o Senate Passes Stripped-Down Copyright Bill

Washington -- The U.S. Senate on Saturday approved a copyright bill that had been stripped of highly contentious provisions that would have provided jail time for file-swappers, but maintained others that will criminalize theater camcording and pre-release distribution of works on file-sharing networks. In an earlier form, the bill would have for first time enabled the Justice Dept. to seek civil damages against file-swappers, as well as five-year prison terms for those offering 1,000 or more unauthorized songs for download. While these provisions were scrapped after protest from the Consumer Electronics Association, Verizon, the American Conservative Union and advocacy group Public Knowledge, the Family Entertainment and Copyright Act as passed will provide three-year jail terms for those who bring camcorders into movie theaters to pirate films, and potential jail time for anyone posting movies, music or other copyrighted works online prior to their commercial release. It will also provide protection for technologies that edit copyrighted movies into family-friendly versions. Although already approved there, the bill will once again be sent to the House in December in order to account for minor changes made to the legislation.

o Thomson Invests in ContentGuard Venture with Microsoft, Time Warner

Paris -- Thomson, a French provider of video technologies for media and entertainment firms, announced on Monday that it has agreed to purchase a 33% stake in ContentGuard, a developer of digital rights management technologies jointly owned by Microsoft, Time Warner and Xerox. Financial details of the investment were not disclosed. When Microsoft announced last year that it planned to purchase Xerox's stake in ContentGuard, European antitrust regulators announced an investigation, saying a 50-50 joint venture with Time Warner could create a Microsoft monopoly for digital rights management technologies. It is not clear what effect the addition of Thomson as a third investor will have on that probe. The companies said that ContentGuard's aim is to promote the development of inter-operable digital rights management systems, accelerate the deployment of new consumer devices and content distribution channels that support such technologies.

o Universal Music Group Launching Digital-Only Record Label

New York -- Major record label Universal Music Group this week will launch a new record label unit that will distribute music exclusively through digital services like Apple's iTunes, Napster, RealNetworks' Rhapsody and MSN Music, The New York Times reported on Monday. Universal Music Enterprises Digital has signed eight independent artists to contracts that will not provide advances or cover album production costs, but will maintain artists' ownership of master recordings. The music is then licensed by Universal and promoted by the company's expansive marketing department. "Even a token gesture from their promotional department is going to be more powerful than anything we've ever had,'' Hans Rotenberry of Nashville band the Shazam, which signed with the new unit, told The Times. Universal will pay musicians with digital-only contracts 25% of royalties, without the standard deductions for packaging and promotional giveaways. If online sales of a song reach around 5,000, Universal has an option to pick up distribution of the album at retail. "It's just so expensive these days to record an artist and make a video and put them out on the road to properly develop them," Jay Gilbert, a senior director at Universal's Music Enterprises unit, told The Times. "This is an alternative to that that's not very expensive but can be highly effective." The Times reports that Warner Music Group is also developing a digital label, which will finance recordings for online sales with an eye towards potential CD releases later.

o Mobile Music Service Developer Melodeo Raises $9.5 Million

Seattle -- Melodeo, a Seattle-based start-up developing mobile music download technology, announced that it has raised $9.5 million in its second round of venture capital financing. Participating investors included GF Capital, Intel, Ignition and Voyager Capital. The company was founded in 2003 by former executives from Tegic Communications, which developed technology that allows users to send text-messages via cell phone. "With the Melodeo solution we have built the music store into the phone so you don't have to be tethered to the desktop and sideload your music from your PC to your phone," Melodeo co-founder Don Davidge told the Seattle P-I. The software offers a catalog of up to 10,000 songs, with free 30-second previews and full-length downloads that take between 30 seconds and three minutes. The company, which will use the funds to accelerate its marketing and sales efforts, plans to begin service in Europe some time early next year.

o Fox Launches Online Store for Ringtones, Digital Entertainment

Los Angeles -- Fox Music, the music division of the entertainment studio, announced on Monday the launch of a new e-commerce site that will sell ringtones and other digital entertainment based on its film, TV and sports properties. Powered by Cupertino, Calif.-based Navio Systems, the store will sell master recording ringtones featuring the theme songs from Fox TV properties like "24," "The X-Files," "The Simpsons" and "The NFL on Fox," as well as full-track downloads of the theme songs and soundtrack albums from Fox films. The FoxMusic.com service will deliver content both directly to cell phones and to customers' PCs.

o Study: Parents Find Video Game Ratings "Highly Accurate"

