o Defense Rests Case In ElcomSoft E-Book Copyright Trial

San Jose, Calif. -- The defense rested its case on Tuesday in the
closely-watched trial of ElcomSoft, a Russian software firm accused of
criminal violation of the U.S. Digital Millennium Copyright Act (DMCA) for
its software that can crack the security on Adobe Systems' e-books.
ElcomSoft attorney Joe Burton on Tuesday called company president
Alexander Katalov to the stand, who testified he knew of the DMCA, but
didn't think his company's program violated it. "I was happy this law
exists. I thought this law protects my software from stealing," said
Katalov, according to Wired News' account of his testimony. Katalov's
brother Vladimir, ElcomSoft's managing director, also testified that the
program "is intended for exercising the same fair-use rights to make
working copies of e-books more convenient and more flexible," Wired News
reported. Closing arguments are expected to be heard on Thursday, after
which Judge Ronald Whyte will instruct the jury and their deliberations
will begin.

o Report: Global DSL Providers Added 5 Million Subscribers in Third Quarter

San Francisco -- Global DSL high-speed Internet service subscribership
grew by 5 million in the third quarter of 2002 to reach 30.6 million,
according to the DSL Forum, a consortium of 250 DSL-related equipment and
service providers. The 20 percent increase over the previous quarter was
the greatest increase ever recorded for the service. "We are on track for
100 percent growth in global subscribers this calendar year, ensuring that
DSL widens the gap in the broadband race," said DSL Forum chairman William
V. Rodey. "It is clear that we are well on the way to our target of a
global mass market of 200 million DSL broadband subscribers in 2005." The
report shows the Asia Pacific region currently accounts for 40 percent of
all DSL subscribers, with South Korea leading market penetration; the U.S.
ranked seventeenth overall in the same category. However, the report does
not include data on cable modem-based broadband, which outpaces DSL
subcribership in the U.S. "In the U.S., [cable modem providers] are
beating the hell out of us," Rodey told CNET News.com. "But globally we're
beating the hell out of them."

o Motion Picture Association Sues Nine Alleged Pirate DVD Sellers

Los Angeles -- The Motion Picture Association of America (MPAA), a trade
group representing major film studios, announced that it has filed suit
against nine online vendors who allegedly sold pirate DVD copies of films
through online auction sites including EBay. The MPAA worked with EBay on
the piracy crackdown, and EBay is not a party to the litigation. "It is an
unfortunate reality that consumers may be sorely disappointed, finding
that the DVD or video that they paid for is not a bargain at all and that
it is, in fact, of a much lower quality than what they expected," said
MPAA president and CEO Jack Valenti. One of the defendants named, Todd
Aspinwall of Windsor Locks, Conn., told Reuters he is an "avid collector"
who buys and sells around 100 DVDs per week on EBay, and that he "never
believed that any of these were pirated DVDs." The MPAA suits were filed
in Connecticut and seven other states.

o Report: Publishing, Media Firms Spent 15.5% of Q1 2002 Ad Budgets Online

New York -- Publishing and media firms devoted 15.5 percent of their first
quarter 2002 advertising budgets of $479 million to online advertising,
according to a Cross Media Ad Spending report released by online ad firm
DoubleClick and measurement firm Nielsen//NetRatings. This figure compares
with other markets such as employment services, which spent 41 percent
online; travel/hotels, which spent 12 percent; and retailers, which spent
a total of 15.5 percent of their first quarter 2002 ad budgets online.  
"Conventional wisdom has it that most advertising spending has been one or
two percent of the total online advertising budget, but according to these
results, the reality is that some key categories are actually spending
much more significant portions of their advertising budgets online," said
Doug Knopper, vice president and general manager of online advertising
solutions for DoubleClick.

o MusicMatch Adds Interactive Streaming Subscription Offering

San Diego -- MusicMatch, a provider of digital music player software and
online music subscription services, announced on Wednesday the launch of a
new interactive streaming subscription service, Artist On Demand. The
service lets subscribers create instant playlists composed of artists of
their choice, to form an on-demand catalog of music from MusicMatch's
available offering of 20,000 albums from 8,000 artists. The service will
be bundled with San Diego-based MusicMatch's MX Platinum service, which is
offered for a fee of $6.95 monthly, $17.85 quarterly or $59.40 annually.

(New York) Publisher Primedia said on Wednesday it plans to distribute
magazine-style programming through cable TV operator Comcast's
video-on-demand service. The "Video Mags" service will launch in the
Philadelphia area with eight video magazines, consisting of 40 hours of
content. The initial video magazines will include "Motor Trend,"
"Parenting Basics," "TeenNews" and "In-Fisherman." Primedia partnered with
Santa Monica, Calif.-based Ascent Media, a subsidiary of Liberty Media, to
provide encoding and metadata management and creation for the service.

Wednesday it is currently developing the first title in a new franchise of
baseball video games. "MVP Baseball 2003" will feature design input from
MLB players Torii Hunter, Trot Nixon, Todd Pratt, Eric Chavez and Tim
Hudson, in addition to play-by-play and color commentary from San
Francisco Giants announcers Duane Kuiper and Mike Krukow. The title is due

Wednesday that its recently added TiVo Showcase programming -- which
offers advertisers the ability to offer viewers video-on-demand features
