o SBC Signs 10-Year, $400 Million
Deal to Use Microsoft IPTV Software
San Antonio, Texas -- SBC Communications announced on Wednesday
that it has signed a ten-year, $400 million agreement with Microsoft
to deploy the company's Internet-based TV (IPTV) service software to
its customers. The deal is the second recent major deployment for
Microsoft's struggling TV-based initiatives, after cable TV operator
Comcast announced earlier this month that it will deploy set-top
boxes running Microsoft software to 1 million of its subscribers.
The services deployed to SBC customers, scheduled to begin testing
in mid-2005 with commercial deployment by the end of the year, will
include an interactive program guide, video-on-demand and digital
video recording. SBC plans to spend $5 billion over three years to
upgrade its network to foster deployment of video and other
broadband services.

o "Pulp
Fiction" Writer Sues Microsoft Over Fitness Video Game
Los Angeles -- Roger Avary, the Oscar-winning co-writer of the
film "Pulp Fiction," has sued Microsoft for allegedly stealing his
idea to create an exercise-themed video game targeting women. Avary
said he pitched the idea during 2003 meetings with Microsoft, which
later released Oregon-based developer ResponDesign's "Yourself!
Fitness" title for the Xbox console. ResponDesign CEO Ted Spooner
told Reuters that the game "is a wholly original idea that was
created before any discussions this individual had with Microsoft."
Avary is reportedly seeking at least $30 million in addition to an
injunction against distribution of the game. "My primary purpose is
to institute a policy change, so that this doesn't happen to anyone
else," Avary told The Los Angeles Times. "If they believe they can
take me through a year of creative process and brain drain, and then
claim they have zero obligation to me -- if that is the culture,
then there is a culture clash."

San Antonio, Texas -- Clear Channel Radio announced that it has
hired Evan Harrison, the head of America Online's AOL Music
division, to create complementary Internet radio sites for the
company's over 1,100 owned or operated radio stations. The company
currently offers streaming versions of about 200 of its local
stations. "The number of people listening to radio online has grown
fivefold over the past five years and it's time to step up our
programming here," said Clear Channel Radio CEO John Hogan. Clear
Channel plans to offer features like in-studio performances, custom
music videos and artist interviews on its station websites.

o Wireless
Entertainment Start-Up ThumbPlay Raises Venture Capital Funds
New York -- ThumbPlay, a New York-based start-up developing
wireless entertainment services, announced that it has raised an
undisclosed amount of venture capital financing from i-Hatch
Ventures and Redwood Partners. The company also announced a
partnership with hip-hop artist Jay-Z, through which it will offer
concertgoers attending shows on the rapper's current tour to send
$0.99 text messages that are then displayed on large video screens
installed at concert venues. In addition to the "Holla at Ya Boyz"
text message application, ThumbPlay offers delivery technology for
ringtones, games and other wireless content, including streaming
multimedia on 2.5G and 3G networks.

o Toymaker
Jakks Pacific Faces Shareholder Suit Over WWE Bribery Charges
Bala Cynwyd, Pa. -- A shareholder class action lawsuit has been
filed against toymaker Jakks Pacific, in connection with the
company's alleged engagement in bribery and fraud in order to obtain
a license to create video games with World Wrestling Entertainment (WWE).
The shareholder action, filed by the law firm of Schiffrin &
Barroway, LLP, argues that the company's stock and shareholders have
been negatively affected by the alleged bribery scheme; shares of
Jakks Pacific have fallen from $24.15 before the WWE lawsuit was
filed to under $13 per share, and are now hovering just above $17
per share.

o Wolfson
Electronics Wins First Round in Patent Dispute
Edinburgh -- Wolfson Microelectronics, a Scotland-based
semiconductor specialist that floated on the London stock exchange
four years ago, announced on Wednesday that it has won a significant
battle in its protracted patent dispute with Cirrus Logic, a
U.S.-based maker of chips for audio and consumer electronics.
Wolfson said the International Trade Commission ruled that Cirrus's
claims over its "928" patent, which involved no fewer than 15
Wolfson products, were "unenforceable." While the Commission did say
that Wolfson had infringed on Cirrus's "501" patent, the patent
affects only three of Wolfson's products, two of which have already
been discontinued, the Scottish firm said. Cirrus now has 10 days to
appeal the ruling. Meanwhile, Wolfson said it planned to continue
with its counter-suit claiming that Cirrus improperly interfered
with its initial public offering (IPO) in 2000.
