o AOL Cuts 750 Employees, Mostly in Virginia

Dulles, Va. -- Continuing to feel the pinch from mounting subscriber losses, America Online has cut 750 employees, mostly from its Virginia headquarters. The cuts, including several at the executive level, account for approximately 4% of the company's overall workforce, and are expected to save AOL about $75 million next year. The move also affected employees in California, Ohio and New York. AOL has lost subscribers in each of the past seven quarters, with dial-up customers either switching to lower-cost alternatives or opting for broadband connections offered by either cable operators or telephone companies. The company, which also cut about 450 employees a year ago, reportedly is under pressure from parent Time Warner to produce about $1 billion in revenue annually.

o Justice Dept. Raids 3 D.C. Video Game Retailers Selling Modified Consoles

Washington -- The U.S. Justice Dept. last week raided three D.C.-area video game retailers, arresting two people on charges of copyright infringement and violation of the Digital Millennium Copyright Act (DMCA). The Dec. 1 raids targeted Pandora's Cube retail stores, which authorities say sold modified PlayStation 2 and Xbox video game consoles with larger hard drives and the capacity to play pirated game titles. It is a violation of the DMCA to circumvent the copyright security technology on devices like video game consoles. "They were burning games onto the hard drive and equipping the hard drive with copying software so that the average consumer could just go ahead and copy the software themselves," Chunnie Wright, anti-piracy counsel to video game industry trade group the Entertainment Software Association, told Reuters.

o Report: Digital Photo Prints to Outnumber Film Prints by 2006

Framingham, Mass. -- The majority of photographs printed in 2006 will be taken by digital cameras rather than their film-based counterparts, according to a report from Massachusetts-based market research firm IDC. The firm estimates that 36% (31 billion) of the 86 billion photos printed this year will come from digital cameras, compared with 55.5 billion from film. The market will shift to digital in 2006, when IDC predicts 56% of photos printed will be digital, growing to 71% of the market by 2008. IDC added that photos printed on home printers currently account for 69% of the market, while 19% are printed by retail-based services. Growth in retail and Web-based printing services is expected to shrink the market for home printers to 43% by 2008, when retail services will represent 33% of the market.

o DVD Trade Group Sues Maker of High-End Home Entertainment Servers

Los Angeles -- Kaleidescape, developer of a high-end home media server that copies DVDs so they may be stored and played without need for the discs, has been sued by the DVD Copy Control Association (DVD CCA), an industry group that holds the patents on DVD anti-piracy technology, CNET News.com reported. The DVD CCA says that Mountain View, Calif.-based Kaleidescape, which has licensed the group's CSS DVD copy-protection technology, violated that license as well as the Digital Millennium Copyright Act with its products. Kaleidescape's servers, which can store up to 3.3 Terabytes of data, won a Best of Innovation award last month from the Consumer Electronics Association. A version that stores 160 DVDs retails for about $27,000. Kaliedescape told News.com it consulted with the DVD CCA on the design of its products, and that it would contest the lawsuit and likely file a counterclaim. "We are flabbergasted by this lawsuit," Kaleidescape CEO Michael Malcolm told News.com. "We have gone to great pains to make our system comply 100 percent with licenses and all the associated technical procedures and requirements." The DVD CCA's suit seeks unspecified damages and a halt to the sale of Kaleidescape's products.

o Ringtone Remix Software Developer Improvista Raises $1.5 Million

Mountain View, Calif. -- Improvista Interactive Music, a provider of ringtone remixing service for 3G wireless carriers, announced that it has raised $1.5 million in its second round of venture capital financing. Infocom America led the investment round; Japan-based Orix Capital, Minato Miriai Capital and Tsunami Network Partners also participated. Mountain View, Calif.-based Improvista's remix4u application lets consumers sample, remix, purchase and download personalized polyphonic ringtones. Customers for the technology include AT&T Wireless Wireless, NTT DoCoMo, Vodafone KK and KDDI. The company will use the funds to enhance its current products and develop new applications, as well as to expand distribution with wireless carriers in the U.S., Europe and Asia.

