o Congress May Vote on Combined Anti-Piracy Copyright Bills

Washington -- Lobbyists for the entertainment industry are asking Congress to approve a controversial bill that combines several anti-piracy and Internet copyright bills into one during a lame-duck session this week. The Senate may vote this week on the Intellectual Property Protection Act (HR 2391), which combines the Piracy Deterrence and Education Act and PIRATE Act. The bill would, among other things, for the first time allow the Justice Dept. to seek civil damages against file-swappers, as well as five-year prison terms for those offering 1,000 or more unauthorized songs for download. The bill would also provide three-year jail terms for those who bring camcorders into movie theaters and pirate a film to distribute it online. "It's not like these bills came out of nowhere. All of these bills had been passed by one house or another," David Green, the Motion Picture Association's vice president for technology and new media, told The Washington Post. Opponents of the bill include the Consumer Electronics Association, Verizon, the American Conservative Union and advocacy group Public Knowledge, which has called on the Senate to postpone consideration until next year, to provide time for additional pubic debate. "It's just plain wrong to make the Department of Justice Hollywood's law firm," American Conservative Union deputy director Stacie Rumenap told The Post.

o Hollywood Studios Sue Movie File-Swappers, Launch Anti-Piracy Campaign

Washington -- The Motion Picture Association of America (MPAA) announced on Tuesday that it has filed its first wave of copyright infringement lawsuits against alleged Internet movie file-swappers. The suits were filed against an undisclosed number of defendants, who could be liable for up to $30,000 for each movie traded, and up to $150,000 if "willful infringement" is proven. The MPAA did not state whether it would offer settlement deals to accused infringers, as the recording industry has done in its legal campaign. "The future of our industry, and of the hundreds of thousands of jobs it supports, must be protected from this kind of outright theft using all available means," said MPAA CEO Dan Glickman. The MPAA's new campaign also includes anti-piracy trailers and posters that will be displayed in 10,000 video rental stores, through an agreement with the Video Software Dealers Association. The group will also soon offer free software that it says will identify potentially infringing movie and music files on a computer, along with any file-sharing applications, and offer to delete them. The MPAA said this information would only be visible by a user of the program, and "would not be shared with or reported to the MPAA or any other body." The MPAA also cited raids on street vendors in Los Angeles and New York, in addition to actions in five other countries, as well as its backing of movie theater anti-camcording laws in 18 states and the District of Columbia as other examples of its campaign against movie piracy.

o Grokster Launches P2P Radio, Enters Talks With Sony BMG

Los Angeles -- Grokster, a provider of peer-to-peer file-sharing software, announced on Tuesday that it will offer a peer-to-peer streaming radio application in partnership with Mercora. The technology allows file-swappers on Grokster to stream tracks from other users' collections, as well as broadcast their own files to other users in a Digital Millennium Copyright Act-compliant manner. The near CD-quality radio service will include 10 million user-contributed tracks, in addition to Grokster-programmed stations featuring independent artists. Los Angeles-based Grokster is also in early talks with major record label Sony BMG to create a legal music service, according to a Reuters report. "I'm not negotiating myself, as Sony BMG chairman, but I know that some staff members are at the very beginning of talks with Grokster," Sony BMG chairman Rolf Schmidt-Holtz told Reuters. "We are noticing that there is huge demand for services like that, and our intention is to transfer this demand into legal channels. Only then it would make sense for us." Schmidt-Holtz, who oversaw BMG's merger with Sony earlier this year, added that he knew of only one meeting so far between the two companies, and was not sure which side initiated the negotiations.

o American Airlines Tests Handheld In-Flight Entertainment Devices

Fort Worth, Texas -- American Airlines announced a three-month test of a new in-flight entertainment option for passengers, in the form of a handheld device that contains movies, music videos, TV shows, newspapers, video games and other content. The Personal Entertainment Device features an 8.9" wide SVGA LCD screen, and during the trial will be available free to first class passengers, and for between $10 and $12 per flight to main cabin passengers, who will be able to swipe their credit cards directly on the devices. Similar devices are offered on Alaska Airlines flights, while other airlines such as JetBlue and Independence Air have deals to offer passengers in-flight satellite TV service.

