o Report: Subscription Digital Music
Services to Outpace Song Downloads
New York -- Subscription digital music services will eventually
outpace a la carte music downloads, and CDs won't be replaced by
digital music in the next five years, according to a report from New
York-based JupiterResearch. While 16% of online adults are
interested in downloading a 99-cent single, 17% are tempted by
subscription services, like Napster and RealNetworks' Rhapsody.
JupiterResearch found that interest in subscription services
increases for teens ages 13-17 (19%), nearly doubles for young
adults ages 18-24 (31%), and hits 37% for adult 'music aficionados',
who have spent more than $45 on music in the past three months.
Likewise, file-sharing and CD burning data indicates digital music
is more popular among youth, as 41% of 18-24 year-olds say they burn
CDs and 31% use file-sharing, compared to the over-25 crowd, where
those numbers are only 14% and 4%. However, the report found that
the majority of online adults (51%) think physical music is more
valuable than digital. JupiterResearch predicts that in 2009,
digital music sales will still represent just 12% of consumer music
spending.

o EU Suspends
Probe of Microsoft-Time Warner Purchase of ContentGuard
Brussels -- The European Commission announced that it has
suspended its antitrust probe into Microsoft and Time Warner's
acquisition of Maryland-based ContentGuard, a developer of digital
rights management technologies. The Commission has not been formally
notified of a major change in the deal, when on Nov. 22 Microsoft
and Time Warner announced that France's Thomson proposed to join
them as a one-third owner of ContentGuard. The Commission initially
launched its probe because it believed the deal could provide
Microsoft with a monopoly on digital rights management technologies,
for which ContentGuard owns a wealth of patents. The European Union
has a deadline of Jan. 6 to act against the deal, or else give it
automatic clearance.

Sells 500,000 DS Handhelds in First Week
Redmond, Wash. -- Nintendo of America announced on Wednesday that
it sold over 500,000 of its new DS handheld video game consoles
during Thanksgiving week, representing over 90% of all available
units in the U.S. The company has increased shipments to North
American retailers, and expects to sell 1 million $149-priced DS
units here by the end of 2004. Nintendo also said it sold more than
800,000 Game Boy Advance and Game Boy Advance SP units during the
past week, and that a special bundle of its GameCube console with a
"Mario Kart: Double Dash" game has sold over 250,000 units since
being introduced in mid-November.

Retailers May Face PlayStation 2 Shortage for Holidays
Foster City, Calif. -- Sony Computer Entertainment America has
announced that the new slimmed-down version of its PlayStation 2
console is in short supply at retailers, and the company may have
problems meeting demand for the holiday shopping season. Earlier in
the year, Sony attempted to clear store shelf space for the new
PlayStation 2 by decreasing supply of the older model to retailers,
but has been unable to keep up with demand for the new $150 version.
"Consumer demand for the new PlayStation 2 has exceeded our
expectations, and we are doing all we can to fulfill the wish lists
of people who want a new PlayStation 2 unit under their tree this
holiday season," the company said. The shortages are being
experienced both in the U.S. and in Europe, with many retailers
offering only back-orders, and sellers on auction sites such as eBay
offering the new PS2 for as much as $250.

ComScore Launch Internet Radio Ratings Service
New York -- Radio industry ratings provider Arbitron announced
that it has partnered with comScore Media Metrix to launch a new
service that will provide traditional broadcast ratings data for the
online radio industry. The comScore Arbitron Online Radio Ratings
will provide customers including the AOL Radio Network, Yahoo's
LAUNCHcast, MSN Radio and Windowsmedia.com with "Average Quarter
Hour" and "Cume" audience estimates for broadcast dayparts and
demographics -- the same metrics advertisers reference when buying
ads on traditional radio. Arbitron once provided online radio
audience measurement through Measurecast, but shuttered that service
in February, citing its lack of scalability and ability to provide
traditional radio metrics. The new service is based on a subset of
approximately 200,000 U.S. participants within comScore's global
consumer panel. In the wake of Arbitron's abandonment of its
MeasureCast ratings service, online ad sales firm Net Radio Sales
and technology provider Ando Media launched their own independent
Internet radio ratings service, Webcast Metrics, which just released
its first monthly data. While Arbitron and comScore will measure a
sample of users' habits, Webcast Metrics' data is derived from
online radio stations' own servers.

Cell Phone Graphics to Generate $1.1 Billion by 2008
Framingham, Mass. -- Graphical content for cell phones, such as
screensavers, wallpaper and caller ID graphics, is expected to
generate $150 million in revenue this year and grow to $1.1 billion
by 2008, according to a report from Massachusetts-based market
research firm IDC. The firm sees color screen phones, richly
animated graphics and fresh content as spurring the market; an IDC
survey also found that youths and young adults were five times more
likely to pay for and download graphics to their cell phones than
adults. "Bundling graphical content with other similarly themed
content should become prevalent over the next few years, as will
tying such content to movie and album releases, all of which should
propel revenue through the content ecosystem," said IDC senior
research analyst Lewis Ward. However, IDC noted the market could be
constrained by low penetration for advanced cell phones, lack of
effective digital rights management and low user awareness for such
services.

