o Excite@Home Customers Remain Online For Now

San Jose, Calif. -- A federal bankruptcy judge in San Jose said on Friday
that broadband access provider Excite@Home may end its contracts with the
cable TV operators to which it provides services and renegotiate them, but
stopped short of allowing the company to turn off service to its
customers, CNET reported. "It's clear that the continued operations have
substantial interests to the cable companies," Judge Thomas Carlson said.
Carlson's reasoning for allowing Redwood City-based Excite@Home to end its
contracts with the cable companies was that the terms of the contracts
were unfair to the bankrupt firm. It's unclear whether or not cable
operators such as Cox, Comcast and AT&T Broadband will now choose to shut
off service to their customers on their own. Newsbytes reported that FCC
chairman Michael Powell urged Judge Carlson not to allow services to be
interrupted. "I respectfully urge you, at a minimum, to provide for an
orderly transition rather than a precipitous shutdown of ExciteAtHome, to
avoid disrupting services to a significant percentage of U.S. customers,"
Powell wrote in the letter to Carlson.

o Dutch Judge Orders Kazaa To Block Copyrighted File-Sharing or Shut Down

London -- A Dutch court has ruled that Netherlands-based Kazaa, a provider
of file-sharing software, must shut down in 14 days if it cannot prevent
its users from sharing copyrighted files, Reuters reported on Friday. The
company, which said it is appealing the ruling, claims that it simply
distributes software, and cannot tell who uses the software for what
purpose once it is downloaded. "The computer program has already been
distributed. Kazaa can't see what sort of files people are sharing or who
its users are. We don't really know what the judge wants Kazaa to do,"
Kazaa attorney Christiaan Alberdink Thijm told Reuters. Netherlands-based
performance rights organization Buma/Sterma brought the claim against
Kazaa, and as part of the ruling is ordered to resume licensing talks with
the company that could potentially reverse the order. If no agreement is
reached in two weeks and Kazaa does not stop unauthorized trading, the
company faces fines of $40,000 per day, up to a maximum of $800,000.

o Study: Internet Use Dipping Into TV Watching Time Among U.S. Users

Los Angeles -- A recent study conducted by the University of California at
Los Angeles found that U.S. Internet users watched 4.5 hours less
television per week than non-Internet users in 2001. The study reported
that 72.3 percent of Americans have Internet access, up from 66.9 percent
in 2000, and spend an average of 9.8 hours a week online. It also found
that increasing numbers of users see the Internet as a valuable source of
information, while the number of users who find the 'Net a valuable source
for entertainment was roughly unchanged from 2000. The top five most
popular Internet activities, according to the study, were using e-mail and
instant messaging, Web browsing, buying online, finding entertainment
information and reading news.

o Gator To Stop Selling Replacement Pop-Up Banner Ads

New York -- The Interactive Advertising Bureau (IAB) announced that it has
reached an agreement with Gator, the controversial firm that sold pop-up
ads that could replace the existing ads on a website with those of a
competitor, whereby the two will work on a new ad format and Gator will
stop selling replacement banners. Gator filed a lawsuit against the IAB in
August, which attempted to protect its replacement banner ad format; both
parties have agreed to extend deadlines in the litigation in order to work
on a mutually agreeable new companion pop-up banner format. Many Web
publishers were angered when Gator released its technology, fearing that
advertisers who paid to place ads on their sites would no longer do so, if
there were no guarantee that a different ad wouldn't be seen in its place.

(Redwood City, Calif.) Diva Systems, a provider of video-on-demand
technology for cable TV operators, announced this week that the U.S.
Patent Office has granted the company two new patents related to its
subscription video-on-demand technology. The patents cover the creation of
programming packages that allow consumers to have on-demand access for a
monthly fee. They also cover the offering of contingent programming
packages, where access to an on-demand service is tied to subscribing to a
broadcast service, as well as promotional services that allow consumers to
subscribe via on-screen prompts.

(Redwood City, Calif.) Liquid Audio, a provider of downloadable music
distribution services, announced on Friday that independent classical
music distributor Naxos of America will use its services. Naxos will
launch its paid download service by selling tracks from 200 of its catalog
of 2400 albums, with new releases added each month. The tracks will be
able to be transferred by users onto portable devices as well as burned
onto CD.

(Columbia, Md.) IBiquity Digital, a developer of digital radio broadcast
technology, said on Friday that the National Radio Systems Committee
(NRSC) has recommended that the FCC authorize its technology as an
enhancement to the current analog FM broadcasting system in the U.S. The
NRSC is a standards group endorsed by both the National Association of
Broadcasters, which represents radio stations, and the Consumer
Electronics Association. Yesterday, Maryland-based IBiquity said that the
International Telecommunications Union endorsed its technology, which allows digital radio signals to be broadcast alongside analog signals without using
additional broadcast spectrum.

(Redwood City, Calif.) Konami, a developer, publisher and manufacturer of
video games, said that it has sold over 1.8 million copies of its "Metal
Gear Solid 2: Sons of Liberty" title for Sony's PlayStation 2 in the two
weeks following its release on Nov. 13. The game is a sequel to the
company's successful title for the PlayStation console.

(Hollywood) Fandango, an online movie ticket retailer, announced on Friday
the launch of advance ticket sales for the Dec. 19 release of "The Lord of
the Rings: Fellowship of the Ring." Hollywood-based Fandango said that it
sold nearly one million tickets in November, propelled by advance sales
for "Harry Potter and the Sorcerer's Stone."

(San Francisco) CNET offered a feature article this week on how classified
ads are being used to revitalize the stagnant online advertising industry.
Areas such as jobs, cars and personals have been able to generate a profit
