Dulles, Va. - There is now one less bidder for a stake in
America Online, following Yahoo's decision to exit the discussions,
the Wall Street Journal and Associated Press reported on Thursday.
That leaves Microsoft and Google as the top candidates to purchase a
piece of Time Warner's Internet unit, which has been viewed as a hot
property of late, due in part to an upswing in online advertising.
People close to the situation told the AP that Yahoo's main
stumbling block was Time Warner's insistence to remain AOL's
majority stakeholder. One of the scenarios reportedly being
discussed called for Yahoo to pay $13 billion in stock for an 80%
share of AOL's content business. Top executives from Yahoo,
including CEO Terry Semel, reportedly met with Time Warner
executives in late October.

Halts Michigan Video Game Law, Pans Violence-Link Research
Detroit - A federal judge has temporarily halted enactment
of a recently passed law in Michigan that prohibits the sale or
rental of violent video games to minors, while a lawsuit filed by
the video game industry to overturn the law is heard in court. In
his ruling, U.S. District Judge George Steeh said Michigan Gov.
Jennifer Granholm and the state are unlikely to win the lawsuit,
filed by the Entertainment Software Association, adding that the
"loss of First Amendment freedoms, for even minimal periods of time,
unquestionably constitutes irreparable injury." The judge also
stated that the research presented by the state, which purports to
link violent games and aggressive behavior -- the same research
relied upon in crafting similar laws in California and Illinois --
was unpersuasive and insufficient. Courts have routinely overturned
similar video game sales restrictions on First Amendment grounds in
Washington state, St. Louis County and the city of Indianapolis. "We
are gratified that Judge Steeh has issued this preliminary
injunction and in so doing has suggested that the arguments and
research relied on by Governor Granholm and the Legislature are weak
and unpersuasive," said ESA president Doug Lowenstein. The ESA has
also filed suit to overturn the video game sales restrictions
recently enacted in California and Illinois.

Faces Class Action Lawsuit Over CD Copy-Protection
Los Angeles - California consumers have filed a
class-action lawsuit against major record label SonyBMG, claiming
their computers have been harmed by the company's recently-uncovered
use of a controversial CD copy-protection technology, Reuters
reported. The label and its anti-piracy software partner, First 4
Internet, used a hacker method called a "rootkit" to hide their CD
copy-protection software deep within a computer's operating system.
Antivirus firms have stated that trying to remove the software could
impair a PC's ability to play CDs. The lawsuit, filed on Nov. 1,
seeks damages, and also asks that SonyBMG stop selling the 20 or so
music albums containing the technology. Consumers argue that Sony
made no disclosure of what its anti-piracy tool was doing, and that
the software also depletes a computer's available resources. A vice
president with Computer Associates told CNET News.com that the
software also reports back to Sony BMG on which CDs users listen to
on their PCs, and potentially can impair ripping any CD, not just
the copy-protected SonyBMG releases.

Acquires Publisher of The Advocate, OUT Magazines for $31 Million
San Francisco - PlanetOut, a media and entertainment
company focused on the gay community, announced on Thursday that it
has acquired the assets of LPI Media -- publisher of gay magazines
OUT and The Advocate -- for $31.1 million. San Francisco-based
PlanetOut's media properties include Gay.com, PlanetOut.com and
Kleptomaniac.com. LPI Media, whose magazines have a combined
circulation of 8 million, expects 2005 revenues of approximately $29
million. PlanetOut said that, for the first nine months of 2005, the
combined company would have derived 41% of revenue from advertising,
45% from subscriptions and 14% from transaction services, adding
that the acquisition will likely nearly double its estimated 2005
annual revenue. "This transaction will further advance our strategy
of building a far-reaching media and entertainment company which
aggregates the largest gay and lesbian media brands," said PlanetOut
chairman and CEO Lowell Selvin. "This combination provides a larger,
more diverse foundation for additional growth, particularly in our
advertising business, as it becomes a larger percentage of our
overall revenue, and it enables us to better reach the markets we
serve, driving higher growth in a more cost-effective manner."

Launches Digital-Only Label Imprint, Cordless Records
New York - Major record label Warner Music Group announced
on Thursday the launch of Cordless Recordings, a new digital-only
label imprint headed by Jac Holzman, the founder and former CEO of
Elektra and Nonesuch Records. In an unorthodox move for a major
label venture, Cordless will allow bands to retain rights to their
master recordings, which will be distributed in "clusters" of three
or more songs on digital services, rather than as full albums.
Cordless will initially sell clusters from signed artists Jihad
Jerry & The Evildoers, Breakup Breakdown, Dangerous Muse, Nozzle,
Koishii & Hush and Humanwine, on iTunes, Rhapsody, Napster and new,
legal peer-to-peer services like iMesh and the forthcoming Mashboxx.
"When we started to think about Cordless, certain lessons from the
past kept returning to me," said Holzman. "The close, creative
relationship with artists and their fan base by frequent release of
records, keeping costs low and having a methodology that would let
us use our medium to introduce our material to more fans. Cordless

