o Bertelsmann 3Q Earnings Up 78%;
Chairman Resigns
Frankfurt -- German media giant Bertelsmann -- the No. 5 record
company in the world and owner of publisher Random House -- on
Thursday reported a 78% increase in third-quarter earnings. The news
was largely overshadowed, however, by the surprising resignation of
supervisory board chairman Gerd Schulte-Hillen, who reportedly quit
because of disagreements with senior management over the company's
plans to merge its record label business with Sony's. The news has
led some analysts to suggest there is a growing rift between the
supervisory board chairman and the CEO at Bertelsmann. Former CEO
Thomas Middelhoff resigned only a year ago.

Students Get Suspended Sentences in 'Net Music Piracy Case
Sydney, Australia -- Two Australian college students convicted of
illegally distributing 1,800 songs on the Internet were given
18-month suspended prison sentences, and will complete 200 hours of
community service, The Sydney Morning Herald reported. The
convictions were the first for criminal online copyright violations
in the country. Prosecutors had sought prison time for Charles Kok
Hau Ng, 20, and Peter Tran, 19, as the recording industry there
estimated their losses at $60 million, but the judge in the case
took into account the offenders' youth and the fact that they did
not personally profit from their MP3 website. A third accused,
21-year-old Tommy Le, also plead guilty to lesser copyright
infringement charges and received 200 hours of community service.

o EU Delays
Vote on Controversial Intellectual Property Law
Brussels -- The EU has once again delayed a vote on controversial
legislation that would increase law enforcement's powers to fight
intellectual property crimes. The vote was delayed after several EU
ministers said more discussion was needed to fully understand the
directive's implications. The proposal has sparked considerable
controversy in Europe, where critics claim that it will hinder
competition and make many harmless practices a crime. The directive,
which has been delayed three times already, was originally scheduled
for vote on Sept. 11. That date has now been changed to Nov. 27, but
industry experts say a vote before year's end is unlikely.

Partners with AOL to Create IM Software
San Francisco -- America Online has partnered with San
Francisco-based Web publishing software firm Macromedia to develop
technology that programmers can use to create software for AOL's
instant messaging platform. Macromedia, best known as the developer
of Flash animation technology, also is the creator of Macromedia
Central, a program that lets users interact with information and
software delivered over the Internet. Through the partnership, the
companies have opened the door for potentially hundreds of thousands
of Flash developers to build applications that incorporate IM
features. "This partnership opens the door for developers to build
applications that add context through online forums such as
discussion groups, virtual classrooms, and multi-party chat," said
Kevin Lynch, the chief software architect at Macromedia. AOL's
instant messaging network supports over 1 billion messages a day and
over 50 million active users each month.

o AT&T Wireless
to Distribute RealNetworks Mobile Video Content
Seattle -- RealNetworks, a provider of media delivery technology,
announced on Thursday that it has partnered with AT&T Wireless to
provide streaming video content to subscribers of AT&T's mMode
wireless content service. Subscribers with Nokia 3650 handset or the
Nokia N-Gage who have installed the RealOne Player software for
mobile devices can pay $4.95 per month, plus usage charges, for
full-motion video and audio of breaking news, entertainment, sports
and weather. Content providers for the service include ABC News, NPR
News, CBS MarketWatch, Fox Sports, Sporting News Radio and The
Weather Channel.

Calif.) Overture Services, a unit of Yahoo that provides
pay-per-performance Internet advertising services, announced on
Thursday the launch of its Marketing Console, which will allow
advertisers to measure the effectiveness of their Overture
campaigns. The service will track paid keyword ads, banners and
third-party email promotions. Pasadena, Calif.-based Overture will
charge advertisers between $150-$250 per month for the service,
depending on the number of ads being tracked.

(New York) Cable TV network HBO, a unit of Time Warner, announced
on Thursday that it is distributing a downloadable game based on its
series "Carnivale" through RealNetworks' RealArcade online PC game
service. "FATE: the Carnivale Game," an online Tarot card game, will
be available for preview and purchase exclusively on RealArcade for
$19.99.

(Dallas) Online personals site Match.com announced on Thursday
that it has partnered with cable TV operator Comcast to launch a
co-branded personals site on Comcast.net, the portal for Comcast's
high-speed cable Internet subscribers. Comcast currently claims five
million U.S. broadband subscribers, while Dallas-based Match.com
claims 12 million members for its service.

Thursday that it signed St. Louis Cardinals All-Star Albert Pujols
as cover athlete and spokesman for its "MVP Baseball 2004." The game
for PlayStation 2, Xbox, GameCube and the PC is under development at
EA Canada for a spring 2004 release. Redwood City, Calif.-based
Electronic Arts also on Thursday released its "Looney Tunes: Back in
Action" title for PlayStation 2, GameCube and Game Boy Advance.
Based on the Warner Bros. film of the same name, the game was
developed by U.K.-based Warthog and is being co-published by Warner
Bros. Interactive.

(San Francisco) Video game publisher Ubisoft has released its
"XIII" title for PlayStation 2 and the PC. Featuring voice talent
from actors including David Duchovny, Eve and Adam West, the title
offers online multiplayer gaming on both the PlayStation 2 and PC
platforms.

Japanese game developer, said that it has released "Disney's Hide
and Sneak" for Nintendo GameCube to retailers. The game features

(San Francisco) Wired News on Thursday reported on Loca Records,
a U.K.-based electronica record label that it is distributing its
artists' music online for free, under a Creative Commons license
that allows anyone to share, remix and redistribute its songs. The
label also sells CD and vinyl versions of its music in European
record stores. "You're free to copy it, give it to your friends and
you can play it. If you're really interested, you can sample it and
then re-release it," Loca Records managing director David Berry told
Wired News. "Because at the end of the day, if you sample the work
and create a fantastic remix, we think you're entitled to try and
make some money from it."

(San Francisco) CNET News.com recently reported on Poisoned, a
file-sharing application that allows Mac users to connect to the
FastTrack network, on which Kazaa's tens of millions of users share
media files. "The Macintosh has been very underserved, very
neglected," programmer Julian Ashton, who is leading development on
Poisoned, told News.com. "That's why this is an ideal project." The
software has already gained the attention of the Recording Industry
Association of America, which reportedly has targeted legal action
at a Poisoned Mac user.
