o Nielsen/NetRatings Launches "Digital Media Universe" Rankings

New York -- Nielsen/NetRatings, a provider of Internet audience
measurement data, announced on Thursday the creation of a new measurement
service for digital media, covering AOL proprietary channels, instant
messaging applications, media players, online games, wireless content
systems and other areas. In the company's "digital media universe"
rankings for October 2002, Microsoft and AOL Time Warner both attracted
more than 92.6 million unique visitors. Yahoo drew 79.8 million unique
visitors, while visitors to U.S. government sites totaled more than 38.3
million visitors and Google saw 37.7 million unique visitors. New
York-based Nielsen/NetRatings estimated that the entire digital media
universe in October was comprised of 178.7 million home and at-work users.
"With the launch of Digital Media Universe measurement, marketers can
understand how consumers are using Instant Messengers and other
applications that are fast becoming an important vehicle for advertising,"
said NetRatings senior vice president of product marketing and business
development Manish Bhatia.

o WSJ: Marvin Davis May Bid For Vivendi Entertainment Assets

Paris -- The Wall Street Journal reported on Thursday that billionaire
U.S. oilman Marvin Davis has approached Vivendi Universal about buying all
or part of its U.S. entertainment assets. The Journal said Davis is
gathering a group of investors to bid $15 billion -- plus $5 billion in
debt -- for Vivendi's U.S. entertainment assets, which include Universal
Studios, Universal Music Group, several cable networks and the Universal
Studios theme parks. Vivendi Universal spokesman Alain Delrieu told The
Associated Press that Vivendi made clear to Davis' representatives at a
Nov. 5 meeting that "the assets are not for sale."

o Webcasting Services Provider Loudeye Technologies Acquires Streampipe

Seattle -- Loudeye Technologies, a provider of webcasting, song samples
and other digital media services, announced on Thursday that it has
acquired Streampipe, a provider of webcasting technology and services.
Terms call for Loudeye to exchange 7.9 million unregistered shares of its
common stock and a $1.1 million unsecured note for ownership of Ardsley,
N.Y.-based Streampipe. Seattle-based Loudeye said the purchase will expand
its customer base and reach into the government market, as Streampipe
provides services to many federal and local government agencies. The
company expects Streampipe's operations to contribute an additional $1
million to its quarterly revenue. In addition to webcasting services,
Loudeye also provides streaming song samples to a number of retail
websites, including Amazon.com.

o Maker of Photoshop Rival Sues Adobe Over "Misappropriated" Trade Secrets

Carpinteria, Calif. -- Shell and Slate Software Corp., distributor of
Kai's Power Tools image editing software, announced that it has sued rival
Adobe Systems for an alleged misappropriation of trade secrets, over
features contained in Adobe's Photoshop 7.0. The lawsuit, filed by Shell
and Slate and the company founder Ben Weiss in U.S. District Court in Los
Angeles, focuses on a feature included in the recent Adobe release called
"texture cloning." San Jose, Calif.-based Adobe has yet to comment on the
litigation.

o Online Magazine Salon.com Delisted from Nasdaq SmallCap Market

San Francisco -- Financially struggling online magazine Salon.com
announced on Thursday that the Nasdaq has delisted its shares from its
SmallCap Market, moving them to the over-the-counter market, the OTC
Bulletin Board. "While we valued the prestige of a Nasdaq listing, this
move to the OTC market should not affect our core business. Our focus has
been and will continue to be on the fundamentals -- growing our business
by subscription revenues and delivering compelling advertising solutions
for our customers," said Salon president and CEO Michael O'Donnell.
O'Donnell said the company intends to reapply for Nasdaq listing as its
"business metrics improve in the months and years ahead."

o Game Developer Bam Entertainment Gets Nasdaq Delisting Notice

San Jose, Calif. -- Game developer Bam Entertainment announced on Thursday
it has been given notice by the Nasdaq that its shares do not meet the
minimum bid price listing requirement, and are in danger of being delisted
from the exchange. San Jose, Calif.-based Bam, whose games include the
recently released "Reign of Fire," based on the Touchstone
Pictures/Spyglass Entertainment film, has seen its shares trade below the
Nasdaq's $1 minimum since mid-October. The company has until February 18,
2003 to regain compliance or request an appeal.
