o AT&T Customers Through Excite@Home Lose Internet Service

Redwood City, Calif. -- Following a bankruptcy court judge's ruling on
Friday which said the company could renegotiate its contracts with cable
companies, Excite@Home announced Monday that it has done so with all of
its partners except AT&T, whose customers' Internet connections it has
terminated. According to published reports, about 850,000 AT&T customers
who subscribed to high-speed cable Internet access had their connections
shut off on Saturday; AT&T said it will transfer subscribers in Chicago,
Dallas, Denver, Connecticut, Pittsburgh, Sacramento, Salt Lake City,
Seattle and San Francisco to its own new network within ten days. The
Washington Post reported that Redwood City-based Excite@Home has reached
an agreement with Comcast to keep its 700,000 subscribers online. The
company is still negotiating with other companies including Cox, while
Charter has already migrated 90 percent of subscribers who were with
Excite@Home to its own high-speed network.

o Sonicblue Granted Patent for Digital Video Recorder Technology

Santa Clara, Calif. -- Consumer electronics manufacturer Sonicblue
announced on Monday that the U.S. Patent Office has granted the company a
patent based on 50 claims related to its digital video recorder, that lets
viewers pause and record live television. The patent covers "the
fundamental concept of using a program guide or other user-specified
criteria to select TV shows for recording on a digital video recorder," as
well as technology Sonicblue developed that "creates, names, prioritizes
and manages recorded programs on the [device's] hard drive." Santa
Clara-based Sonicblue recently shipped its ReplayTV 4000 -- despite
pending litigation from major TV networks -- which charge that the device
enables copyright infringement.

o Webnoize Suspends Operations Amid Restructuring

Cambridge, Mass. -- Webnoize, a provider of digital entertainment industry
news and research services, announced on Monday that it will suspend
publication of daily news and research on its website while it
restructures. "We are not immune to the same market influences that have
affected others in our space," Webnozie president and publisher Tom Roli
said in a statement. "However, we expect to re-emerge in early 2002 with
new and improved events, products and services, that will continue to meet
the needs of those invested in digital media." Although the company's
research division was gaining notoriety for its coverage of volume on
file-sharing networks, its recent industry conference in Los Angeles was
sparsely attended when compared with previous years. "The fallout from
September 11, low travel numbers, and the poor economy hit our annual
event harder than anticipated just as we were working on an expansion to
our services," spokesman Gary Lacey wrote in an email. Cambridge,
Mass.-based Webnoize reported on digital music, Internet video technology,
interactive television, wireless and other convergence technologies.

o Report: Microsoft Loses European Interactive TV Contract to Liberate

London -- Reuters is reporting that an industry source said United
Pan-Europe Communications (UPC), Europe's largest cable TV operator, has
cancelled its order for Microsoft's interactive TV software in favor of a
product from competitor Liberate Technologies. Microsoft had problems
delivering the software -- which functions as an operating system for
set-top boxes used to deliver interactive TV services -- when promised,
and UPC reportedly used Liberate's software in its place to conduct
consumer trials. Microsoft did not comment for the story on what it called
"market rumors."

o Listen.com Launches Rhapsody Paid Music Subscription Service

San Francisco, Calif. -- Online music entertainment site Listen.com
announced on Monday the launch of its paid subscription service, giving
consumers access to on-demand streaming of music from 46 independent
record labels. The company said it is still in negotiations with the major

including 26.2 Music, Ark 21 Records, Eroica Classical Recordings, GNP
Crescendo Records, JamDown Records, Jazzateria, LoveCat Records, Slimstyle
Records, and Tinder Records. Rhapsody will cost $5.95 per month for a
subscription to either a classical music service or a "sampler" of tracks
from its indie label partners. Users can pay $7.95 for access to
Listen.com's entire library. The company is also offering a three-day
trial of the service for free. Distribution partners for Rhapsody include
broadband service provider Speakeasy.net and classical label Naxos of
America. Two subscription services from the major record labels are also

o Sun To Provide Infrastructure For Hughes' Spaceway Satellite Network

Santa Clara, Calif. -- Sun Microsystems said on Monday that it has signed

provide servers for the company's Spaceway service, being developed to
offer consumers and businesses high-speed Internet access via satellite.
Hughes Network Systems, which also manufactures the consumer satellites
used for DirecTV, said the Spaceway service will be based on a
peer-to-peer architecture and is scheduled to launch sometime in 2002.

million. Polaroid is selling off its assets as part of its filing for
Chapter 11 bankruptcy protection. Oregon-based Digimarc said it plans to

o Briefly Noted:

(New York) Inventor Dean Kamen revealed his much-hyped "Ginger" device to
the world on Monday morning during ABC's "Good Morning America," as well
as through an interview granted to Time.com. The device, as predicted by
several news outlets, is a personal scooter. The $3,000 Segway Human
Transporter has no engine or brakes, runs on energy costing 5 cents a day
and can travel at speeds up to 12 mph. "Cars are great for going long
distances," Kamen told Time.com, "but it makes no sense at all for people
in cities to use a 4,000-lb. piece of metal to haul their 150-lb. asses
around town." The device is expected to be available by the end of 2002.

(San Jose, Calif.) The DVD Copy Control Association (DVD CCA) has filed a
petition with the California Supreme Court in a controversial case over
DeCSS, a computer code that can crack the anti-piracy technology on DVDs.
The DVD CCA, a non-profit that licenses the "CSS" security technology to
DVD disc and hardware manufacturers, has asked for a review of a lower
court's decision that overturned a preliminary injunction prohibiting
publishers from posting the code online. DVD CCA argues that DeCSS is a
trade secret, and legally cannot be published, while defendants in the
case argue that the code has already been publicized in major newspapers
and online publications and therefore the case should be dismissed.

folded into its print operations, Internet.com reported on Monday. "[We]
will focus our online efforts exclusively on our Web site," the company
wrote in an email to subscribers. San Francisco-based Red Herring laid off
17 percent of its staff in September and switched its print magazine from
a bimonthly to a monthly.
