o CA Supreme Court: Texan 'Net Publisher May Not Be Tried In California

San Francisco -- The California Supreme Court has ruled that a Texas
resident cannot be compelled to stand trial in California for posting code
that can crack the encryption technology on DVD discs on the Internet. The
court ruled that defendant Matthew Pavlovich does not have to defend a
trade secret lawsuit brought by entertainment industry companies simply
because he knew that his publication could cause "general effects" on the
motion picture and technology industries in California. The publication in
question is the controversial DeCSS code, originally written to allow DVDs
to play on Linux devices but also capable of circumventing the
anti-copying technology on the discs. "This decision clearly puts to rest
the notion that you can drag someone into California court simply because
he should have known that a web publication could harm Hollywood," said
Cindy Cohn, legal director of the Electronic Frontier Foundation (EFF),
which is handling Pavlovich's defense. The case could serve as precedent
for other jurisdiction-related cases pertaining to Internet distribution.

o Danish Anti-Piracy Group Sends File-Sharers Bill for Copyrighted Content

London -- A Danish anti-piracy group has targeted about 150 Kazaa and
Edonkey file-sharing service users with letters demanding a combined
$133,600 in reparations for alleged copyright infringement, according to a
Reuters report. The Danish Anti Piracy Group (APG) is working with
recording industry trade group the International Federation of the
Phonographic Industry (IFPI) in an effort to combat online piracy. Experts
have questioned the tactic, saying that it's impossible to know what is on
a user's computer without physically examining it; they have also
questioned the monetary damage amounts, and pointed out that only a court
can dole out such judgments. Based on the amount of music, movies and
video games downloaded, the APG calculated the most egregious offender in
its current crackdown was served with a bill for $13,360.

o Sony to Launch Video-on-Demand Service for TV Soap Operas

Culver City, Calif. -- Sony Pictures Digital Entertainment plans to launch
a video-on-demand service for TV soap operas on its SoapCity.com site,
CNET News.com reported. Soap opera fans will be able to pay $9.99 per
month for unlimited, commercial-free access to four weeks' worth of soaps
including "General Hospital" and "Days of Our Lives." Individual episodes
will also be available for $1.99 each. Sony told News.com that the
service, which will deliver content using RealNetworks technology, is
expected to launch in the first quarter of 2003.

o "Final Fantasy" Creator Square to Merge With Japanese Developer Enix

Tokyo -- Japanese game developer Square, which created the popular "Final
Fantasy" franchise, announced that it will merge with fellow developer
Enix Corp. in April, The Asahi Shimbun reported. Terms of the transaction
call for Square shareholders to receive 0.81 shares in Enix for each share
of Square they hold. The new company, Square Enix, will be headed by
Square president Yoichi Wada, while Square itself will eventually be
dissolved. Enix has shipped 30 million copies of its "Dragon Quest"
roleplaying game series in Japan, while "Final Fantasy" has seen global
sales to date of 42.1 million.

o Set-top Box Maker Pace Micro Technology Plans Further Cost-Cutting

London -- Citing "difficult trading conditions", Pace Micro Technology,
the British manufacturer of digital TV set-top boxes, said on Wednesday
that it expects to make further cost cuts, having already cut costs by
$23.2 million earlier this year. The company said it is performing
satisfactorily in the U.K., but that it is falling short of sales targets
in Continental Europe and the U.S.

o Report: Online Advertising Expected to Increase 16% Through 2006

Waltham, Mass. -- In a sign of possible relief for online publishers and
other content providers, Internet advertising is expected to increase 16
percent from 2002 through 2006, according to a recent report from
Massachusetts-based research firm Global Insight. "This is very good news
for the advertising market in general, and a ray of light for the economy
as a whole," said Global Insight's John Rose. "Hard-hit media companies
such as AOL/Time Warner, Disney, and Viacom will feel substantial relief
in 2003, as corporate profits improve and increased retail sales drive
advertising spending throughout the year and on into 2006." Global
Insight's Media and Advertising practice works with Fortune 500 companies
to forecast demand for advertising spending and offer consulting services.

(Hanover, N.H.) The Dartmouth, the school newspaper for the Ivy League
university, recently reported on how one of its students has developed a
Dartmouth-only file-sharing system based on an application called Direct
Connect. As the system uses only internal Dartmouth bandwidth, only files
contained on Dartmouth-networked computers may be shared among one
another. However, closing off the public Internet has apparently concealed
its use from network monitoring software and administrators. "I haven't
seen any increased traffic over the last week passing the border monitor,
and I have not noticed any significant activity changes on internal
networks, either," director of network services Bill Brawley told The
