o Texas Sues Sony BMG Under
Spyware Law; Additional Security Risk Found
Austin - The Attorney General for the state of Texas has
sued major record label Sony BMG under the state's spyware law, in
connection with the release of millions of CDs containing technology
that hid anti-piracy software that opened users' PCs to virus
attacks. "Sony has engaged in a technological version of cloak and
dagger deceit against consumers by hiding secret files on their
computers, said Attorney General Greg Abbott. "Consumers who
purchased a Sony CD thought they were buying music. Instead, they
received spyware that can damage a computer, subject it to viruses
and expose the consumer to possible identity crime." The state of
Texas is seeking civil penalties of $100,000 per violation of the
state's anti-spyware law. Meanwhile, another security risk related
to the Sony BMG copy-protection technology has been identified, this
time in connection with software from Arizona-based SunnComm
Technologies. Computer researchers Ed Felten and Alex Halderman
identified a security risk in the uninstall program for SunnComm's
anti-piracy application, which the company said had been downloaded
by just 223 consumers before it was removed from the Web. SunnComm's
CD copy-protection software is different than the offending
application from U.K.-based First 4 Internet at the heart of the
controversy -- although SunnComm's software has likely been included
on a greater number of releases, from both Sony BMG and other record
labels.

2005 Internet Ad Sales Expected to Hit Record $12 Billion
New York - Internet ad sales are expected to hit another
all-time high of over $12 billion in 2005, up from 2004's record
$9.6 billion in sales, according to a report from
PricewaterhouseCoopers and the Interactive Advertising Bureau (IAB).
Record third-quarter sales of $3.1 billion were up 33.9% over a year
ago, boosted by sponsored ads on search engine results. "The
continued strength in Internet advertising reflects in part the
medium's unique ability to collapse the business cycle for
advertising, marketing and branding, making it more attractive for
traditional advertisers," said Pete Petrusky, director of advisory
services for PricewaterhouseCoopers. "The high percentage growth in
revenues is more significant given the larger revenue base."

Let Subscribers Transfer TV Shows to Apple iPod, Sony PSP
Alviso, Calif. - TiVo announced on Monday that subscribers
to its digital video recorder service will soon be able to transfer
recorded TV programs to their Apple iPod or Sony PSP portable
devices. TiVo subscribers can already use the TiVoToGo feature to
transfer recorded TV shows to a PC or laptop, as well as to portable
devices that support Microsoft's Portable Media Center software.
Consumers will be able to purchase "low-cost" software that enables
them to program TiVo to automatically transfer select recorded shows
to an iPod or PSP overnight via the PC. TiVo will embed watermarks
on the transferred programs as an anti-piracy means, enabling
tracking of the account from which a transferred program originated.
TiVo will begin testing the feature in the coming weeks, with
availability for all TiVo Series2 subscribers expected in the first
quarter of next year; in October, the company claimed a total of
3.85 million subscribers.

iTunes Store Cracks Top 10 List of Leading Music Retailers
Port Washington, N.Y. - Apple's iTunes Store entered the
top 10 list of leading music retailers for the first time during the
third quarter of 2005, coming in seventh and ahead of Tower Records,
Sam Goody and Borders, according to a report from market research
firm NPD Group. "The ongoing and growing popularity of Apple's
iTunes Music Store now positions the company as a leading music
retailer, and continues to legitimize legal digital music
retailing," said NPD Group analyst Russ Crupnick. "With the growing
interest in digital music, forecasts of more iPod demand this
holiday, plus the stocking-stuffer appeal of iTunes gift cards, we
can expect Apple to increase its share even more by year's end." The
iTunes Store commands 70% of all U.S. digital music download sales,
while the iPod accounts for around 90% of all digital music player
sales, according to NPD. Music retailers still bettering Apple in
sales during the third quarter included Wal-Mart, Best Buy, Target,
Amazon.com, FYE and Circuit City.

Radio, Napster Launch Beta Version of Combined Service
Los Angeles - Digital music subscription service Napster
and satellite radio service XM on Monday announced the launch of a
beta test of a service that allows subscribers to purchase tracks
heard on XM radio channels from Napster through a single interface.
XM + Napster provides direct links between XM channels and available
song downloads from Napster, in addition to in-depth information
about artists and related music recommendations. The service will
also enable subscribers to transfer purchased songs and albums to
portable MP3 players that support Microsoft's Windows Media Audio
format, which excludes Apple's iPod. Washington-based XM Satellite
Radio currently claims more than 5 million subscribers, while Los
Angeles-based Napster counts nearly 450,000 subscribers.

Exec Bachus Quits as CEO of Troubled Games Firm Infinium
Seattle - Kevin Bachus, a former top Xbox executive at
Microsoft, has announced his resignation as CEO of Infinium Labs,
the developer of an unreleased video game console he joined in
December 2003. "I'd like to thank Kevin for his past support and
wish him well with his future endeavors," said Greg Koler, who was
named interim CEO, CFO, president and a director of Infinium. "A lot
of that support has helped put our operational planning on track and
has helped create awareness for the company in the industry." Koler
was previously general manager of Gemstar-TV Guide's European
Infomedia unit, and was a founding director of Sony Computer
Entertainment Europe. Seattle-based Infinium Labs was slated to
release its "Phantom" PC-based broadband gaming service in the fall
of 2004, but numerous delays have pushed the release to at least
mid-2006.

