o RIAA Wins Transfer of SBC Subpoena
Challenge Case to D.C.
San Francisco -- A federal judge in San Francisco has agreed to
transfer a case challenging the Recording Industry Association of
America's (RIAA) subpoenas for the identities of SBC Internet
subscribers accused of illicit file-sharing to the District of
Columbia, a potential coup for the RIAA. The D.C. District Court
previously ruled in the RIAA's favor in a challenge to the subpoenas
launched by another ISP, Verizon. "Since the DC court has already
addressed most of the challenges raised by SBC and resolved them in
RIAA's favor, we believe that the decision to transfer the case
throws a significant monkey wrench into SBC's case," said RIAA
president Cary Sherman. In a statement, SBC said it was undeterred.
"This ruling is procedural in nature and does not address the
substantive issues we are raising about the recording industry's
continued misapplication of [Digital Millennium Copyright Act]
subpoena power."

to Introduce Music Download Store, Digital Music Player
New York -- PC maker Hewlett-Packard said on Tuesday that it
plans to counter rival Dell with the launch of its own music
download store next year, Reuters reported. The service is expected
to partner with an existing provider, such as Musicmatch -- which
provides fulfillment for Dell's download store -- and launch in
conjunction with the release of a new HP digital music player, which
will also compete with a similar product from Dell. The company will
likely introduce both new products at the Consumer Electronics Show
in January.

Australian Firm to Launch Music Download Store
Sydney -- Ninemsn, a joint venture between Microsoft and
Australian firm Publishing and Broadcasting, have announced plans to
launch an online music download store in the first quarter of 2004,
Australian IT reported. Having partnered with U.K. online music
distributor OD2, the service will initially offer 250,000 songs from
BMG, EMI, Sony, Universal and Warner Music, as well as independents
including Ministry of Sound, Beggars Group and Festival Mushroom.
Although pricing was not announced, Ninemsn said it would be
competitive with the $0.99 tracks offered on Apple's iTunes Music
Store.

Surprises Experts with $157 Million Profit
Paris -- French media and entertainment conglomerate Vivendi
Universal on Tuesday reported that it is back in black for the first
time since 2001. Vivendi took most analysts by surprise when it
reported a 131-million-euro ($157.5 million) third-quarter profit,
compared to a 1.23-billion-euro ($1.48 billion) loss in the same
quarter last year. What's more, the company announced that it has
negotiated a new bank deal for a 2.7-billion-euro ($3.2 billion)
credit line. The results suggest that Vivendi, which has undertaken
a massive 16-billion-euro ($19.2 billion) asset disposal program, is
very much on the mend, analysts say.

Publisher Take-Two Completes TDK Mediactive Purchase
New York -- Video game publisher Take-Two Interactive, creator of
the "Grand Theft Auto" and "Max Payne" game franchises, announced on
Tuesday that it has completed its acquisition of fellow game
publisher TDK Mediactive. New York-based Take-Two paid $12.8 million
in cash and stock for the Westlake Village, Calif.-based company,
which holds licenses to create games based on properties including
The Haunted Mansion, Pirates of the Caribbean, The Land Before Time,
Robotech, The Muppets and Corvette. TDK also created a line of games
based on the DreamWorks film "Shrek," but that license was not
transferred to Take-Two as part of the transaction. Take-Two said
that TDK Mediactive will now be known as Take-Two Licensing.

Clamp Down on Ads from Unlicensed Pharmacies
Mountain View, Calif. -- Following the lead of rivals Yahoo and MSN,
Google, the popular provider of search engine services, will stop
accepting advertising from unlicensed pharmacies. The pharmacies
have used services like Google to sell millions of doses of
narcotics and prescription drugs without medical supervision. The
move comes as three congressional committees begin to examine the
issue. Both Yahoo and MSN made similar decisions last month.
According to Nielsen/NetRatings, health care represented about 5% of
all online advertising sales in October.

Reports 500,000 GameCube Sales During Holiday Week
Redmond, Wash. -- Nintendo of America reported on Tuesday that,
according to "direct sales data from the nation's leading
retailers," the company sold over 500,000 GameCube video game
consoles in the U.S. during Thanksgiving week, topping sales of both
Sony's PlayStation 2 and Microsoft's Xbox. The company credited the
Sept. 25 price drop for the GameCube to $99 for the sales spike.
Additionally, Nintendo said it sold over 600,000 of its Game Boy
Advance handheld games last week, surpassing sales of all consoles.

(Los Angeles) Napster, a unit of Roxio, announced on Tuesday that
it will offer a free 3-day trial subscription to its premium service
during the month of December. The company also introduced a $30
retail bundle that includes Roxio's Easy CD & DVD Creator 6 Starter
Kit and five free Napster downloads. Roxio added Radio Shack to the
list of distributors for its pre-paid Napster cards, which offer 15
downloads for $14.85; the cards are also currently available at
RiteAid, Best Buy, CompUSA, Kroger, Safeway and other retailers.

(Anaheim, Calif.) ICTV, a provider of interactive TV
infrastructure technology, said on Tuesday that it has partnered
with e-commerce technology firm Delivery Agent. The two companies
will work to develop television-based interactive applications that
will enable subscribers utilizing video-on-demand to purchase items
related to films and television shows -- including apparel,
accessories, home furnishings and travel packages -- from their
televisions.

Tuesday released its AmbiCom Radio FM-CF, a Compact Flash memory
card accessory that functions as an FM radio. The $40 product
includes earphones and can turn any portable device running
Microsoft's Pocket PC operating system, such as a PDA, into an FM
radio.

(Los Angeles) Video game publisher Atari announced on Tuesday
that it has signed Michael Madsen, Ving Rhames, Mickey Rourke and
Michelle Rodriguez to provide voice talent for its "DRIV3R" title
for PlayStation 2 and Xbox. In development at U.K.-based Reflections
Interactive, the game is scheduled for release in the spring of
2004. Atari also announced the release of "Yu Yu Hakusho: Spirit
Detective" for Nintendo Game Boy Advance, based on the animated
children's series airing on Cartoon Network. The game was developed
by Sensory Sweep Studios and Screaming Games.

(Redwood City, Calif.) Game developer Electronic Arts announced
on Tuesday the release of its "The Sims Bustin' Out" title for
Nintendo Game Boy Advance. Developed by EA's Maxis Studio in
collaboration with Kirkland, Wash.-based Griptonite Games. The title
will support connectivity with the Nintendo GameCube version,
scheduled for release in mid-December. The company also released its
"James Bond 007: Everything or Nothing" title for Game Boy Advance,
based on its license from MGM Interactive. Versions of the game for
PlayStation 2, Xbox and GameCube are due for release early next
year.
