o LA Times: Artists Demand Removal From Labels' Subscription Service

Los Angeles -- The Los Angeles Times reported on Monday that a number of
recording artists are preparing cease-and-desist letters to send to the
major labels' digital subscription services, saying they were never asked
whether or not their songs could be included. "Artist managers are very
alarmed about what's going on here," said Simon Renshaw, a manager at the
Firm, which represents such acts as the Dixie Chicks, Korn and Limp
Biskit. "Attorneys representing a number of our artists have already
transmitted notices to the labels requesting that their copyrights not be
included on Pressplay or MusicNet." The labels argue that the terms of
artists' contracts give them the right to control all forms of
distribution, including digital. But some artists, such as the Beatles,
have specifically stipulated they do not want their music sold digitally.
Artists are weary partly because no payment structure for use of their
works has been announced by the labels, to which the labels respond that
payment will be accounted for once they know how often an artist's tracks
are streamed or downloaded on digital services.

o Napster Back In Court Monday

Pasadena, Calif. -- Napster was back in court on Monday in its ongoing
litigation with the Recording Industry Association of America. This latest
hearing in the two-year effort by the RIAA to stop Napster from enabling
users to share MP3 files will tackle the terms of the injunction issued
against the company. Napster says that record labels must provide
filenames along with the artist and name of song, in line with the
language of the injunction. "One of the key elements in this ruling was
that the plaintiffs had to submit filenames. On this issue, we're asking
that the court simply reaffirm its earlier ruling," Napster attorney
general counsel Jonathan Schwartz told Reuters. The RIAA on the other
hand, argues that, "Napster wants the recording industry to provide file
names after the damage has been done," RIAA spokesman Jano Cabrera told
Wired News. As of press time no new rulings were issued in the case.

o RealNetworks Service In Trials Over 2.5G Wireless Networks

Seattle -- Media delivery technology provider RealNetworks said on Monday
that its technology for delivering digital media over wireless networks is
currently in trials on wireless networks provided by AT&T Wireless,
Sonera, StarHub Mobile and Telefonica Moviles Espana. The trials will test
the delivery of audio and video using GPRS (General Packet Radio Services)
technology over these companies' 2.5G wireless networks. AT&T Wireless
told CNET that the tests are simply an initial technological trial, and do
not mean the company will soon be offering next-generation services. "We
have made no firm commitments in terms of even if we are going to bring
this to market," said AT&T Wireless spokesman Jeremy Pemble. Seattle-based
RealNetworks also announced on Monday that it now supports the MPEG-4
video standard, through a deal with Brisbane, Calif.-based MPEG-4
technology developer Envivio. The company will include MPEG-4 support in
the servers it markets for media delivery. MPEG-4 is significant because
it is a component of the specification for delivering digital media over
next-generation 3G wireless networks.

o CD, DVD Authoring Systems Manufacturer Sonic Solutions Gets $1 Million

Novato, Calif. -- Sonic Solutions, a manufacturer of systems used by
professionals to create CDs and DVDs, announced on Monday that it has
received a $1 million equity investment from Japanese firm Sanshin
Electronics. Sanshin is the Japanese distributor for Novato-based Sonic's
products, which include publishing solutions for the new DVD-Audio format.
Sonic Solutions did not say how it plans to use the funds.

o FTC Asks For More Information On Jupiter-NetRatings Merger

New York -- Internet measurement and analyst firm Jupiter Media Metrix
announced that the U.S. Federal Trade Commission (FTC) has requested more
information from the company regarding its pending merger with rival
NetRatings. The companies did not detail what additional information the
FTC is seeking. At the very least, the request will stall the proposed
merger for 30 days and push its completion until the first quarter of
2002. In October, Milpitas-based NetRatings announced its intention to
acquire Jupiter Media Metrix in a transaction valued at $71 million.

o Web Radio Network Live365 Back On the Air

Foster City, Calif. -- Live365, a provider of nearly 40,000 online radio
stations, is back on the air Monday after a temporary shutdown. "After
being down for a few days, the bandwidth issues have been resolved and
we're back up! Thanks to all for your patience," the company wrote in a
note on its website. Foster City-based Live365 experienced an outage last
week when its Internet Service Provider had its own service suspended by
Cogent, the telecommunications company providing its bandwidth, due to
alleged infractions of Cogent's spam policy.

institutions and other organizations, announced on Monday that publisher
Penguin Classics will make its 1600-title library available online.

(Santa Monica, Calif.) Premium Wireless Services (PWS), a provider of cell
phone ringtones through its YourMobile.com, announced on Monday that it
will provide ringtones to network operator Cingular Wireless. Santa

(Redmond, Wash.) Microsoft said that it has shipped over 1 million Xbox
video game consoles to North American retailers as of the third week of
the game's availability. The company said it plans to ship an additional
300,000 units to retailers through the end of the year, in line with the
company's original estimate that it would put a total of between 1 million
and 1.5 million Xbox consoles in stores during 2001.

network services that help speed content across the Internet, said on
Monday that MusicMatch will use its streaming media services. San
Diego-based MusicMatch's Radio MX service claims more than 1 million