Launches FiOS Internet TV Service in Virginia
Herndon, Va. - Telecommunications firm Verizon announced
on Monday that it will launch its FiOS TV broadband television
service this week in the northern Virginia community of Herndon --
the first deployment of the service in the eastern U.S. -- following
the September FiOS TV launch in Texas. The service will deliver up
to 330 TV channels, including more than 20 HDTV channels, over 1,000
video-on-demand titles, and digital video recorder services over
Verizon's fiber-optic broadband network. Basic service with 180
digital video and music channels will cost $39.95 per month; premium
sports and movie channels will also be offered, including HBO,
Cinemax, Starz, Encore, Showtime, The Movie Channel and WWE 24/7.
Following the service roll-out in Herndon, Verizon will expand FiOS
TV to additional households in Fairfax County and Fairfax City, as
well as in other states where the company has obtained video
franchises from local governments.

Developer iBiquity Gets Funding From Intel Capital
Columbia, Md. - IBiquity Digital, a developer of digital
radio broadcasting technology, announced on Monday that it has
received an undisclosed investment from Intel Capital. Founded in
1998, Maryland-based iBiquity has to date raised over $145 million
in financial backing for its HD Radio technology, which allows radio
stations to transmit a digital signal alongside their analog
broadcasts. Over 500 U.S. stations are now broadcasting using HD
Radio, and radio firms including Clear Channel and Infinity
Broadcasting have committed to using the technology. The company
said it would use the funds to accelerate the roll-out of commercial
HD Radio receivers, as well as for development of portable receivers
-- especially HD Radio for cell phones and digital media players.

Internet Search Closing on E-Mail as #1 Web Application
Washington - Using an Internet search engine has become
the second most-popular use of the Internet, behind e-mail,
according to a report from the Pew Internet & American Life project.
The survey showed that use of search engines on a typical day has
grown from 30% of the Internet-using population (38 million) in
mid-2004, to 41% (59 million) in September 2005, an overall increase
of about 55%. The Pew data found that 52% of American Internet users
send and receive e-mail on a typical day now, up from 45% in June
2004. Reading news on the Internet was the third most-popular online
activity, according to the report.

Online Pulls Out of PartyGaming Takeover Talks
London - Empire Online, a U.K.-based promoter of Internet
poker and casino websites, announced that it has pulled out of
takeover talks with PartyGaming, currently the largest online casino
in the U.K. Empire also announced that it has launched legal action
against its would-be buyer. Empire said PartyGaming had revised a
takeover approach made earlier this month that had been
"significantly different", both in terms of "the price and
structure" and "at a level that cannot be recommended". PartyGaming
initially tabled an offer valuing Empire at about $469 million.
Since Empire made its initial public offering in June, the company's
shares have lost nearly two thirds of their value. Industry experts
say investor confidence in online gambling has deteriorated to such
a degree that Emprise is now worth just $305 million.

Hold Midnight Sales for Microsoft Xbox 360
Redmond, Wash. - Microsoft announced on Monday that some
4,500 retailers will stay open past midnight for the retail launch
of its Xbox 360 video game console tomorrow. The company, which
hosted 3,500 gamers over the weekend in California's Mojave Desert
at an Xbox 360 launch party, said that Best Buy, Wal-Mart, GameStop
and EB Games will open select stores at midnight. The Xbox 360,
available for $399 or in a discounted $299 version without a hard
drive, will also go on sale Tuesday morning at retailers including
Circuit City, Target and Costco. Microsoft will begin selling the
Xbox 360 in Europe on Dec. 2 and in Japan on Dec. 10.

Movielink Adds 20th Century Fox Films to Internet VOD Service
Santa Monica, Calif. - Movielink, an Internet video-on-demand
joint venture between a number of Hollywood movie studios, announced
on Monday that it has signed a distribution agreement with 20th
Century Fox. With the addition of Fox, Santa Monica, Calif.-based
Movielink's service now offers a library of over 1,200 titles from
all the major studios, including Disney, MGM, Paramount, Sony,
Universal and Warner Bros. Fox titles initially offered on Movielink
will include "Robots," "Hide And Seek," "Kingdom of Heaven," "Mr. &
Mrs. Smith" and "Fantastic Four."

Los Angeles - Fandango, a provider of advance online and
phone-based movie ticket sales, announced on Monday that it sold an
estimated $12 million of the $101.4 million weekend opening box
office ticket sales for "Harry Potter and the Goblet of Fire." The
company broke its daily record for ticket sales on Nov. 18, when it
sold an average of nearly 10 tickets per second to the film;
however, "Star Wars Episode III" remains the advance top-selling

advance movie ticket sales, announced on Monday that it expects to
sell a total of $10 million in advance tickets for screenings of

Tech Used in Time Warner Cable "Star Over" VOD Service
Washington - Mediaware, a developer of digital video technology
for the broadcast sector, said on Monday that Time Warner Cable is
using its digital video editing and processing technology as part of
the launch of its new video-on-demand offering. Time Warner launched
the service, known as "Start Over," on Nov. 1 to 10,000 customers in
a South Carolina test market. The company plans to roll it out to
137,000 customers in South Carolina in the coming months, and
expects to expand it nationally next year. The service allows
digital cable customers to pause and rewind live TV, as well as
restart shows that are already in progress, without additional
hardware or software.

London - Jack Thompson, an attorney with a track record of
suing video game publishers and lobbying lawmakers over video game
violence, has had his license to practice law in the state of
Alabama revoked, GamesIndustry.biz reported. Thompson was lead
attorney in a lawsuit filed by the families of police officers
killed by a man who claimed inspiration from the video game "Grand
Theft Auto" -- a lawsuit which Judge James Moore said in an 18-page
statement Thompson turned "into a circus," with courtroom behavior
that "suggests that he is unable to conduct himself in a manner
befitting practice in this state."
