o Employees Look to Sue Game
Developer Electronic Arts for Overtime Pay Redwood City, Calif. --
A San Francisco law firm is seeking to launch a class action lawsuit
against video game developer Electronic Arts, alleging the company
has failed to pay game developers and other artists overtime pay for
their work. The law firm of Schubert & Reed is seeking certification
of a "class" status for the animators, modelers, texture artists,
lighters, background effects and environmental artists who are
currently not entitled to overtime pay from EA. The company
maintains that it pays its workers fairly under California laws. EA
is not alone in this practice, as most video game publishers require
long hours as final development is completed for a game's release.
The lawsuit was launched in the same week that an anonymous
LiveJournal blog posting, purportedly from the spouse of an EA
employee, was published and widely circulated. The post details the
perpetual "crunch time" work environment at the company, including
some mandatory 85-hour workweeks.

Discontinue Broadband in Nine States
Dulles, Va. -- Customers of America Online's broadband Internet
service in nine Southern states will have to find a new provider
after the company said that it will discontinue the service in that
part of the country early next year, the Associated Press reported.
AOL is alerting customers by e-mail that they must find a new
provider by Jan. 17 or automatically be switched to AOL's standard
dial-up service. The states affected include Alabama, Florida,
Georgia, Kentucky, Louisiana, Mississippi, North Carolina, South
Carolina and Tennessee. An AOL spokeswoman told the AP that she
expects the company to phase out the service in the rest of the
country over the next year. AOL has about 23 million subscribers,
but the vast majority use the company's dial-up service.

Proposes $700 Million Buyout of Rival Hollywood Video
Dallas -- Home video rental giant Blockbuster has announced a
$700 million bid for rival rental company Hollywood Entertainment
Corp., which operates 1,920 Hollywood Video and 600 Game Crazy
stores. Dallas-based Blockbuster offered $11.50 per share, a 17%
markup from where Oregon-based Hollywood Entertainment's shares
closed on Wednesday. A similar merger proposal was thwarted in 1999
by the Federal Trade Commission over antitrust concerns, but may
pass scrutiny now that Blockbuster has branched out into movie
sales, as well as video game rentals and sales. Both companies face
increasing competition from both cheap DVD retail prices and online
DVD rental services from Netflix, Wal-Mart and, potentially,
Amazon.com.

Holiday Spending Expected to Reach Record $15 Billion
San Bruno, Calif. -- This holiday season is expected to be a boon
for online retailers, according to a new forecast from comScore, a
provider of Internet audience measurement services. The firm said
that spending on non-travel goods at U.S. web sites should exceed
$15 billion during the November through December holiday season. If
the numbers hold true, that would represent growth of 23%-26% over a
year ago. comScore also predicts total quarterly non-travel spending
to cross the $20 billion threshold for the first time ever in the
quarter. "We believe consumers' growing familiarity and confidence
with online shopping, coupled with a dramatic increase in broadband
penetration and continuing efforts by retailers to simplify the
shopping process across channels, will translate to substantial
gains for online merchants again this year," said Dan Hess, a senior
vice president at comScore Networks.

Approves Disney-Columbia Video-on-Demand Joint Venture
Brussels -- The European Commission on Thursday approved the
proposed joint venture between The Walt Disney Company, U.K.-based
ON Demand Group and U.S.-based film studios Columbia Pictures to
provide video-on-demand services in the U.K. and Ireland. The
Commission said the joint venture -- called MovieCo -- would
increase competition for BSkyB "to the benefit of cable customers"
in both countries. In a statement, the Commission said it had
examined the transaction's impact on the competitive structure of
the market and concluded that the joint venture would give cable
network operators "an alternative to procure video content other
than BSkyB", currently the dominant player. ON Demand manages
transactional TV services, including the launch and operation of
pay-per-view and video-on-demand services.

Releases Beta Version of New MSN Search Service
Redmond, Wash. -- Microsoft this week launched a beta version of
a new search engine service, in its quest to enter the lucrative
market currently dominated by Google and Yahoo. The new MSN Search,
which still uses search results powered by Yahoo, offers an index of
5 billion Web pages and new features including the ability to refine
search results by date and geographical locations, and integrated
news, image and music results. Microsoft is also developing
technology that will allow users to search both within their own
computers and the public Internet, but previously said it would
offer a search engine powered solely by its own results by the end
of the year. Rival Google beat Microsoft to the punch last month
with the release of a beta version of its own desktop search
service, and also this week announced that it has expanded its
search index to over 8 billion Web pages.

Objections to Microsoft-Time Warner Joint Venture
Brussels -- According to news reports, the European Commission this
week officially notified Microsoft Corp. and Time Warner Inc. of its
objections to the U.S.-based companies' proposed bid to jointly
acquire ContentGuard, a specialist in digital media distribution.
Although the list of objections has not been released, European
regulators are reportedly concerned the deal would give Microsoft a
dominant position in the Digital Rights Management (DRM) market. The
Commission has also expressed concern that the joint venture would
stifle the development of open interoperability standards in Europe.
All that said, some industry experts are predicting the Commission
will approve the deal if Microsoft and Time Warner agree to grant
third parties access to their technology through licensing.
Microsoft and Time Warner now have two weeks to respond to the
Commission's statement and until Jan. 6, 2005, to present any
settlement terms.

"Halo 2" Xbox Game Sees $125 Million in First Day Sales
Redmond, Wash. -- Microsoft announced this week that its anticipated
"Halo 2" game for the Xbox sold 2.38 million units in its first 24
hours of release, generating a record $125 million for the company.
A Microsoft vice president had predicted earlier in the week that
the game would take in $100 million in its first day, but the $125
million take eclipsed even the opening weekend box office for the
first "Spider-Man" movie, which made $114 million over three days.

"City of Heroes" Game Publishers Over Superhero Trademarks
Los Angeles -- Comic book publisher Marvel Enterprises has sued
the two video game firms behind "City of Heroes," an online
superhero roleplaying game that the company says contains virtual
characters that are too similar to its popular trademarked
characters like Incredible Hulk and Wolverine, the Associated Press
reported. Marvel sued San Jose, Calif.-based Cryptic Studios and
Korea-based NCSoft, which created the game and operate its online
servers that allow players to design their own superheroes that
inhabit the online game. It is the individual players' choices that
result in characters similar to Marvel's. The comic book publisher
is seeking unspecified damages as well as an injunction to stop
"City of Heroes" from using its intellectual property.

$1.3 million, a 16% increase from the same period last year, while

counted 80,900 Premium paying subscribers at the end of the quarter,
compared with 72,500 last year. Current figures place its Premium

(San Francisco) Microsoft has locked out owners of Xbox video
game consoles that have been modified or hacked from its Xbox Live
online gaming service, CNET News.com reported. Many modded Xbox
owners have said they were banned from the service after attempting
to log on to play the recently released "Halo 2" game online.
Microsoft's interest in banning such modified devices is that they
both enable the console to play pirated games in some instances, and
can give players who own them an unfair advantage against others on
Xbox Live.
