provider make quicker decisions and improve its financial performance. "We are going to try to be much crisper in decision-making," Miller told the Post. One of the divisions, headed by vice chairman Ted Leonsis, will be called "Audience," and focus on selling ads on AOL's various web sites and services. As part of the changing strategy, three top executives -- Lisa Hook, who headed the company's broadband initiative, Joseph Ripp, its vice chairman, and Michael Kelly, its CFO -- will be leaving the company. The news emerged just days after reports that the company plans to cut more than 700 jobs next month.

o Copyright Industry, Artists, States Ask Supreme Court to Hear File-Sharing Case

Washington -- A coalition consisting of copyright holders, musicians and 40 state attorneys general filed "friend of the court" briefs with the Supreme Court on Monday, petitioning the justices to hear an appeal of a federal appeals court ruling that said providers of Internet file-sharing software are not liable for any copyright infringement committed by individual users. On the opposite side, peer-to-peer firms StreamCast Networks and Grokster also filed a friend of the court brief, arguing that lower courts correctly applied the "Betamax" ruling, which said VCRs are legal because of substantial non-infringing uses. They also said Supreme Court should not weigh in on the matter because it is also currently being taken up in Congress. A decision on whether the Supreme Court will hear the case is not expected for several months.

o EU to Continue with Microsoft Antitrust Case Despite Settlements

Brussels -- Despite the fact Microsoft has reached settlements with two of its fiercest rivals, the European Commission said it would pursue its antitrust case against the U.S.-based software giant. On Monday, Microsoft announced that it had reached a deal with the Computer & Communications Industry Association (CCIA), and that it had agreed to pay $536 million to settle an antitrust lawsuit over Novell's Netware software. Even so, European Commission spokeswoman Amelia Torres said the settlements did not change "any elements of Microsoft's conduct in the market" and that EU antitrust enforcement did not "hinge upon complaints by individual parties." Acting EU Competition Commissioner Mario Monti, who has spearheaded the EU case against Microsoft, is set to step down at the end of this month; so far, his replacement, Neelie Kroes, has said little about what line she plans take on the Microsoft antitrust case.

o Report: Average CD Price Drops 4% in Q3 2004 to $12.95

Port Washington, N.Y. -- CD prices hit a new low in the third quarter of 2004, when the average retail price of a CD fell to $12.95, a 4% decline from the same period a year ago, according to data from New York-based market research firm NPD Group. The average price of a "catalog" CD (18 months old or more) fell to $12.84, whereas current CDs sold for an average of $13.08. "A few leading mass merchandisers have been flirting with the $13 mark since late 2003 for catalog titles," said NPD president Russ Crupnick, "but it now appears that all of the major mass retailers have begun to adopt lower pricing for these CDs. By contrast, electronics retailers are offering lower prices on current CDs. Current product accounts for approximately 60 percent of music sales at both mass merchandisers and electronics specialty retailers." NPD Group predicts that overall prices will decline even further during the holiday shopping season.

Los Angeles -- Reuters reports that The Walt Disney Company is set to increase its investment in the video games industry by up to $40 million this year, including development of titles for handheld devices and acquisitions of small publishers and developers. Disney consumer products chairman Andy Mooney made the assertion yesterday at an investment conference. He added that Disney would more aggressively tie-in games to its movie releases, including for its upcoming adaptation of C.S. Lewis' "The Chronicles of Narnia."

o Broadcasters Lift Objection to XM Satellite Local Weather, Traffic Services

Washington -- XM Satellite Radio on Tuesday said the National Association of Broadcasters (NAB) has withdrawn its petition to the Federal Communications Commission (FCC), which sought to prohibit XM from providing local traffic and weather reports on its nationwide satellite radio service. The NAB had argued that the services violated XM's FCC license to offer a national service, by offering localized content that would compete with its local radio broadcasters for ad dollars. XM, the Consumer Electronics Association, U.S. Dept. of Transportation and others countered that prohibiting such services would deny public safety services and was unconstitutional. "Why would the NAB suddenly withdraw a petition that it so confidently believed would win approval? Because all indications were that the Commission was poised to rule against the NAB, so it decided to withdraw in a last-minute attempt to save face. As a result, this waste of Commission resources is now at an end," XM said in a statement.