New York -- The vast majority of parents (83%) agree with video game ratings set by the industry's Entertainment Software Rating Board (ESRB), according to a study conducted by Peter D. Hart Research Associates on behalf of the industry ratings group. The study showed 401 randomly selected parents a compilation of video footage from 80 recent console and PC games, and asked them to provide their own rating before being told of the ESRB rating. They were then asked to describe the ESRB rating as "about right," "too strict" or "too lenient." Parents found the ratings to be "about right" 83% of the time, and further found them "too strict" 5% of the time. In a separate announcement, eight members of Congress on Monday urged parents to check the ESRB rating on video games before buying them for their children this holiday season. The statement was endorsed by Senators Santorum, Kohl, Allen, and Ensign and Representatives Pelosi, Blunt, Hoyer, and Coble. "The ratings system makes it crystal clear whether or not the content of the video game is appropriate for young children. With such a vast array of games available, parents will be able to find a suitable gift for the all the kids on their list with just a pause to check the ratings," said Sen. Herb Kohl (D-WI).

o Audio Developer Dolby Files to Raise $460 Million in IPO

San Francisco -- Dolby Laboratories, a San Francisco-based developer of sound technologies, said on Friday that it has filed with the Securities and Exchange Commission to raise $460 million in an initial public offering (IPO). The offering will include shares to be sold by Dolby Laboratories and by Ray Dolby, who founded the company 40 years ago and remains its principal shareholder. Details such as the number of shares to be issued and the date of the offering, have yet to be announced. Dolby expects to list its shares on the New York Stock Exchange under the symbol "DLB." Morgan Stanley and Goldman Sachs & Co. will lead a group of underwriters. Virtually all major movie soundtracks throughout the world are encoded using Dolby's technologies, and virtually all DVD players incorporate its technologies.

o Broadband Ad Delivery Firm Lightningcast Adds Two New Investors

Washington, DC -- About four months after raising $5 million in a round of venture capital financing, DC-based Lightningcast, a maker of software for broadband advertising, said on Monday that it has added two new investors -- WWC Capital and the Washington Dinner Club. The amount of the additional funding was not disclosed, but the company said that it plans to use it to accelerate product development and expand its sales organization in response to increase demand for its products. The company's clients include AOL, Disney/ABC, Microsoft and MTV.

o Report: Kids Ages 2-11 Lead Growth in Web Page Views

New York -- Web pages viewed by kids ages 2-11 grew more than any other demographic group last month, according to a new report from Nielsen/NetRatings, a provider of Internet audience measurement services. The average number of web pages viewed by kids in the age group increased to 264 in October, up 36% from the year before and more than 100% since October 2002. "While kids are not necessarily spending more time online, they are digesting more content at a faster pace," said Charles Buchwalter, the vice president of analytics for Nielsen//NetRatings. Web users on average viewed 911 pages during the month. In October, there were 12.8 million kids connected to the Internet.

(Sydney, Australia) Sharman Networks, distributor of the Kazaa file-sharing application, announced on Monday that its new version 3.0 of Kazaa integrates Skype, a peer-to-peer technology that enables users to make free online telephone calls anywhere in the world. The company says that Kazaa has to date been downloaded over 300 million times. "The inclusion of Skype is a natural extension of the Kazaa product and of peer-to-peer," said Sharman CEO Nikki Hemming. "Despite narrow-minded attempts by others to stymie P2P technology through litigation, boycotts and legislation, Sharman Networks remains committed to delivering on the promise of peer-to-peer."

Movielink, an Internet video-on-demand joint venture between a number of Hollywood movie studios, announced on Monday that it has increased the number of titles offered in "enhanced quality," or an average encode rate of 1.3 Mbps with a peak of 4 Mbps. Movielink's standard movie downloads are delivered at an average of 700 kbps with a peak of 2.1 Mbps. The firm said it now offers nearly 50 titles in the enhanced format.

(New York) The New York Times recently examined the recording industry's contention that Internet file-sharing has negatively affected CD sales. "The most basic notion of economics is this notion of perfect substitution. You have two products that are in essence substitutes, so the market drives toward the freebies," said Recording Industry Association of America (RIAA) CEO Mitch Bainwol. However, professors Joel Waldfogel and Rafael Rob with the Wharton School at the Univ. of Pennsylvania conducted a study that concluded that every 10 downloads resulted in 1 to 2 lost sales. Another academic paper, co-written by Felix Oberholzer-Gee of the Harvard Business School and Koleman S. Strumpf of the Univ. of North Carolina at Chapel Hill, found no correlation. "Our best guess is that peer-to-peer networks in 2002 had no effect whatsoever on sales," Oberholzer-Gee told The Times.

(London) Scotland-based video game developer Traffic Games on Monday released "JFKReloaded," a $10 downloadable PC "docu-game" that recreates the scene in Dallas where President John F. Kennedy was assassinated on Nov. 22, 1963. "This new form of interactive entertainment brings history to life and will stimulate a younger generation of players to take an interest in this fascinating episode of American history," said Kirk Ewing, managing director of Traffic. "We've created the game in the belief that Oswald was the only person that fired the shots on that day, although this recreation proves how immensely difficult his task was." The developer says part of its goal is to discredit conspiracy theories that dispute the lone gunman theory. "It is despicable," David Smith, a spokesman for Massachusetts Sen. Edward Kennedy, brother of the late president, told Reuters.
