o World Copyright Treaty to Take Effect in March 2002

Geneva -- The World Intellectual Property Organization (WIPO) announced
that its treaty covering the use of copyrights worldwide has received the
final necessary approval from a participating nation, effectively making
the treaty enforceable in March 2002. The country of Gabon became the 30th
nation to ratify the treaty, which updates international copyright law to
include the digital distribution of works. The WIPO also said it expects
its Performances and Phonograms Treaty (WPPT), which more directly
addresses sound recordings distributed on the Internet, to be approved
soon. The WPPT has been ratified by 28 nations so far. "Both treaties
require countries to provide a basic framework of rights, allowing
creators to control and/or be compensated for the various ways in which
their creations are used and enjoyed by others," the WIPO said in a
statement. The WIPO's treaties also contain provisions similar to the
controversial clause of the U.S. Digital Millennium Copyright Act that
makes it a crime to circumvent the copy-protection security on digital
media.

o Web Radio Site Live365 Shut Down While Company Seeks New ISP

Foster City, Calif. -- Live365, a provider of nearly 40,000 Web radio
stations, has temporarily shut down its network due to a problem with the
third party company providing its bandwidth, Live365 said in a note on its
website. "We are currently seeking to establish a deal with alternative
service providers. Unfortunately, due to the volume of traffic we support,
our requirements are not easily met," the company said. CNET reported that
Cogent Communications, the telecom that provided services to Foster
City-based Live365's ISP, has suspended service. "We have suspended
service to their ISP for repeated violations of our acceptable use
policy," Cogent CEO David Schaeffer told CNET. Cogent said that the
unnamed ISP was cited for "repeated spamming of material, some of which
might be considered offensive."

o Sony Predicts $1B in Revenue from PlayStation Products in December

Foster City, Calif. -- Sony Computer Entertainment America on Friday
predicted that it will see $1 billion in revenue from sales of its
PlayStation family of products this month. The company said that during
the week of Thanksgiving (Dec. 19), 317,000 PlayStation 2 units and
100,000 PS one consoles were sold at retail, and that "the introduction of
two new competitive consoles [from Microsoft and Nintendo] had no impact
on sales." Sony also forecasted that when numbers are tallied, PlayStation
console sales will have accounted for $2 of every $3 spent on video game
consoles in the U.S. during 2001.

o Court Finds Lawsuits Overrule Arbitration in Cybersquatting Cases

Boston, Mass. -- The First Circuit Court of Appeals in Boston has ruled
that in "cybersquatting" cases where the rightful owner of a domain name
on the Internet is in dispute, a court's judgment trumps any arbitration
proceedings between the two parties, Newsbytes reported. The court found
that the U.S. Anticybersquatting Consumer Protection Act bears more weight
than decisions from The Internet Corporation for Assigned Names and
Numbers' (ICANN's) Uniform Domain-Name Dispute Resolution Policy (UDRP).
The court also ruled that domain name holders that have their domains
taken away from them under a UDRP arbitration decision can wield the
Anticybersquatting Consumer Protection Act on their own and sue their
opponents in federal court. The ruling is likely to affect many
cybersquatters who have had to relinquish their domain names as a result
of UDRP arbitration proceedings.

o IKnowledge Raises $8 Million in Second Round of Funding

Lexington, Mass. -- IKnowledge, a developer of content aggregation and
distribution software, has raised $8 million in a round of venture capital
led by Carmel Ventures, the firm that also led IKnowledge's $5 million
investment round last summer. Also participating in the latest round of
funding were existing investors DOR Ventures and Star Ventures, as well as
new investor D-Partners. IKnowledge's software integrates storage, caching
and networking capabilities, allowing organizations to aggregate content
in "native" form from a wide range of sources. The technology "fuses the
content with business logic and accelerates its distribution over any
network," the company said. In recent months, IKnowledge has announced a
series of strategic alliances with IBM, Sun and NEC Corp. of Japan, which
has agreed to beta test the 2.0 version of IKnowledge's software.

o DoubleClick Exchanges Research Unit for 10% Stake in Dynamic Logic

New York -- Online advertising technology and services firm DoubleClick
announced that online ad research firm Dynamic Logic will take over its Ad
Effectiveness research unit and become the exclusive provider of research
to the company. In exchange, New York-based DoubleClick will receive a 10
percent equity stake in Dynamic Logic, along with the opportunity to earn
additional equity in the future. New York-based Dynamic Logic provides
metrics for online advertising that include brand awareness, message
association, purchase intent and brand favorability. Its clients include
GlaxoSmithKline, GM, J Walter Thompson and MSN. DoubleClick will
transition its existing research customers to Dynamic Logic.

o Adobe Acquires Digital Photo Management Software Firm Fotiva

San Jose, Calif. -- Adobe Systems, a provider of Web publishing, streaming
media, video editing and graphic design software, announced that it has
acquired Fotiva, a provider of software that helps users manage, store and
share digital photographs. Financial terms of the transaction were not
disclosed. San Jose-based Adobe plans to integrate Santa Rosa,
Calif.-based Fotiva's technology into its own products, such as the
widely-used Photoshop image-editing program.

infringement claims leveled against it by Network Commerce, and has
determined that "we don't infringe on their intellectual property," the
company said in a statement. Redwood City-based Liquid Audio has filed a
motion to dismiss the claims, which allege that the company's downloadable
music distribution technology infringes on Network Commerce's patent
covering online transactions that include a download.

(New York) Performing rights organization Broadcast Music International
(BMI) announced this week a marketing alliance with online songwriters'
resource Tonos.com. Under the agreement, BMI's 200,000 songwriter and
composer members will receive discounts on Tonos memberships. The two
groups also said they will work together to identify and promote promising
new talent.

(San Francisco) Wired News reported on Friday on the choice of some
companies to return to privately-held status after an IPO and a stint on
the stock market. While most dot-coms saw their IPO as the logical path to
profitability during the 90's, companies now are beginning to realize that
they can save money and time by not having to compile the financial
statements required of publicly-traded companies. They can also move more
quickly in affairs such as cash acquisitions. Buy.com -- whose IPO
generated $182 million in February 2000 -- was recently repurchased and
made private by founder Scott Blum, who purchased all outstanding stock at
$0.17 per share.

(San Francisco) CNET reported on Friday on companies including Zingy and
Supermegaphone, which provide cell phone ringtones for free to owners of
phones capable of downloading the jingles. Carries such as AT&T Wireless
say they are aware of the traffic to their customers -- and are beginning
to sell their own ringtones -- but say they are so far relying on the
recording industry to clamp down on sites that have not properly licensed
their ringtones from songwriters and copyright owners. "Certainly, court
action is in the cards if people do not stop putting up our ring tones,"
Walt Disney Internet Group's Larry Shapiro told CNET.