o Report: Music Videos Most-Viewed Streaming Media in 2004

Monterey, Calif. -- Music videos account for the largest share of the overall streaming video market, representing 33.6% of the 5.6 billion streams served in the first half of 2004, according to a report from AccuStream iMedia Research. The next most popular content category was news and information, with sites like CNN.com, CBSNews.com and Weather.com drawing 18.2% of the market, followed by sports with 15.6% share. Categories drawing smaller audiences included movies, general entertainment and Internet TV. "While music, news and sports are the most popular categories today, publishers are offering more types of content online. That coupled with more broadband users and distribution partnerships is going to alter viewing share patterns in the future," said AccuStream research director Paul A. Palumbo.

o Webcast Metrics Launches Third-Party Internet Radio Audience Ratings

Denver, Colo. -- Ando Media, a provider of third-party Internet radio audience ratings, on Tuesday announced the launch of its Webcast Metrics service and first set of data from subscribing webcasters for the month of October. The company developed the Web radio ratings service following the closure of radio ratings firm Arbitron's Measurecast surveys last spring, but for now its subscriber-only ratings do not include larger webcasters like Yahoo Launch, Radio@AOL, MSN Radio, Musicmatch or Live365. Denver, Colo.-based Ando said its Webcast Metrics cull real data from stations' servers that is then converted to the standard broadcast metrics -- such as average quarter hour, cume and total listener hours -- widely used by terrestrial radio stations and their advertisers. The first Webcast Metrics data found that DI.fm was the top station in October, with a 15,506 average quarter hour (AQH) for the time period of 6 a.m. to midnight, followed by AccuRadio.com, RadioIO.com and EnergyRadio.com.

o TV Content-Shifting Device Maker Sling Media Raises $10.5 Million

San Mateo, Calif. -- Consumer electronics maker Sling Media announced on Tuesday that it has raised $10.5 million in its first round of venture capital financing from Doll Capital Management, Mobius Venture Capital and undisclosed strategic investors. The company's first product, the Slingbox Personal Broadcaster, will allow users to view TV and movie content from their cable box, satellite receiver or digital video recorder at home from anywhere via a laptop or other Internet-connected device. San Mateo, Calif.-based Sling Media was founded in 2004, and plans to introduce its Slingbox Personal Broadcaster during the first quarter of 2005.

o Broadcast Video Watermarking Firm Medialink Raises $5 Million

New York -- Medialink Worldwide, a provider of digital video watermarking technology for broadcasters through its Teletrax unit, announced on Tuesday that it has raised $5 million through the private placement of securities with unnamed institutional investors. Teletrax, used by ABC, NBC News, Reuters Television and others, embeds video watermarks into programming that can then be monitored to generate broadcast tracking reports. The service was launched two years ago using patented technology from Philips and Digimarc. In addition to supporting the development of Teletrax, the net proceeds will be used for working capital and to reduce bank borrowings.

Satellite TV provider EchoStar Communications, operator of the DISH Network, said on Tuesday that it added 350,000 net new subscribers during the third quarter of 2004, ending the period with a total of 10.5 million subscribers. The company, which said its quarterly profit rose to $102 million from $35 million last year, also declared a one-time stock dividend of $1 per share -- a total of about $455 million to be paid to shareholders on Dec. 14.

(Redmond, Wash.) Microsoft announced on Tuesday that it has partnered with American Express to offer free music downloads from MSN Music to U.S. cardholders. Under the deal, AMEX cardholders who use their cards on MSN Music will receive one free download for every ten purchased; new applicants for the AMEX Blue card will also receive ten free downloads from the service. (Los Angeles) Game developer Electronic Arts on Tuesday announced that it will lower the prices for some of its popular sports titles for the holiday shopping season. "Madden NFL 2005" and "NHL 2005" will now cost $29, down from $49, while "NBA Live" and "NCAA Football 2005" will both be discounted by $10, to $29 and $39, respectively. The move is seen countering Take-Two Interactive and Sega's pricing of their ESPN sports games at $19.