Montreal -- Mobile entertainment publisher Airborne Entertainment announced on Wednesday that it has acquired Cellus USA, a publisher of wireless entertainment and provider of mobile storefronts and content delivery technology. Financial terms of the transaction were not disclosed. Denver-based Cellus offers a large library of polyphonic and master ringtones, ringback tones and phone graphics, and provides services to create mobile storefronts. "Airborne's strong brand relationships, product lines and carrier distribution, combined with Cellus' mobile storefront capabilities and comprehensive content catalog provides substantial incremental revenue generation possibilities for us, as well as for our carrier and brand partners," said Airborne CEO Garner Bornstein.

o Myspace.com Parent Company Intermix Gets $4 Million Investment

Los Angeles -- Intermix Media, an online media and entertainment company that operates the Myspace.com social networking service, announced on Wednesday that it has received a $4 million equity investment from Redpoint Ventures. Under the terms, Redpoint will receive one million shares of Intermix, and a warrant to purchase an additional 150,000 shares at a price of $4 per share, in return for a minority stake in MySpace, Inc. Separately, Intermix announced the departure of chief financial officer Tom Flahie, for personal reasons. Los Angeles-based Intermix said that Myspace.com, whose rivals include Friendster, is currently adding an average of 35,000 new members daily. The company will use the funds to further expansion of the MySpace infrastructure, reduce the interest of its early investors and founders, and position the company for continued growth and evolution.

o U.K. Outlaws iTrip FM Wireless Transmitter Accessory for iPod

London -- Ofcom, the U.K. communications and media watchdog, announced on Wednesday that the iTrip, one of the most popular accessories for Apple's iPod digital music player, is now illegal in U.K. Ofcom ruled that use of the iTrip, which allows users to broadcast music on their iPods to an external FM radio, was illegal because it essentially functions like a small pirate radio station and therefore violates the Wireless Telegraphy Act. Although the regulator said it would pursue Griffin Technology, the makers of the iTrip, it also said that violators of the Wireless Telegraphy Act could be fined and even face jail time.

o BBC to Save $620 Million and Cut 2,900 Jobs in Digital Transition

London -- BBC Director-General Mark Thompson this week unveiled a radical new program for the broadcaster that will lead to $620 million in savings over the next three years and the elimination of at least 10% of its workforce -- or 2,900 jobs. "My vision for the future of the BBC has three parts: a bold new program and content strategy based above all around the idea of excellence; a transformation of the BBC into a state-of-the art digital broadcaster; and an irreversible shift in the culture of the BBC towards simplicity, opportunity and creativity," he said. Thompson said he wanted to focus more on "excellence" and transform the BBC into a simpler and more creative digital broadcaster in order to better satisfy audience expectations and their relationship with the BBC through interactivity and personalization.

(New York) Shares in New York-based Sirius Satellite Radio plunged 23% on Wednesday, following warnings from two large brokerages that the company's share price had risen too fast in the past couple months. Analysts at both Smith Barney and Bear Stearns reported that a recent string or positive news from Sirius -- including the company's signing of "shock jock" Howard Stern -- had artificially pumped the company's share price 300% over the past two months.

BayTSP, a service that monitors peer-to-peer file-sharing traffic on behalf of entertainment industry clients, announced on Wednesday that "Alien vs. Predator" was the top pirated film in November, based on the number of unique copies available for download on the FastTrack (Kazaa) and eDonkey file-sharing networks. The top five also included "Fahrenheit 9/11," "Van Helsing," "The Terminal" and "Shrek 2." For the first time, Los Gatos, Calif.-based BayTSP also tracked software downloads in November, finding that Norton Antivirus 2005 was the top pirated application. BayTSP added that the eDonkey network saw 2.81 million average daily users in November, extending its lead over the FastTrack network, which counted 2.43 million average daily users during the month.

(Los Angeles) Virgin Digital, the digital entertainment unit of Sir Richard Branson's Virgin, announced on Wednesday that it will distribute pre-paid music download cards in the CVS pharmacy drug store chain in the U.S. The company partnered with Illinois-based CellCards to promote, market, distribute and sell the music download cards through the company's national retail distribution network. (Washington) The Federal Trade Commission (FTC) said in a letter to Congress on Tuesday that peer-to-peer file-sharing companies are implementing policies to better disclose the risks their users face from downloading spyware, pornography and copyrighted content, CNET News.com reported. The letter comes after Congressional hearings on the presence of child pornography and malware on P2P networks. "(Peer-to-peer) industry members have developed proposed risk disclosures that we believe would be a substantial improvement over current practices," FTC chair Deborah Platt Majoras wrote in the letter. "We intend to monitor and report back to interested members of Congress on the extent to which P2P file-sharing program distributors implement these proposed risk disclosures." The disclosures include prominent notices that will appear when users download a file-sharing program. "We are grateful for the interest that the Federal Trade Commission has taken in this young industry's efforts at self-regulation," said Marty Lafferty, CEO of P2P trade group the Distributed Computing Industry Alliance.