o Rockstar Games, Interscope to Release 8-CD "Grand Theft Auto" Box Set

New York -- Rockstar Games, the game publishing label of Take-Two Interactive responsible for the "Grand Theft Auto" franchise, on Tuesday announced details for an 8-CD box set to accompany its recently released "Grand Theft Auto: San Andreas" game. As the game is set in the early 1990's, many of the CDs will feature tracks from the era, as well as DJ dialogue and satirical commercials found in the game. Artists featured include 2 Pac, Public Enemy, Bell Biv DeVoe, Willie Nelson, Lynyrd Skynyrd, Soundgarden and Faith No More. o MSN Music, Garageband.com Partner to Offer Independent Music Downloads

Redmond, Wash. -- Microsoft announced on Tuesday that its MSN Music digital download store and music service has partnered with independent music site GarageBand.com to offer free downloads, radio and other content from unsigned artists. MSN Music will feature a GarageBand.com page highlighting five up-and-coming musicians from the site's online community of over 100,000 musicians, as well as a streaming music station featuring its artists. MSN Music will also offer a large portion of the 1.7 million songs from the former MP3.com archive, acquired by GarageBand.com in April. MSN Music will initially offer 150,000 free MP3.com tracks through a link on its site.

o Finnish Digital TV Developer Sofia Digital Closes Investment Round

Helsinki, Finland -- Sofia Digital, a Finland-based digital TV technology company, announced on Tuesday that it has closed an investment round with Sentica Partners. While financial terms for the investment were not disclosed, Sofia Digital did say that Sentica would join the Finnish firm as minority owners to "support the company's growth internationally". Sofia Digital provides technologies for interactive TV services, SMS TV games and cross-media content management products for broadcasters, operators, receiver manufacturers and service providers. The company's customers include Czech Telecom, Helsinki Television, Nokia, ST Microelectronics and Sun Microsystems Italia. "Sofia is an internationally well-known and respected digital television solution provider," said Sofia Digital Chairman Heikki Lehmusto. "We expect to have significant growth from the European market."

(London) Inspired Broadcast Networks is set to launch the first public digital music download kiosks in London next month, Reuters reported. The kiosks in Waterloo and King's Cross subway stations will offer tracks for about $1.85 each that may be downloaded onto a cell phone or portable music player. The company hopes to eventually offer a catalog of 2 million songs, and has plans to launch up to 20,000 additional public kiosks by the end of 2005.

(Malibu, Calif.) Toymaker Jakks Pacific announced on Tuesday that it has signed a license with World Wrestling Entertainment to develop and market a "TV Games" product featuring WWE characters. The all-in-one plug-and-play video game controller and console will sell for $20 and is set for release in 2005. The deal was announced amid strained relations between the two companies, as WWE recently sued Jakks alleging bribery and fraud in its negotiations to secure the very same video game license. Jakks said in a statement that the TV Games deal was secured in July, 2004, prior to WWE's lawsuit. The WWE responded with its own statement: "We do not know why Jakks chose to issue a press release on the subject today," adding that a quote from a WWE executive contained in the press release that praises Jakks is no longer accurate.

(New York) Music Choice, a provider of digital music services for cable TV and broadband providers, announced on Tuesday the launch of a new advertising model that allows advertisers to place video-based campaigns within its new video-on-demand platform. The VOD service is offered for free to digital cable subscribers, and offers music videos, concerts, and exclusive performances and interviews on demand, in addition to the ability for viewers to program their own music video and audio channels. In addition to the video ads, Music Choice will offer advertisers both branded individual music genre channels or programs, as well as static ads, all of which the company says can be accurately tracked and verified.

The game was developed by Japan-based DIMPS and is based on the children's animated series that airs on Cartoon Network.
