o Online Retailers See 29% Surge
in "Black Friday" Visitors
New York - Web traffic to online retailers on Black Friday
-- the traditional start of the holiday shopping season -- shot up
29% from a year ago, according to new figures from Internet research
firm Nielsen/NetRatings. The firm said that its 100 representative
online retailers brought in 17.2 million unique visitors, up from
13.3 million a year ago. "While many shoppers headed out to the
stores over the weekend, the majority first turned to the Internet
to check prices and product availability," said Heather Dougherty, a
senior retail analyst with Nielsen/NetRatings. EBay was the top
online retailer, with 9.5 million unique visitors, followed by
Amazon and Wal-Mart Stores, which drew 4.6 million and 3.4 million
unique visitors, respectively. Target and BestBuy.com rounded out
the top five. Target, Wal-Mart and Circuit City, which offered deep
discounts on selected items on Friday, saw traffic to their sites
more than double from the previous Friday.

Next-Generation Game Consoles to Ship with Parental Controls
Washington - All three next-generation video game consoles
-- the Microsoft Xbox, which was released last week, and the Sony
PlayStation 3 and Nintendo Revolution, due for release next spring
-- will feature parental controls, the Entertainment Software
Association (ESA) announced on Monday. Similar to the "V-Chip" that
was federally mandated to ship with all new televisions, the game
consoles will let parents determine which games their kids will be
able to access, based on the game ratings defined by the
Entertainment Software Ratings Board (ESRB). Microsoft's Xbox
already ships with such controls, and Sony implemented them with the
release of its PSP handheld system. "With the average age of game
players now 30, our industry naturally creates content appropriate
for a wide range of audiences, just as there are TV shows, films,
music, and books for people of all tastes, interests, and values,"
said ESA president Doug Lowenstein. "I am proud that each console
maker has taken the initiative to give power to the parents,
offering technology not available for DVD players or even portable
music players that will allow parents to control the entertainment
their children access. In a culture where raising kids is a
challenge, video game parental control technology gives power to the
parents."

o TiVo to
Launch Ad Search, Targeted Advertising Service for Subscribers
Alviso, Calif. - TiVo announced on Monday that it plans to
launch a service in the spring of 2006 that will let its 3 million
subscribers search a library of on-demand ads, and also allow
advertisers to target ads based on the interests users submit in
personal profiles. TiVo said it partnered with advertising agencies
including Interpublic Media, OMD, Starcom Mediavest Group and The
Richards Group, as well as cable TV provider Comcast's advertising
sales division on the new service. The opt-in service will let TiVo
subscribers search for ads by category -- in sectors such as
automotive, travel, telecommunications, and consumer packaged goods
-- as well as by keyword.

o MPAA,
BitTorrent File-Sharing Network Sign Anti-Piracy Agreement
Washington - The Motion Picture Association of America (MPAA)
announced that it has reached an agreement with the BitTorrent
peer-to-peer file-sharing service and major movie studios to clamp
down on the unauthorized sharing of movies on the service. Under the
agreement, BitTorrent founder and CEO Bram Cohen will remove links
to pirated movies from the search engine on his BitTorrent.com
website. "BitTorrent is an extremely efficient publishing tool and
search engine that allows creators and rights holders to make their
content available on the Internet securely," Cohen said. "BitTorrent
Inc. discourages the use of its technology for distributing films
without a license to do so. As such, we are pleased to work with the
film industry to remove unauthorized content from BitTorrent.com's
search engine." The move will not stop trading on BitTorrent's
network, however, as there are many other search engines and
websites that can locate both authorized and copyrighted files
available for download from BitTorrent. "We are glad that Bram Cohen
and his company are working with us to limit access to infringing
files on the BitTorrent.com Web site," said MPAA CEO Dan Glickman.

o Kazaa Appeal
Set for February; Company Must Block 3,000 Songs Now
Sydney, Australia - Sharman Networks, the Kazaa
file-sharing service operator found guilty of copyright infringement
in Australia, has received a stay of the shutdown order from the
judge in the case until February 2006. In September, Justice Murray
Wilcox found Sharman Networks and its officers guilty of copyright
infringement in a suit brought by the world's music and motion
picture industries, and gave the company two months to install
filtering software to block trading of copyrighted songs. Sharman
has until Dec. 5 to block an initial list of 3,000 songs -- fewer
than the 10,000 requested by the industry. In a statement, Sharman
Networks said that it will work to implement filtering software to
block copyrighted songs so it may continue operating its
file-sharing network as a legitimate service. It also said that the
court "indicated that it was not prepared to make an order that
Sharman give security for damages," adding that the record companies
are seeking $200 million. The company's appeal before the full court
will take place in February.

o U.K.
Dot-Com Billionaire Ends Fight for Control of iTunes.co.uk
London - According to the Register, dot-com entrepreneur
Ben Cohen has abandoned his protracted attempt to regain the
iTunes.co.uk domain name he registered before Apple Computer. The
dispute began in 2000 when Cohen registered the domain name 10 days
after Apple applied for a trademark for the name "iTunes" on Oct.
27, 2000. A judge dismissed the case after noting that Cohen's
company, Cyberbritain Group Ltd., could have used the appeal process
that forms part of the DRS, but failed to do so. Cyberbritain
initially sought a further hearing, but has since withdrawn the
request and dropped the case altogether.