Support for Sony Blu-ray Next-Generation DVD Format
Los Angeles - Film studio Metro-Goldwyn-Mayer (MGM)
announced on Thursday that it will release films on Sony's Blu-ray
next-generation DVD format. The announcement gives Sony a solid
advantage over rival Toshiba's HD DVD format in terms of studio
support; recently, both Warner Bros. and Paramount said they would
release movies on both Blu-ray and HD DVD -- after previously
announcing support for only HD DVD. So far, no studio that first
pledged support for Blu-ray has said it will also support Toshiba's
format. MGM was recently acquired by an investor group that includes
Sony.

Partner to Deploy 15,000 Digital Cinema Systems
Burbank, Calif. - French video equipment maker Thomson
announced on Thursday that it has signed agreements with a number of
Hollywood movie studios aimed at accelerating the deployment of
digital cinema projection systems in North American movie theaters.
Under the terms, DreamWorks, Sony Pictures, Universal Pictures and
Warner Bros. will each pay a "virtual print fee" to distribute their
films digitally through Thomson's Technicolor Digital Cinema systems
in movie theaters. Thomson said the studios will support the
roll-out of digital cinema systems for up to 5,000 movie theater
screens over the next 3-4 years; the company plans to deploy at
least 15,000 digital systems in the U.S. and Canada over the next
ten years, at an estimated cost of $90,000 - $100,000 per screen.
Thomson plans to begin deployment of digital cinema systems under
the agreement in the first quarter of 2006.

Tycoon" Developer Sues Atari Over Unpaid Royalties
New York - Video game publisher Atari has been sued by the
developer of the "RollerCoaster Tycoon" video game franchise, who
claims he is owed $5.2 million in unpaid royalties. Scottish
developer Chris Sawyer is asking that Atari be compelled to open its
books for an audit, as was promised in his contract, to examine
whether he was underpaid for his work. Atari asked the U.K.'s High
Court for a venue change to New York, where its U.S. headquarters
are based, but a judge ruled the case will be heard in London. "If
Chris proves his claim that Atari Interactive has failed to account
properly and substantially underpaid, it could have major
ramifications for the industry as well as the company," said Guy
Herbert, an attorney with Marjacq Micro who is representing Sawyer.
"Publishers need to invest at the sunk cost stage. If developers
cannot be sure of getting fair royalties, they have to get as much
as they can at the sunk cost stage, and they become the grasping
contractors that publishers often believe them to be."

IM Usage Up 19%; 38% Send More IM Than E-Mail
Dulles, Va. - Instant messaging is up 19% this year compared
with last, with many Americans now sending more IMs than emails,
according to a new survey by America Online. All told, 38% of those
surveyed said that they send as many or more IMs than e-mails, and
the younger users are, the more likely they are to favor IM. The
company said that a quarter of users want to see entertainment
content within IM and 20% want to make voice calls to landlines and
cell phones directly from their IM service. The top markets for
instant messaging include Miami, New York, Boston, Chicago and
Atlanta.

Chipmaker PortalPlayer Withdraws Plans for Stock Offering
San Jose, Calif. - PortalPlayer, a maker of system-on-chips,
firmware and software for manufacturers of hard disk drive and flash
memory-based personal media players, on Thursday withdrew plans for
a follow-on public offering. The company said that its current stock
price "does not reflect the company's market opportunity and future
growth prospects for the business." In late October, PortalPlayer
said that it would offer 4.5 million shares. The company provides

Launches Free Version of Music Discovery Service
Oakland, Calif. - Pandora Media, a provider of an online
music recommendation engine, announced on Thursday that it has
launched a free, ad-supported version of its music discovery
service. The company's subscription-based version of the service,
launched in August, is based on data accrued from the Music Genome
Project, in which musician analysts looked at 400 musical attributes
in describing songs and their relation to others. Oakland,
Calif.-based Pandora's service allows users to choose songs and
create online radio stations that automatically populate with songs
that share key musical traits.

London - I-play, the U.K.-based mobile game developer formerly
known as Digital Bridges, announced that CEO Brian Greasley has

Agoura Hills, Calif. - Video game publisher THQ announced on
Thursday that it has signed a multi-year licensing agreement with
Conan Properties International, for the rights to develop games
based on its Conan fantasy character. Conan was created in the
1930's by Robert E. Howard, and has since sold some 12 million books
worldwide and spawned films including "Conan the Barbarian." Los
Angeles-based Paradox Entertainment will develop Conan games for THQ,
whose agreement encompasses current and next-generation consoles,
PC, wireless and handheld platforms.