Makes Contingent Offer to Raise Bid for Hollywood Video
Dallas -- Video rental giant Blockbuster said on Wednesday that it
is willing to increase its bid for Hollywood Entertainment, the
nation's second-largest video rental chain, if Hollywood would allow
Blockbuster access to its financial records. Last month, Blockbuster
offered around $700 million to acquire Hollywood Video. The bid was
countered by rival offers from buyout firm Leonard Green & Partners,
and Movie Gallery, the third-largest video rental chain. Billionaire
Carl Icahn also disclosed that he has recently purchased 5.1 million
Hollywood shares -- an 8.4% stake -- signaling that he may emerge as
a fourth bidder for the company.

Entertainment Publisher Sorrent Acquires Developer Macrospace
San Mateo, Calif. -- Mobile entertainment publisher Sorrent
announced on Wednesday that it has acquired London-based mobile game
developer Macrospace. Financial terms of the deal were not
disclosed, although San Mateo, Calif.-based Sorrent said Macrospace
will maintain its management team and London offices. Macrospace has
created more than 40 mobile games, including "Fatal Force: Earth
Assault," for clients including Cartoon Network, Eidos, Square Enix
and Celador International. It also offers a service called
ProvisionX that provides managed mobile game distribution for
wireless carriers and media companies. "Their exceptional management
team, innovative portfolio of games, and extraordinary technology
and distribution significantly enhances our position in Europe and
will be a substantial asset to Sorrent," said Sorrent CEO Greg
Ballard.

Firm Sues Game Console Maker Infinium Labs
Sarasota, Fla. -- Infinium Labs, developer of a PC-based
broadband gaming console, has been sued by a California-based
investment firm that claims it has not been paid for its efforts to
secure outside investment in the company. Newport Beach,
Calif.-based SBI-USA says its agreement stated it would be paid a
percentage of all financing received by Infinium for 12 months
following the execution of the agreement, adding that Infinium says
it has secured $30 million in debt and financing since March 2004.
Florida-based Infinium Labs denied the allegations, arguing that SBI-USA
"misstates the now-terminated agreement between the parties as well
as the amounts raised by the company." Infinium has several times
delayed the launch of its Phantom gaming console, and divulged in
its recent quarterly report that it will need an additional $11.5
million to launch the device next year.

Wednesday that it has partnered with wireless carrier Sprint to
create ESPN Mobile, a national wireless service for sports fans.
Launching in 2005, the service will sell sports news, information,

(Kahl, Germany) Singulus, a German manufacturer of CD and DVD
replication equipment, announced that it has partnered with Sony to
develop mass-production technology for Sony's Blu-ray Disc format,
which will increase the capacity of DVDs from 4.7GB to 25GB per
disc. The deal will allow for the mass-production of pre-recorded
Blu-ray discs containing movies, music and other content. Sony's Blu-ray
disc technology is competing with a rival format developed by
Toshiba, HD DVD, which yesterday won the support of four Hollywood

(Stockholm) Mobile developer Ericsson announced on Wednesday an
agreement with Warner Music International, to distribute Warner
artist ringtones, master tones, ringback tones, logos and autographs
in 28 markets throughout Europe. The content will be distributed via
Ericsson's mobile music service, M-USE. Ericsson also announced that
European wireless carrier Tele2 launched M-USE for its subscribers,
offering music from Sony BMG and Warner artists.

company, announced on Wednesday that it has signed a two-year deal
with Warner Bros. International Television Distribution (WBITD) for
the distribution of more than 100 movies each year via the Rosso
Alice broadband portal. As of Wednesday, all broadband users will be
able to purchase new movies and library titles, paying 2.99 euro
($3.99) for movies released recently on home video, 1.99 euro
($2.65) for cult movies and classics and 1.50 euro ($2.00) for
children's movies and special offers. Alice customers will be able

(New York) Verizon Wireless has launched cell phone ringback
tones in California, a new feature that allows subscribers to
program their phones so callers hear music instead of the usual
ringing, the Associated Press reported. Verizon is charging $0.99
per month, plus an annual fee of $1.99 for each song chosen from the
2,000 available tracks. The service should be available nationwide
by mid-2005.

privately branded digital music download store for Sweden's Home

(Irvine, Calif.) Video game publisher Blizzard Entertainment, a
unit of Vivendi Universal Games, announced on Wednesday that its
"World of Warcraft" massively multiplayer online roleplaying game
for PC sold over 240,000 copies on Tuesday, the highest first-day
sales for any PC game in history. The company said later in the day
over 200,000 online accounts for the game had been created, and over
100,000 were playing the game concurrently. Blizzard added that over
350,000 copies of "World of Warcraft" were sold through the
Thanksgiving weekend.

(Los Angeles) Sony sent a promotional game disc to 1 million
PlayStation 2 owners last month that inadvertently erased all data
on the console's memory card, The Los Angeles Times reported. The
card keeps track of players' progress on many game titles, including
the level to which they had progressed, and which weapons and other
items had been amassed. "It doesn't quite rise to the level of
tragic," American Technology Research analyst P.J. McNealy told The
Times. "But it's close." Sony said it sent emails notifying
recipients of the error in the disc, which wipes out PlayStation 2
memory when a preview for Capcom's "Viewtiful Joe 2" game is viewed.
